Subject: Notice of Completion - Autumn Gate Phase III Subdivision (IH)
RECOMMENDATION
Council to accept the Autumn Gate Phase III public improvements as complete and authorize the City Engineer to file a Notice of Completion with the Tulare County Recorder's Office.
EXECUTIVE SUMMARY
The subdivision improvements for Autumn Gate Phase III have been completed in accordance with the requirements of the subdivision agreement and as specifically set forth in the plans and specifications approved by the City. The filling of a Notice of Completion will allow the performance securities provided by the developer to be released thirty-five (35) days after recordation.
OUTSTANDING ISSUES
None.
DISCUSSION
The tentative tract map for the Autumn Gate Subdivision was approved by the City on March 28, 2006. This map consisted of 138 lots located between Viscaya Parkway and Euclid Avenue along the north side of Nebraska Avenue. Unfortunately, the housing market crash of 2008 hindered the development of this new subdivision.
In 2018 the Autumn Gate Subdivision was purchased by San Joaquin Valley Homes, a Visalia based home builder.
The City Engineer performed a final inspection on January 4, 2022 and determined that all public improvements are complete and approved for permanent maintenance.
An excerpt of the Autumn Gate Phase III final map is attached herein as Exhibit 'A'.
The required one year maintenance bond has been provided by the developer pursuant to the executed subdivision agreement. It is now recommended that the City Council accept the improvements as complete and authorize the City Engineer to file the Notice of Completion, attached to this report as Attachment 'B', with the Tulare County Recorder's Office. The performance securities on this tract will be released thirty five (35) days after the recordation of the Notice of Completion.

Resolution No. 2022-04 Authorizating Application for CalRecycle Grants (IH)
RECOMMENDATION
Council adopt Resolution No. 2022-04 authorizing the submittal of CalRecycle grant applications eligible to the City of Dinuba within the next five years and authorizing the Public Works Director to execute all required grant documents.
EXECUTIVE SUMMARY
The Department of Resources Recycling and Recovery (CalRecycle) is tasked with promoting the State's efforts to reduce, recycle and reuse solid waste in an effort to preserve landfill capacity and protect public health and safety and the environment. To that end, CalRecycle administers various grant programs and makes them available to cities across the State. Before an application can be submitted an authorizing resolution is required.
OUTSTANDING ISSUES
None.
DISCUSSION
The Department of Resources Recycling and Recovery (CalRecycle) administers various grant programs to further the State's efforts to reduce, recycle and reuse solid waste. CalRecycle's grant application procedures require an applicant's governing body to adopt a resolution authorizing the submittal of a grant application and also designating and authorized agent. This authorization can encompass any eligible grant opportunity for a period of up to five years. Resolution No. 2022-04 enclosed herein as Attachment 'A' contains the required language and authorizes the Public Works Director to submit applications on the City's behalf.
One of these grant opportunities was announced earlier this month with the creation of the Senate Bill 1383 Local Assistance Grant Program. This non-competitive grant program will provide one-time funding to local jurisdictions to assist with the implementation and regulation requirements associated with Senate Bill 1383.
As discussed with the City Council on September 28, 2021 this landmark legislation creates considerable impacts to all disposal customers effective January 1, 2022. The Local Assistance Program allocates approximately $35,800 to the City of Dinuba for a variety of eligible projects or programs to promote organics recycling efforts.
FISCAL IMPACT
There is no fiscal impact associated with the recommended action.

