9. DEPARTMENT REPORTS
9.1. SUBJECT
Delgado Park and Downtown Area Lighting Study (JW)
a
RECOMMENDATION
Council to receive report on lighting study and authorize the use of solar streetlights in lieu of the typical hardwired streetlights in neighborhood around Delgado Park and in the downtown area.
City Engineer Watts reported that 4Creeks performed a lighting study of Delgado Park and the Downtown area. The analysis of the existing conditions determined that additional lighting is needed. The research found lighting deficiencies at night, including six street lights at Delgado Park that are not working. Staff is now aware and are working on a resolution. The study found that there is not enough light between streets on O Street and Kamm Ave, and discovered that there are a few lights not working downtown, which are now being resolved.
Watts reported that the pros of using solar lighting are many. Including the ability to use them anywhere and they would be city-owned and maintained. Solar lighting has a lifespan of 20 years on average and is extremely simple to replace.
The cost is cheaper than hardwire lighting at 14k vs 33k.
The study determined that 52 lights are needed at Delgado Park and the downtown needs more pedestrian lighting. Watts asked the council to consider using solar instead of wired street lights for this project and for future residential areas.
Council member Launer asked about solar panel upkeep. Watts advised that there is minimal maintenance required for solar panels.

Dear Mayor Reynosa and Council Members,
We are excited to announce our 2022 Dinuba Cars in the Park Car Show on June 10th and Cruise Night Concert on June 11th. This Year’s Cruise Night will have musical entertainment in Entertainment Plaza and possibly in front of Borderline. We believe this year's concerts and events will bring people from all over the valley as we have already had a large interest from participants. We are planning to have a beer garden again set up in the old skate park set up exactly the same as last year. We would like to discuss the possibility of setting up a beer garden at the car show in the park event located at Rose Ann Vuich on Saturday.
The Dinuba Lions Club and the Dinuba Chamber of Commerce would like to express our gratitude for your interest in sponsoring this great event as well as your ongoing support and commitment to this event in the past. It is generous donations from organizations like yours that help make our event such a success. The nature of this letter is to invite your organization to participate in our 2023 Main Street Cruise Night and Cars in the Park Car Show event. In order for us to put on a free concert we are seeking sponsorships.
We respectfully request a $7,000 sponsorship for this year's event. This money would be used to offset the entertainment expenses for both Friday and Saturday. We feel that this event fits within the city’s vision of creating family-friendly events in our downtown and community and are open to any suggestions that our city leadership has regarding making this event a success.
We look forward to your participation in the 2023 Dinuba Main Street Cruise Night and Cars in the Park Car Show. If you have any questions regarding this letter or event sponsorship, please feel free to contact us.
Thank you again for your consideration and support.
Respectfully,
Heathe Jones

Resolution No. 2023-30 Approving Participation in the Public Provider Ground Emergency Medical Transport Program (PP-GEMT) with the California Department of Health Care Services (DHCS) for EMS Ambulance Transport Service Reimbursements; and Resolution No. 2023- 31, Approving Budget Amendment No. 2023-16
RECOMMENDATION
Council to take the following action by one motion:
1. Adopt Resolution No. 2023-30, approving participation in the Public Provider Ground Emergency Medical Transport Program (PP-GEMT) with the California Department of Health Care Services for EMS ambulance transport service reimbursements; and,
2. Adopt Resolution No. 2023-31, approving Budget Amendment No. 2023-16 including the funds in the FY 2022-23 budget; and,
3. Authorize the City Manager or designee to execute all agreements associated with the PP-GEMT program.
EXECUTIVE SUMMARY
Under the PP-GEMT program, public GEMT providers in the State of California may elect to transfer funds to DHCS in support of the PP-GEMT program. These funds are used as a match for federal funds, which are eventually returned to the Public GEMT providers through their respective Medi-Cal Managed Care and Fee-forService Health Plan Providers as a supplemental payment for Ground Emergency Medical Transportation.
OUTSTANDING ISSUES
None.
