AGENDA ITEM REPORT
To: City Council
Date: March 18, 2025
Department: City Clerk
Prepared by: Jerryl Soriano, City Clerk
Subject: OneFuture Coachella Valley Funding Request
RECOMMENDATION:

Consider a $25,000 sponsorship proposal from OneFuture to provide educational services to the City of Desert Hot Springs residents.

BACKGROUND:

In 2005, the Coachella Valley Economic Partnership (CVEP) launched a career pathways program to increase educational attainment as a driver of economic development. This program built a connection between local businesses, K-12 districts, high school career pathways programs, higher education, and county partners to provide student support systems to create a stronger workforce for local businesses. The program then expanded to include a college access and scholarship initiative called Pathways to Success and was ultimately combined under CVEP’s Workforce Excellence division.

In 2012, a Regional Plan for College and Career Success was created, with the CVEP Workforce Excellence division leading the implementation. The Plan outlined a five-year framework for business, education, and community partners to collaborate to achieve goals.

Excellence division leading the implementation. The Plan outlined a five-year framework for business, education, and community partners to collaborate to achieve goals.

In 2017, the Workforce Excellence division was spun off from CVEP and OneFuture Coachella Valley was established as a stand-alone 501(c)(3). The organization was created to lead the development and implementation of Regional Plan 2.0, emphasizing college completion, workforce readiness and job attainment for local students.

The City provided previous support to OneFuture as follows:
 FY 2023-24 - $25,000
 FY 2022-23 - $25,000
 FY 2021-22 - $25,000
The attached proposal outlines how our funding will be used by the organization to help assure students succeed in college, career, and life.

Purpose: OneFuture Coachella Valley submits this comprehensive proposal to provide invaluable services to the City of Desert Hot Springs aimed at elevating educational attainment and income potential for low-income residents. The primary objective of this partnership is to bolster economic recovery and prosperity through degree completion among local students, coupled with enhancements to the quality of the workforce.

Investment: Recognizing the shared vision for long-term economic growth and the inherent benefits of higher education, OneFuture proposes a strategic investment of $25,000 through a Regional Investment Fund. This fund serves as a catalyst for sustainable economic progress, fostering a skilled workforce and empowering residents with the tools for successful careers and entrepreneurship.

AGENDA ITEM REPORT
To: City Council
Date: March 18, 2025
Department: Administrative Services
Prepared by: Geoffrey Buchheim, Administrative Services Director Subject: Resolution of Intention to Create a Special Tax Area Zone for Property Rancho Descanso to the Desert Hot Springs Public Safety Tax Area RECOMMENDATION:

Adopt a Resolution of Intention which establishes the time and place of the Public Hearing to establish Zone 55 within the Special Public Safety Tax Area for Police and Fire Protection Services and authorizing an election.

DISCUSSION:

It is of critical importance to the City Council of the City of Desert Hot Springs that residents of the City receive high quality police and fire protection services. In carefully reviewing the City’s budget and revenue projections with the Police and Fire Departments it has become clear to City staff that the City budget does not contain adequate funding to ensure the continued delivery of adequate highquality public safety services unless additional revenues are obtained.

This Resolution of Intention establishes the time and place of the Public Hearing to establish Zone 55, within the Public Safety Tax Area, for police and fire protection services and authorizing the levy of a tax on improved parcels of real property on the secured property tax roll of Riverside County that are within Zone 55 of the Desert Hot Springs Special Public Safety Tax Area (the “Zone”). The voters of Zone 55 recognize the importance of adequate public safety services to the entire Desert Hot Springs community and approve this tax to ensure that those services will be maintained and improved citywide.

The revenues raised by this tax are to be used solely for the purposes of obtaining, furnishing, operating, and maintaining police and fire protection equipment or apparatus, for paying the salaries and benefits of police and fire protection personnel, and for such other police and fire protection service expenses as are deemed necessary for the benefit of the residents of Zone 55. Exhibit B of the Resolution is a copy of the petition requesting the creation of Zone 55.

