Subject: 2025 Desert X Exhibition Sponsorship Requests in the Amount of $35,000 RECOMMENDATION:
Consider the approval of:
1) Sponsorship in the amount of $25,000, to support the 2025 Desert X Exhibitions; and 2) Sponsorship in the amount of $10,000, to support the 2025 Desert X Closing Ceremony to be held in the City of Desert Hot Springs.
BACKGROUND:
During the past year Desert X has met with City Staff to discuss the proposed public art installations and activations within the City of Desert Hot Springs for the 2025 Desert X Exhibition . Desert X creates contemporary art exhibitions that engage with desert environments through site-specific installations by acclaimed and emerging artists from around the world.
From March 8, 2025-May 11, 2025, Desert X will showcase various art exhibitions throughout the Coachella Valley, including four exhibitions in and around the City of Desert Hot Springs which will be accompanied by hands-on participation from local high school students. As part of each exhibition, Desert X creates programming that complements the artists and installations while engaging visitors both locally and internationally.
This year Desert Hot Springs will host three exhibitions within city limits, with a fourth installation in our area of influence, thus helping increase tourism in the community. 1) The first installation, “To Breathe - Coachella Valley” is being proposed by artist Kimsooja, on Pierson Boulevard between Foxdale Drive and Miracle Hills Road. 2) The second installation, “Soul Service Station” is being proposed by Alison Saar on Pierson Boulevard between North Indian Canyon and Desert Terrace Way. 3) The third installation, "G.H.O.S.T. Ride" is being proposed by artist Cannupa Hanska Luger on Pierson Boulevard between Foxdale Drive and Miracle Hills Road. Note: This artwork is a mobile installation, it will be sited here for 3-weeks and then move to another site outside of Desert Hot Springs. 4)The fourth installation, while not in City limits, is in Desert Hot Springs' area of Influence. This installation, "The act of being together" is being proposed by artist Jose Davila and is located on Item Number: 4.

Worsley Road between Pierson Boulevard and Painted Hills Road and is the site of the opening night toast.
As in years past, Desert Hot Springs youth will work with Desert X Educators and Desert X Artists through in-person classes, site visits, and individual studio chats to learn about the exhibitions and produce original documentary films expressing their unique perspectives on Desert X 2025.
Finally, Desert X is requesting sponsorships from various cities in the Coachella Valley. The proposed funding request for the City of Desert Hot Springs includes a Closing Ceremony to be held at Dillon's Burgers & Beer to celebrate the completion and installation of all of the Desert X art installations.
Desert X will begin on March 3rd and will end May 6th with a closing ceremony at Dillon's Burgers & Beer.
DISCUSSION:
Jenny Gil Schmitz, Executive Director of Desert X, submitted a request for funding:
1) A sponsorship in the amount of $25,000, to support the 2025 Desert X Exhibitions and 2) A sponsorship in the amount of $10,000, to support the 2025 Desert X Closing Ceremony.
FISCAL IMPACT:

Dear Desert Hot Springs City Council,
The Desert X team is full steam ahead for Desert X 2025. Our internationally-renowned contemporary art exhibition will be held March 8 – May 11, 2025 throughout the Coachella Valley. Civic partnership has been and continues to be essential to the exhibition’s success, and we submit here a formal request and proposal for funding to the City of Desert Hot Springs. All of us at Desert X are appreciative to the city for past exhibition support and are hopeful that it will renew support in 2025.
Desert X would like to request $25,000 in exhibition support plus $10,000 to host our exhibition closing celebration in May 2025 in Desert Hot Springs.
Since 2017, Desert X hosted several installations by prominent artists in Desert Hot Springs that showcase the city’s natural beauty, welcoming community spirit, and local businesses and presented enriching and engaging public program experiences that activate public spaces within the city and promote art education and awareness. Installations hosted in Desert Hot Springs to date include:
• Richard Prince, Third Place, 2017
• Julian Hoeber, Going Nowhere Pavilion #01 & Executed Variant DHS #1 (Q1, CJ, DC), 2019 • Kathleen Ryan, Ghost Palm, 2019
• Zahrah Alghamdi, What Lies Behind the Walls, 2021
• Alicja Kwade, ParaPivot (sempiternal clouds), 2021*
• Tschabalala Self, Pioneer, 2023
• Mario Garcia Torres, Searching for the Sky, 2023
• Hylozoic/Desires, Namak Nazar, 2023
*Installation was located in Sky Valley
Desert X has also collaborated with Desert Hot Springs High School for Viewpoints, an educational program and video series that allows emerging creatives across the Coachella Valley (including students at including Desert Hot Springs High School) to explore and document the exhibition installations.
In 2025, Desert X plans to continue to utilize public spaces and resources in Desert Hot Springs in its installations and public programming to engage local and visiting audiences of all backgrounds and ages.
Desert X’s Education programming is expanding to the studio art classroom through the Desert X Art Club.
Alongside dynamic digital storytelling workshops in classrooms across all three school districts, the Desert X Art Club will engage studio art students from K-12 in a collaborative, hands-on arts appreciation program through in-person classroom instruction, after-school programs, school tours, community family day events, and more. Student creative work will be exhibited and celebrated at a juried show at the Marks Item Number: 4.