DISCUSSION
In accordance with Assembly Bill (AB) 1705 (Chapter 544, Statues of 2019), the Department of Health Care Services (DHCS) developed the Public Provider Ground Emergency Medical Transport (PP-GEMT) Intergovernmental Transfer Program (IGT) program to provide increased reimbursements, by application of an add-on increase, to emergency medical transports provided by eligible public GEMT providers. The non-federal share collected will be used to provide an add-on increase to the fee-for-services (FFS) fee schedule rate for the affected emergency medical transport billing codes and a rating increment that will be applied to primary capitation rates for contracted Medi-Cal plans.
DHCS will calculate an initial statewide add-on increase amount based on the difference between: (a) the weighted average reimbursement paid pursuant to the applicable base Medi-Cal FFS fee-for-service payment fee schedule for an emergency medical transport, and (b) the weighted average cost directly associated with providing a Medi-Cal emergency medical transport under the Medi-Cal program by an eligible provider. The average cost data will be drawn from the most recently audited cost reports of eligible providers available at the time the add-on amount is developed, which is the 2017-18 audited reports. The add-on increase is subject to federal approval by the Centers for Medicare and Medicaid Services (CMS) A 10 percent fee will be assessed on the IGTs in order to support health care coverage costs and costs associated with administering the program. Eligible emergency medical transport providers will be required to receive an add-on increase to their Medi-Cal FFS fee-for-service (FFS) payment schedule for certain procedure codes. the department developed the add-on increase based on specific standards, including eligible providers' average costs directly associated with providing Medi-Cal emergency medical transports under the Medi-Cal program.
Once the PP-GEMT IGT Program is implemented, public providers will no longer be assessed the Quality Assessment Fee (QAF) prospectively and will not be eligible to receive the add-on pursuant to the GEMT QAF Program, but will be eligible to receive a reimbursement add-on under the PP-GEMT IGT Program. Additionally, public GEMT providers will no longer be eligible to participate in the GEMT Certified Public Expenditures (CPE) program, once the PP-GEMT IGT Program is implemented.
Participation in the PP-GEMT program provides an important opportunity for the City to collect ambulance transport fees at an increased rate. The PP-GEMT program requires the transfer of local dollars from the City to the DHCS. DHCS, in turn, uses the transferred funds from public providers as the non-federal share of an increased reimbursement rate for Medi-Cal transports.
Participation in IGTs are voluntary, however 100% participation of public providers is essential to the continuation of the PP-GEMT program.
FISCAL IMPACT
DHCS has calculated Dinuba's portion of the non-federal share to be $457,177.22 for Calendar Year 2023 with estimated revenues from supplemental payments totaling $1,047,394.39. A conservative estimate in net new revenues for calendar year 2023 for participation in this program is $450,000.00.

Urgency Ordinance No. 2023-04 Adding Section 190, “Prohibited Activities in Public Parks and Recreation Facilities” to Title 9, Chapter 48 Public Parks of the Dinuba Municipal Code (DY)
RECOMMENDATION
Council adopt Urgency Ordinance No. 2023-04 Adding Section 190, “Prohibited Activities in Public Parks and Recreation Facilities” to Title 9, Chapter 48 Public Parks of the Dinuba Municipal Code.
EXECUTIVE SUMMARY
This urgency ordinance adds language and provides clarification regarding the enforcement of camping, and other specified activities, in City Parks and City recreational facilities. The urgency ordinance also attempts to improve compliance with recent federal case law regarding the enforcement of restrictions against camping and sleeping in public parks.
OUTSTANDING ISSUES
None.
DISCUSSION
The goal of this urgency ordinance, which is attached herein as 'Attachment A', is to provide clarification regarding the enforcement of camping, and other specified activities, in City Parks and City recreational facilities. The urgency ordinance also attempts to improve compliance with recent federal case law (Martin v City of Boise, 920 F. 3d 584 (9th Cir. 2019)) regarding the enforcement of restrictions against camping and sleeping in public parks, and other activities such as alcohol consumption and fires in City parks and recreational facilities.
Section 2 of this urgency ordinance provides definitions for terms such as “Abandoned Personal Property”, “Available Shelter”, “Camping”, and “Personal Property”. The goal of this section is to provide clarification and aid enforcing officers in defining the parameters of their authority to enforce this ordinance.