FISCAL IMPACT:

The applicant has paid a deposit of $5,000, which covers the costs of establishing the zone. The property owner is responsible for all costs and payment of associated levy amounts applied to the annual tax roll for police and fire maintenance services.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DESERT

FOR ASSESSOR’S PARCEL NUMBER 656-500-001 THROUGH 656-
500-040, AND 656-510-001 THROUGH 656-510-038
WHEREAS, it is the intention of the City Council of the City of Desert Hot Springs (the “City Council”) to create Zone 55 within the City of Desert Hot Springs Special Public Safety Tax Area and authorize an election; and
WHEREAS, it is the intention of the City Council to adopt an ordinance establishing a special tax for police and fire protection services within Zone 55; and WHEREAS, the City of Desert Hot Springs recognizes the need for increased police and fire protection services (hereinafter “public safety services”) in Zone 55 and the difficulty of funding the current or increased level of services with revenues now available; and WHEREAS, the City Council has received a written instrument from the landowners within Zone 55 to initiate and conduct proceedings for the creation of Zone 55 within the City of Desert Hot Springs Special Public Safety Tax Area and consenting to the shortening of election time requirements, waiving analysis and arguments, and waiving all notice requirements relating to the conduct of the election; and WHEREAS, it is the intention of the City Council to direct the City Clerk to conduct the election required by Government Code Section 53978 to be conducted by mail ballot pursuant to Elections Code Section 4000 and to be held on the earliest date permitted by law; and WHEREAS, Assessor’s Parcel Numbers 656-500-001 through 656-500-040, and 656-510-001 through 656-510-038, 76 Single Family Residential units. The initial annual tax will be $351.37 per unit annually, per the Desert Hot Springs Special Public Safety Tax – Tax Rate Table (approved by the City Council on March 1, 2005 Resolution No. 2005-07 and amended by Resolution No. 2005-49 approved on July 6, 2005, adjusted for inflation as provided for in Section 3(B) of Exhibit C); and WHEREAS, this Resolution is adopted pursuant to Government Code section 53978; and WHEREAS, under Government Code section 53978 and for the purposes of this Resolution, a “voter” entitled to vote on the creation of Zone 55 is a person who owns real property within Zone 55, as shown on the last equalized assessment role prepared by the Riverside County Assessor’s Office, at the time that the City Council submits an ordinance authorizing the imposition of a public safety tax to the voters of Zone 55. At the time that the City Council adopted this Resolution, there were 0 registered voters residing within Zone 55 and a single property owner. Because the Special Public Safety Tax will be imposed on property in Zone 55 and paid by the owner of the property, the City Council finds that restricting the vote on the Special Public Safety Tax to the property owner in Zone 55 is appropriate and consistent with the principles and requirements of California Constitution article XIIIC (Proposition 218).

NOW THEREFORE, be it resolved as follows:

AGENDA ITEM REPORT
To: City Council
Date: March 18, 2025
Department: City Manager
Prepared by: Doria Wilms, Interim City Manager
Subject: Amendment to the Professional Services Agreement with The Mural Supply Co.

RECOMMENDATION:

Approve the Amendment to the Professional Services Agreement with The Mural Supply Co. to modify Section 4 - Compensation as follows; The City agrees to pay consultant for and in consideration of the faithful performance of the services and duties set forth in this agreement, and consultant agrees to accept from the city, as compensation for the faithful performance of said services and duties, Two Hundred Forty Thousand Dollars, and Zero Cents ($240,000.00) for the successful completion of twelve murals in the downtown and 8 days’ worth of events highlighting murals, which eight days shall be scheduled and approved by the City Manager. Payment for each mural and event will be remitted to consultant within 15 days of invoice and upon successful completion as determined by the City Manager or their designee in their sole discretion.

BACKGROUND:

On October 1, 2024 the City Council authorized the Professional Services Agreement with The Mural Supply Co. for the curation of the First Friday Arts and Cultural Event and Mural Program in the Downtown Arts and Culture District.

Since January, The Mural Supply Co. has commenced the completion of five murals in the downtown and anticipates the completion of the final seven murals over the next two months. The speed with which this project is being executed is much faster than initially anticipated and is driven by artist schedule and availability.