Gallery in May 2025. We are also proud to be continuing our Viewpoints documentary program.
Viewpoints engages at-promise youth and budding creatives in the community to produce short documentaries on installations in each exhibition. Using varied aesthetic and narrative approaches, from video journalism to personal storytelling and experimental film structures, the series showcases the unique voices and perspectives of Desert Hot Springs and Coachella Valley youth as they investigate and respond to the artworks of Desert X. From January through May 2025, PSUSD students will work with Desert X Educators and Desert X Artists through in-person classes, site visits, and individual studio chats to learn about the exhibitions and produce original documentary films expressing their unique perspectives on Desert X 2025.
Thank you for your consideration, continued collaboration and support of Desert X. We look forward to discussing this proposal further. We are always open to new ideas and creative ways to bring our partnership to life.
Sincerely,
Jenny Gil

ABOUT THE CURATORS
Kaitlin Garcia-Maestas is Curator and Director of Exhibitions at Socrates Sculpture Park in Queens, NY. Born and raised in New Mexico, her research and curatorial interests have primarily explored themes of displacement, decolonial resistance, and cultural hybridity in the United States and the Americas. For over a decade, she has been devoted to the advocacy and realization of large-scale, site-specific installations by BIPOC and emerging artists.
Previously, Garcia-Maestas was Acting Curator of Visual Arts at the Momentary, the contemporary satellite space of Crystal Bridges Museum of American Art in Bentonville, AR. While at the Momentary she oversaw the artist-inresidency program and organized over a dozen exhibitions and outdoor installations, including site-specific projects.
Prior to the Momentary, she held curatorial positions at the Denver Art Museum, the Biennial of the Americas, and MCA Denver.
Neville Wakefield is a postmodern writer and curator interested in exploring the ways in which art behaves outside of institutional contexts. As senior curatorial advisor for PS1 MoMA and curator of Frieze Projects, he gained a reputation for challenging the conditions that shape art in both commercial and noncommercial contexts. Explorations of time and space have been a signature part of his practice. He has worked extensively with international institutions, including the Schaulager in Switzerland, where he curated the Matthew Barney retrospective Prayer Sheet with the Wound and the Nail one of the first shows to juxtapose the work of a contemporary artist with that of half a millennium before. Space as it relates to landscape and land art led him to co-found Elevation1049, a site-specific biennial in Gstaad, Switzerland, while also shaping the recurring Desert X exhibitions in the Coachella Valley region of Southern California of which he is Founding Artistic Director. He has also been instrumental in the development and success of Desert X AlUla, taking place in AlUla northwest Saudi Arabia, home to the country’s first UNESCO World Heritage Site, Hegra along with numerous other initiatives aimed at promoting art in the Gulf region.

In the Coachella Valley, where time unfolds in geological epochs and the wind weaves stories through ancient
mountains, a profound reverence for the enduring spirit of this harsh yet resilient region emerges, challenging us to glean wisdom from its vast knowledge. Far from an
empty expanse, the desert landscape acts as a canvas of real and imagined histories, narrating tales of
displacement, sovereignty and adaptation superimposed
over visible testaments of time.
Reflecting on the desert’s deep time evolutions, the fifth edition of Desert X will delve deeper into nonlinear
narratives of time, forming a space where ancestral
wisdom intertwines and collides with contemporary
visions for our collective future.