Section 3 prohibits camping in City parks and recreational facilities. This section allows the City to remain in compliance with current federal case law, and provides clear language regarding the prohibition of camping in City parks and recreational facilities.
Section 4 of the urgency ordinance provides detailed procedures for the impoundment of personal property being stored in public parks. These procedures rely on the definitions of personal property and abandoned personal property and the section also complies with constitutional rights against unreasonable searches and seizures of personal property.
The remaining sections reasonably prohibit fires from being started in City parks and recreational facilities as well as alcohol from being consumed in these locations. Staff felt it prudent for clarification purposes to include a prohibition on alcohol at these locations, which is consistent with section 11.12.180 of the Dinuba Municipal Code which prohibits alcohol from being consumed in public places.
This urgency ordinance will expire in 45 days after adoption by City Council. Staff anticipates that a permanent ordinance will be introduced within the 45 day effective period of this urgency ordinance. Staff recommends Council adopt Urgency Ordinance No. 2023-04 Adding Section 190, “Prohibited Activities in Public Parks and Recreation Facilities” to Title 9, Chapter 48 Public Parks of the Dinuba Municipal Code.
FISCAL IMPACT

An activity shall constitute camping when it reasonably appears, in light of all the circumstances, the participants in conducting these activities are in fact using the area as a sleeping or living accommodation regardless of the intent of the participants or the nature of any other activities in which they may also be engaging. "Camping" shall not include merely sitting, lying or sleeping outside in a public park/recreation area or the use of a blanket, towel or mat in a public park/recreation area during the time the park is open to the public.
E. "CAMP EQUIPMENT" or "CAMP PARAPHERNALIA" means tents, tarpaulins, lean-tos, huts, cardboard boxes, or similar make-shift temporary shelters constructed from random materials, as well as cooking facilities, hammocks, ground cover, bedding, sleeping bags, or other similar equipment used for living in the outdoors.
F. "PARK and RECREATION FACILITIES" and "PUBLIC PARK/RECREATION AREAS" means all parks and their associated open spaces, pedestrian and biking trails, park amenities, buildings and recreation centers used by the public within the boundaries of the city limits of the city, and which are owned, operated and/or maintained by the city.
G. "PERSONAL PROPERTY" means tangible personal belongings or possessions, which shall include any movable or tangible thing that is subject to ownership; property or chattels that can be seen, weighed, measured, felt, or touched, including, but not limited to, furniture, appliances, camping facilities, camping paraphernalia, money, and/or books.
H. "TENT" means shelter or structure that is not entirely open on all sides.
SECTION 3- CAMPING IN PARKS AND RECREATION FACILITIES PROHIBITED.
A. It is unlawful and a public nuisance for any person to establish, maintain, or operate a camp or occupy camp facilities, and to utilize camping equipment or camping paraphernalia while camping or occupying camping facilities, in any City of Dinuba park and/or City of Dinuba 4 recreation facility. "Establish" means setting up or moving camping equipment or camp paraphernalia in park and recreation facilities to camp or operate camp facilities. "Maintain" means keeping or permitting camping equipment or camping paraphernalia to remain in a park or recreation facility in order to camp or operate camping facilities. "Operate" means participating or assisting in establishing or maintaining a camp or camping facilities.
B. An individual or family unit experiencing homelessness may not be cited for violation of Subsection (A) between the hours of 10:00 p.m. and 6:00 a.m. unless it is confirmed that there is available shelter as defined in Section 2 of this urgency ordinance.
C. Notwithstanding the exemption provided for in subsection B., camping facilities, camping equipment, and camping paraphernalia may not be affixed or attached to, or constructed upon or with, or otherwise located within ten (10) feet from, any park amenities.
D. Camping may be permitted in park and recreation facilities in conjunction with any city sponsored and approved event.
SECTION 4- STORAGE OF PERSONAL BELONGINGS PROHIBITED.
A. It shall be unlawful and a public nuisance for any person to store personal property in any public park/recreation area, except as otherwise approved in writing by the City Manager or designee or by resolution of the City Council. Personal property stored in public park/recreation areas in violation of this section shall be impounded pursuant to the requirements of this section. Any personal property left in any public park/recreation area at the time the public park/recreation area is closed to the public, whether or not the personal property is unattended, shall be immediately impounded, pursuant to this section.