The original agreement capped payment at a fixed amount per month based on the successful completion of one mural and one "First Friday Event". The proposed amendment would modify those terms to allow for funds to be expended as the murals are completed and would modify the eight individual "First Friday Events" into a two weekend event, totaling eight days, to coincide with the April Festival season which consists of Coachella Festival and Stagecoach.

FISCAL IMPACT:

There is no fiscal impact as the funding for this project was previously approved.

AGENDA ITEM REPORT
To: City Council
Date: March 18, 2025
Department: City Manager
Prepared by: Daniel Porras, Deputy City Manager
Subject: Inspection Services Hacienda Avenue Street Improvement Project 3003 RECOMMENDATION:

Authorize the City Manager to draft and execute the Professional Services Agreement for Inspection Services for the Hacienda Avenue Street Improvement Project, City Project No. 3003, to Omnis Incorporated, in an amount not to exceed $110,800.00 with a 10% contingency of $11,080.00 bringing the total amount to $121,880.00.

BACKGROUND:

The Hacienda Avenue Street Improvement Project extends along Hacienda Avenue from West Drive to Tamar Drive. The project scope of work includes the construction of 10,000 lineal feet of sidewalk with ADA accessible driveways, new bike lane, new parkway with landscaping, 39 new street lights, new ADA ramps, and new striped crosswalks. These improvements will provide a safer pedestrian and bicycle access route to various schools, parks, transit route stops, commercial areas, and residential neighborhoods.

On January 19, 2021, the City Council awarded the professional services agreement for engineering design for the Hacienda Avenue Street Improvement Project to Kimley-Horn and Associates.

In order to secure funding for the construction of the project the City applied and was awarded multiple grant funds for this project.

On March 13, 2019, the City applied and was awarded $1,322,000.00 for the construction of the Hacienda Ave Street Improvement Project from the California Active Transportation Program (ATP) Grant Funds Cycle 4.

On March 6, 2024, the City applied was awarded $2,999,000.00 for the construction of the Hacienda Ave Street Improvement Project from the Clean California Local Grant Program Cycle 2.

On December 12, 2024, the City Council awarded the construction agreement to the lowest responsive qualified bidder All American Asphalt in an amount not to exceed $6,632,992.00, and authorized a total project budget in an amount of $7,295,191.20. This total budget amount included an estimated $124,000 for As-needed Inspection Services.

SR-25-064
DISCUSSION:

In order to move the project through construction with inspections services, quality assurance, and quality control, the City requested a proposal from Omnis Incorporated for as-needed inspection services for this project. Omnis Inc. has provided Capital Improvement Project Inspection Services to the City for over 7 years, more recently to all 3 phases of the Palm Drive Street Improvement Projects, the Changeable Message Signs projects, and the HSIP Traffic Signal Improvement Projects. Omnis Inc. Staff understands all of the City needs and requirements and has successfully provided inspections services for all projects, with no complaints. This project specifically involves construction along the street and will require working with multiple private property owners and addressing their needs during construction. Omnis Incorporated has dealt with very similar situation in other previous projects and has found positive solutions to all issues that arise.

The City’s Municipal Code 3.44.180 allows for “…the selection of professional services …to be based on demonstrated competence and professional qualifications necessary for satisfactory performance of services required, as so determined by the Department Head. An RFP is not required. The emphasis for selection is therefore based upon qualifications, rather than the lowest price…” In this case Omnis Incorporated has demonstrated the specific qualification to perform inspection services for this project.

Staffs is recommending that City Council award the Professional Services Agreement for Inspection Services for the Hacienda Avenue Street Improvement Project, City Project No. 3003, to Omnis Incorporated, in an amount not to exceed $110,800.00 with a 10% contingency of $11,080.00 bringing the total amount to $121,880.00. The City Council previously approved a total budget amount of $124,000 for As-needed Inspection Services when the construction agreement was awarded for the project.

FISCAL IMPACT:

On December 12, 2024, the City Council awarded the construction agreement to the lowest responsive qualified bidder All American Asphalt in an amount not to exceed $6,632,992.00, and authorized a total project budget in an amount of $7,295,191.20. This total budget amount included an estimated $124,000 for As-needed Inspection Services.