Dávila’s sculptural work is based on the specificity of the employed materials. Their origin, symbolic value
and their formal characteristics are elements that
take great significance; industrial materials interact
with organic raw materials. They reflect the
phenomenon of gravity, the laws of static and
dynamic energy, the tractive force used to generate
motion and the compression strength, the potential
for deformation prior to the rupture of material, and
above all, of structural intuitions. With these
sculptures, Dávila intends to provide visibility to the physical processes that are required in order for
things to maintain their shape and occupy space in a
specific manner.

AGENDA ITEM REPORT
To: City Council
Date: February 27, 2025
Department: Code & Cannabis Compliance
Prepared by: Christina Newsom, Compliance Director
Subject: Massage Establishment Permit Requirements and Regulations Update RECOMMENDATION:
Receive and file.
BACKGROUND:
In November 2022, the City Council took decisive action to address a growing concern regarding unlawful activities and complaints associated with local massage therapy parlors.
The previous regulations were deemed insufficient to combat issues such as human trafficking and to ensure the integrity of massage therapy practices within the community. Consequently, the council passed an ordinance that repealed and replaced the existing massage establishment regulations.
The newly adopted regulations aimed to achieve several critical objectives:
Deter Human Trafficking Activity: The primary goal of the updated regulations is to create a safer environment by deterring human trafficking activities that have been reported in connection with some massage establishments.
Permit Requirement for Massage Establishments: The ordinance mandates that all massage establishments not connected to a hotel or spa must obtain a Massage Therapy Establishment Permit.
Operational Regulations: The new regulations establish clear operational guidelines for massage establishments, ensuring that they adhere to State regulations and maintain a standard of professionalism.
Certification Requirements: The regulations require that all practitioners obtain certification from the California Massage Therapy Council("CAMTC") to enhance the credibility of massage therapy services. This requirement helps to ensure that only qualified individuals are providing massage services.
Suspension and Revocation Provisions: The regulations outlined robust provisions for suspending and revoking massage establishment permits. In cases of suspension or revocation, the establishment must immediately cease operations, and no other establishment can operate at that Item Number: 5.
SR-25-045
location under the same ownership for a minimum of one year.
DISCUSSION:
Since adopting the new regulations, City staff has taken significant steps to ensure compliance and uphold the integrity of massage therapy practices. A comprehensive massage establishment permit application was developed, which includes several critical components:
Background Checks: All applicants, owners, operators, or managers not CAMTC certified are subjected to thorough background checks to identify any prior violations or criminal activities that may disqualify them from operating a massage establishment.
Roster and Modality Requirements: Applicants must provide a roster of all owners, managers, and massage therapists employed at the establishment and details regarding the modalities offered, ensuring transparency and accountability.
Lease Inspection Requirements: The application process includes a requirement for lease inspections to verify that the premises meet the necessary standards for operation and that property owners are aware that massage therapy activities are taking place at the property.
Since the new regulations were enacted, the Code Compliance staff has conducted 18 inspections to enforce compliance with state and local regulations. These inspections are designed to ensure that massage establishments adhere to the established regulations and maintain a high standard of service.
Additionally, City staff processed fourteen permit applications for massage establishments. City staff conducted thorough investigations to process these applications, reviewing the background checks of owners, operators, managers, and therapists, and reviewed all online advertisements for the entity.
Five of the thirteen applications were denied due to failures of background checks and violations related to sexually explicit advertising, which are strictly prohibited under State regulations.
Moreover, two permits were revoked due to serious violations. In both cases, individuals were found to be conducting massage services without the required California Massage Therapy Council certifications. They both had previous charges filed against them related to sexually explicit crimes.
These actions underscore the city's commitment to enforcing the new regulations and ensuring that only qualified and law-abiding individuals operate within the massage therapy industry.
The updated massage establishment regulations have led to significant changes in the City's operational landscape of massage therapy. The proactive measures taken by city staff, including rigorous inspections and stringent permit requirements, reflect a strong commitment to public safety and the integrity of the massage therapy profession. The ongoing enforcement of these regulations will continue to play a crucial role in deterring unlawful activities and promoting a safe environment for both practitioners and clients.