City Council Staff Report
Department: CITYATTORNEY January 25, 2022
To: Mayor and City Council
From: David Yanez, City Attorney
Subject: First drafts of Council Election District Boundaries (DY)
RECOMMENDATION
City Council receive, review and solicit community input on the first draft maps of council district boundaries that were updated to reflect population changes resulting from the 2020 Census.
EXECUTIVE SUMMARY
The city is required to review and update city council district boundaries every ten years based on changes in population following the U.S. Census. The goal is to ensure that each district has equal population and demographic fairness. The city's consultant has prepared the first draft council district boundaries for review and input the City Council and the community.
OUTSTANDING ISSUES
None.
DISCUSSION
Every ten years, cities with by-district election systems must use new census data to review and, if needed, redraw district lines to reflect how local populations have changed. The current City Council district is attached herein as Attachment 'A.' This process, called redistricting, ensures all districts have nearly equal population.
Pursuant to California Elections Code § 21600- 21630, the Dinuba City Council must adopt the redrawn council maps by April 17, 2022.
The council election districts must now be redrawn, since the 2020 census data reflect a change since the adoption of the City’s current districts. New maps will be redrawn with the assistance of the Dinuba community, Davis Demographics, Inc., and city staff.
The Citizens Advisory Committee
Section 2.02 (A) of the Dinuba City Charter states that if U.S. Census data necessitates, a Citizens Advisory Committee shall be formed by the City Council for the purpose of developing and recommending to it, revised council election district boundaries. The Charter further requires that at the “time of redistricting Council districts shall not vary in population between districts by more than two (2%) percent” and that “no change in district boundaries shall operate to disqualify an incumbent from office before expiration of the term for which such person was elected or appointed.”
At the City Council meeting of June 22, 2021 the Planning Commission was appointed to serve as the Citizens Advisory Committee to advise the Council on redrawing council district boundaries. By law, California charter cities must hold at least four (4) public hearings that allow community members to provide input on the redrawing of council election district maps. The City will hold these public hearings during meetings of the Planning Commission and of the City Council. All meetings and hearings will comply with all applicable legal requirements.
Criteria for Redistricting
According to the FAIR MAPS Act, which was adopted by the California legislature as AB 849 and took effect January 1, 2020, the council shall draw and adopt boundaries using the following criteria in the listed order of priority (Elections Code 21621 (b),(c)):
1. Comply with the federal requirements of equal population and the Voting Rights Act;
2. Geographically contiguous;
3. Undivided neighborhoods and “communities of interest” (socio-economic geographic areas that should be kept together);
4. Easily identifiable boundaries;
5. Compact (do not bypass one group of people to get to a more distant group of people);
6. Shall not favor or discriminate against a political party; Once the prioritized criteria are met, other traditional districting principles can be considered, such as:
1. Minimize the number of voters delayed from voting from 2022 to 2024
2. Respect voters’ choices / continuity in office
3. Future population growth
The public is requested to provide input regarding communities of interest and other local factors that should be considered while drafting district maps. A community of interest under the relevant Elections Code 21621(c) is “a population that shares common social or economic interest that should be included within a single district for purposes of its effective and fair representation.”
Possible features defining community of interest might include, but are not limited to:
1. School attendance areas
2. Natural dividing lines such as major roads, hills, or highways;
3. Area around parks and other neighborhood landmarks;
4. Common issues, neighborhood activities, or legislative/election concerns; and Shared demographic characteristics, such as:
1. Similar levels of income, education, or linguistic insulation;
2. Languages spoken at home; and
3. Single-family and multi-family housing unit areas
Current and proposed draft maps are attached herein as Attachments 'B' and 'C'. It is staff's recommendation that the City Council provide input and direction to staff and the Citizens Advisory Committee, receive community input and provide appropriate direction to City staff regarding the proposed council election district boundaries as presented.
FISCAL IMPACT
The City has contracted with Davis Demographics, Inc. for an agreed upon price to provide demographic and mapping services for the redistricting process because of their expertise and familiarity with the City of Dinuba’s data.
PUBLIC HEARING
None required. Subsequent public hearings will be held at the Planning Commission meetings of February 1st, 2022 and March 1st, 2022.

Resolution No. 2022-05 Authorizing Submittal of Land and Water Conservation Grant in the amount of $2.5 Million for the Viscaya Recreation and Open Space Park (SH)
RECOMMENDATION
Council adopt Resolution No. 2022-05 authorizing submittal of a $2.5 million grant application through the Land and Water Conservation Fund for the construction of the Viscaya Recreation and Open Space Park.
EXECUTIVE SUMMARY
The California Department of Parks and Recreation's Office of Grants and Local Services has allotted $45 million to the Land and Water Conservation Fund. The City of Dinuba submitted two grant applications for the construction of the Viscaya Neighborhood Park in the last two years, but was not awarded. The city is proposing to submit a $2.5 million grant application in the Land and Water Conservation Fund for the Viscaya Recreation and Open Space Park. Resolution No. 2022-05 authorizes staff to submit a grant application by the February 1, 2022 deadline.
OUTSTANDING ISSUES
None.
DISCUSSION
The California Department of Parks and Recreation Office of Grants and Local Services is seeking applications for its Land and Water Conservation Fund. Up to $45 million in projects will be selected. The maximum grant amount per application is $6 million; however, cities must match a minimum of 50% of the total project cost.
Eligible projects include the acquisition or development of projects for outdoor recreation opportunities. Applications are due Feb. 1.
Staff is recommending that the City apply for these grant funds for the Viscaya Community Park. Staff applied twice for Proposition 68 park funds for this park but was unsuccessful. The LWCF grant is another opportunity to fund this much needed park. The estimated cost for the park is $5.0 million. Staff is asking authorization from the Council to submit a grant application to the LWCF in the amount of $2.5 million and the City will match the $2.5 million needed to completed the project using funds from Park Impact Fees, ARPA funds, and the General Fund.
The elements in the design will remain as requested by the community including playground area, dog park, picnic pavilion, restrooms, sports court for basketball and pickleball, on-site parking, concrete walking trail, lights, irrigation system, trees and other amenities. These elements all qualify under the LCWF grant program guidelines. A copy of the Viscaya Park design in enclosed as Attachment 'A'.
Resolution No. 2022-05 enclosed herein as Attachment 'B' authorizes staff to submit a LWCF grant application in the amount of $2.5 million for the Viscaya Recreation and Open Space Park.
FISCAL IMPACT
The LWCF grant requires a 50% local match. The cost to develop the park is estimated to be $5.0 million. If awarded the LWCF grant will cover $2.5 million and the City will cover the other $2.5 million from a combination of Park Impact Fees, ARPA funds and the General Fund.
