Agenda #: 5.3
Meeting Date: February 6, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Daniel Fox, City Manager
TITLE: ANNEXATION OF FORTY-SEVEN (47) EXISTING STREET LIGHTS TO THE COUNTY LIGHTING MAINTENANCE DISTRICT 10006.
STRATEGIC
GOAL: Responsible Stewardship of Public Resources
RECOMMENDATION:
Adopt Resolution No. 2024-03 Granting Consent and Jurisdiction to the County of Los Angeles to Annex Existing Streetlights to County Lighting Maintenance District 10006 and County Lighting District LLA-1, Diamond Bar Zone.
FINANCIAL IMPACT:
None. The County Lighting Maintenance District (CLMD) 10006 and County Lighting District LLA-1, Diamond Bar Zone are responsible for the operation and maintenance costs of approximately 5,000 streetlights in Diamond Bar, which are funded by property taxes.
BACKGROUND:
Prior to the City’s incorporation, the Los Angeles County Public Works Department formed Lighting Maintenance Districts to appropriate property tax funding for streetlight operation and maintenance costs. Eligible streetlights must be annexed into the County Lighting Maintenance District (CLMD) to benefit from this service. In Diamond Bar, there are approximately 5,000 streetlights currently in CLMD 10006.
An inventory audit was conducted in 2018 as part of an upcoming citywide streetlight cost reduction and energy conservation project (a.k.a. Southern California Edison Option E Program). The audit identified eighty-seven (87) streetlights managed by the County but not formally annexed to the CLMD. The original audit list of eighty-eight (88) streetlights included one (1) duplicate that the County later removed.
Forty-seven (47) of the eighty-seven (87) streetlights were identified by the County to be
annexable into the CLMD without the circulation of an assessment petition. As shown in Attachment 2, these forty-seven (47) streetlights are located along roadway segments and are collectively known as Project Nos. 13-19A, 112-101A, 124-129A, 133-79A, and 173-119A.
Separate from the current action, the remaining forty (40) streetlights require further coordination between County and City staff.
• Twenty-nine (29) streetlights are subject to new property tax asessments and will require the circulation of petitions prior to annexation into the CLMD. The County is leading this process and will require separate Council action when approved petitions are ready for consideration.
• Eleven (11) streetlights are not annexable into the CLMD, and the City will remain responsible for them in perpetuity.
In November 2023, the County of Los Angeles executed the Diamond Bar Option E Agreement for streetlights administered by the County with Southern California Edison (SCE). According to SCE, the replacement of the current streetlight heads with the new LED lights will start later this calendar year. SCE is currently working on an updated schedule for the work.
ANALYSIS:
The proposed annexation territories described in Project Nos. 13-19A, 112-101A, 124- 129A, 133-79A, and 173-119 A are being processed for the operation and maintenance costs of forty-seven (47) streetlights to CLMD 10006 and County Lighting District LLA-1, Diamond Bar Zone. These fourty-seven streetlights are annexable without a peitition since these streetlights benefit all property owners within the district.
With the City Council’s approval of the attached Resolution granting consent and jurisdiction (Attachment 1), the County will exercise the appropriate actions to complete this annexation process.
LEGAL REVIEW:
The City Attorney has reviewed and approved the Resolution as to form.