AGENDA ITEM REPORT
To:
Date: March 4, 2025
Department: Administrative Services
Prepared by: Geoffrey Buchheim, Administrative Services Director Subject: Mid-Year Budget Adjustments for the 2024-2025 Fiscal Year RECOMMENDATION:
Adopt a Resolution of the City Council approving the Mid-Year Budget Adjustments for the 2024-2025 Fiscal Year.
BACKGROUND:
During the regular course of business, adjustments to the budget become necessary as new information for more accurate estimates become available. Staff is able to make changes to the forecasted revenues based on new information that is received during the fiscal year. In addition, as actual changes in programs occur, such as changes in staff positions, and new or altered demands for contracted services, expenditure forecasts can be made more accurate. These adjustments allow the City to continue daily operations, on-going repairs, maintenance, and improvements to the City’s public facilities and to provide appropriations for unanticipated expenses.
The City’s Finance Staff worked in cooperation with staff from other City departments to determine the changes in their needs for FY 2024-2025. The items presented here are the adjustments for FY2024-2025 for the City Council’s review. To date, these adjustments reflect staffing changes, other operational changes, and improvement projects.
DISCUSSION:
-Consolidated General Fund: Revenue Reduction
The Consolidated General Fund consists of three funds used to account for virtually all required services funded predominantly with discretionary revenue sources that help to properly maintain clean, safe, well-lit city streets and parks and other essential core City services like emergency response, roads, police, and addressing homelessness. Those funds are as follows:
General Fund (Fund 100)
Emergency Reserve Fund (Fund 212)
Public Safety Fund (Fund 245)
Item Number: 6.
SR-25-044
The summary of the mid-year budget adjustments for FY2024-2025 in the Consolidated General Fund are as follows:
Consolidated General Fund FY2024-2025 Mid-Year Adjustments Change in Revenues $2,179,218 increase
Change in Expenses $2,138,071 increase
Revenues over Expenditures $41,147
Since the cannabis industry has been experiencing difficulty for the last several years, the City reduced the cultivation tax to $5.75 per square foot and redefined cultivation space to canopy space.
This resulted in a reduction in annual revenues for the cultivation tax but has increased the collection rate. However, the retail portion of the cannabis industry is no longer as robust leading to a $500,000 reduction in the budgeted dispensary tax for FY24-25. To offset the loss of cannabis tax revenues, the residents approved a 1% Transaction and Use Tax this past November. The tax will commence on April 1, 2025, and is estimated to bring in an additional $880,000 for the remainder of FY 24-25. In addition, the City has been fortunate enough to experience an increase in development, such as new houses being built in Skyborne, Rancho Descanso, and other developments. These new developments are expected to provide an additional $901,000 in development-related fees. Other revenue increases include additional Tax Increment Pass-Thru, Utility User Tax, and receipts from other fees that have already exceeded budget estimates. The City also received reimbursable grant revenue from grant expenditures made in previous fiscal years. These changes result in an estimated $2,179,218 increase in budgeted revenues.
Increased Service Needs
At the same time, the City is experiencing increases in annual expenditures, in order to continue providing the core services residents have told us are important to them, including 911 emergency response, addressing homelessness, and maintaining well-lit city streets and public places. In order to continue services for the unhoused, the City Council authorized an additional $1 million for the operations of the HUB as well as additional staffing. With the transfer of the properties from the Coachella Valley Humane Society, the Animal Control division needs additional staff for the administrative needs of its expanded services. Other additional personnel services cost increases include a $282,481 increase in the annual CalPERS Side Fund payment, increases in worker’s comp insurance premiums, additional overtime, and annual leave buyout costs. Other increases include additional building repair & maintenance, park improvements, engineering services for the increased development, and increased use in technology. These adjustments also include some cost decreases. With the change of the firm for the City Attorney and the transition to retainer payment rather than actual hours works, the City is expected to save an additional $150,000 for the remainder of FY24-25. While the construction of Fire Station 98 continues, the ramp-up of additional staffing has not been going as quickly as expected. Therefore, the City can reduce what it expects to pay to the County for fire services for FY24-25 by $650,000. These measures have resulted in an increase of $2,138,071 in budgeted expenditures for FY24-25.

AGENDA ITEM REPORT
To: City Council
Date: March 4, 2025
Department: City Manager
Prepared by: Doria Wilms, Deputy City Manager
Subject: The Hawley Living Trust Nomination of Successor Trustee - Animal Care and Control Beneficiary
RECOMMENDATION:
Authorize the City Manager to execute the Nomination of Successor Trustee, and further negotiate any and all documents associated with any “gifts or donations” to the City of Desert Hot Springs from the Hawley Living Trust dated September 9, 2001
DISCUSSION:
On or about February 5, 2025, the City received a letter from the law firm of Lonich, Patton, Ehrlich, and Policastri (“Law Firm”), representing the Hawley Living Trust Dated September 9, 2001 (“Trust”).
This letter notified the City that the Desert Hot Springs Animal Care Center has been named as a remainder beneficiary of the above referenced Trust and requested the City execute the Nomination of Successor Trustee. Such execution would allow for the appointment of Michelle Babbage to serve as Successor Trustee of the Trust to allow for the administration of the Trust to proceed without further delay.
On February 18, 2025, City Attorney, Jennifer Mizrahi spoke with Nick Cerveny from the Law Firm regarding the Trust. At this time, the City Attorney does not see any risk in executing the Nomination of Successor Trustee, especially in light of the fact that: 1) the Trust asset disbursement is being overseen by the Superior Court; and 2) the City is a remainder beneficiary possibly receiving moneys, gifts or other assets.

AGENDA ITEM REPORT
To: City Council
Date: March 4, 2025
Department: Administrative Services
Prepared by: Geoffrey Buchheim, Administrative Services Director Subject: Revised Resolution for Examination of Confidential Records RECOMMENDATION:
Adopt a revised Resolution of the City Council authorizing examination of sales or transactions and use tax records.
DISCUSSION:
On November 5, 2024, the residents of Desert Hot Springs approved a 1% local transactions and use (sales) tax. On December 20, 2024, the City Council approved the following documents:
Certified copy of the Resolution to Execute Agreements Preparatory Agreement
Administration Agreement
Resolution for Examination of Confidential Records
Certified copy of the Transactions and Use Tax Ordinance Certification of Final Election Results
The documents were immediately sent to the California Department of Tax and Fee Administration (CDTFA) to begin the process of levying the new local transaction and use (sales) tax.
After a review of the documents, the CDTFA requested revisions to the Resolution for Examination of Confidential Records. This resolution allows for the City and its consultant to access the confidential sales tax records. The revisions to the resolution are revised wording to include reference to Ordinance Number 73-14 and Ordinance Number 807. The resolution also needs to include the full business name of the City’s consultant which is Hinderliter de Llamas & Associates doing business as HdL Companies.
FISCAL IMPACT:
There is no fiscal impact. This resolution just allows the City and its consultant to examine the confidential records related to the transaction and use tax. It does not affect the collection of the tax.

AGENDA ITEM REPORT
To: City Council
Date: March 4, 2025
Department: Administrative Services
Prepared by: Geoffrey Buchheim, Administrative Services Director Subject: Designation of Applicants Agent Resolution for Non-State Agencies CalOES Form 130
RECOMMENDATION:
Approve the Form 130 Disaster Designees as the City Manager, Deputy City Manager, and Administrative Services Director, to direct City Clerk to certify and to direct staff to submit CalOES Form 130 to the California Office of Emergency.
BACKGROUND:
In mid-February 2019, storms cause significant damage to City property requiring extensive repairs and clean-up efforts. On May 1, 2019, the federal government declared a major disaster making federal disaster aid available to 11 counties in California for the Mid-February 2019 Storms event.
Riverside County was included as one of the 11 counties. The City now has the opportunity to apply for FEMA grants for reimbursement for the costs incurred in repairs, debris removal, and emergency response. One step in this process is to provide the State with Form CAL OES 130.
DISCUSSION:
On August 20, 2023, Tropical Storm Hillary caused severe damage to many roads in the City requiring extensive clean-up and repairs. The City is eligible to receive reimbursement of these costs by the State and Federal governments. In order to receive State and Federal financial assistance for disaster relief, CalOES requires an updated Form 130 to be on file. The California Office of Emergency Services (CalOES) Form 130 authorizes the positions listed to execute for and on behalf of the City of Desert Hot Springs for the purpose of obtaining certain Federal financial assistance, under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, P.L. 93-288, as amended, 42 U.S.C. 5121 et seq., and Related Authorities as of April 2013, and/or State financial assistance under the California Disaster Assistance Act (CDAA). The City last filed Form 130 in December 2019 and it was only valid for three years. Since the previous form has expired, the City must file a new Form 130.
The positions designated on the form are the City Manager, Deputy City Manager and Administrative Services Director. By approving and submitting this form, the City designates personnel to act as an agent in obtaining financial assistance for any disasters. The City will need to submit another Form 130 to CalOES in three years.
FISCAL IMPACT:
Item Number: 10.