Notwithstanding these prohibitions, an individual or family unit experiencing homelessness may not be cited for violation of this section between the hours of 10:00 p.m. and 6:00 a.m. unless it is confirmed that there is available shelter as defined in Section 12.32.010.
B. The provisions of this section shall not apply to abandoned personal property, which shall be disposed of forthwith.
C. The Chief of Police or the City Manager, or their designees, are authorized to impound personal property pursuant to the provisions this section, and shall make provisions for the receipt and safekeeping of personal property coming into his or her possession pursuant to this section. A receipt shall be issued to the person delivering such personal property, unless the personal property was found in the course of employment by an employee of the city. The Chief of Police or the City Manager, or their designees, shall notify the owner of the personal property if his or her identity is reasonably ascertainable, or, if the identity of the owner is not reasonably ascertainable, cause a notice to be left in a prominent place on or near the location of the personal property for any personal property impounded pursuant to this section, advising that the city is in possession of the personal property and the location where it may be claimed.
5 D. Notice prior to impoundment.
1. Stored personal property may be impounded without notice if there is a reasonable belief that it is abandoned, presents an immediate threat to public health or safety, is evidence of a crime, is evidence in a criminal investigation, or is contraband.
2. The city may erect signs in public parks/recreation areas stating that any personal property stored in those areas will be impounded. Those signs shall serve to provide the notice required by this section. Signs and amount of notice will comply with applicable state and federal law.
3. If neither subsection (1) nor subsection (2) applies, personal property unlawfully stored in public parks/recreation areas shall be impounded only after a clearly understandable notice is provided to the owner of the personal property or left at or near the location of the personal property advising that the personal property will be impounded if it is not removed. This notice will specify a date and time when the personal property will be impounded if it is not removed. The notice shall also state the legal authority for the impoundment of the property and the specific location of where the impoundment will occur.
E. If, after any notice required by subsection D. is given, personal property remains unlawfully stored in a public park/recreation area, that personal property may be impounded. The person impounding the personal property shall leave a notice in a conspicuous place at or near where the personal property was located prior to being impounded, advising where the personal property is being kept and when and where it may be claimed by its owner.
F. Personal property coming into possession of the city pursuant to this section shall be deposited in a safe place for a period of at least ninety (90) days. If the personal property consists of money, it shall be deposited with the Finance Director or designee for a period of not less than ninety (90) days, unless sooner claimed by its owner. In the event the personal property or money is not claimed within ninety (90) days, it shall be deemed to be abandoned personal property, subject to disposition as provided in this section.
G. During the time that any personal property is held by the city, it may be delivered or paid to its owner as follows:
1. The personal property shall be delivered upon proof of ownership satisfactory to the Chief of Police or the City Manager, or their designees, after ten (10) days' notice by mail to any other person(s) who have asserted a claim of ownership at any address given by such person(s).
2. If the personal property consists of money, it shall be paid to the owner upon written order from the Chief of Police or the City Manager, or their designees, to the Director of Finance. The Chief of Police or City Manager, or their designees, shall make such order upon the same proof of ownership and with the same notice as prescribed in the case of personal property.
6 3. If ownership cannot be determined to the satisfaction of the Chief of Police or the City Manager, or their designees, he or she may refuse to deliver the personal property or refuse to order the payment of such money to anyone until ordered to do so by a court of competent jurisdiction.
H. Upon expiration of the ninety-day period, any personal property received by the city and not delivered to the owner may be appropriated to the use of the city upon order of the City Manager or his or her designee, on his or her finding that the personal property is needed for a public use, and any personal property not appropriated to city use may be disposed of or sold at public auction to the highest bidder. All unclaimed money received by the Chief of Police, and not delivered to the owner during the ninety-day period, shall thereafter be deposited in the general fund.
I. Subject to the provisions of subsection I. below, any personal property coming into the possession of the Chief of Police or designee may be disposed of immediately and without notice, in a manner that the Chief of Police or designee determines to be in the public interest, when such personal property is perishable, contraband, or constitutes an immediate threat to the public health or safety.
J. The provisions of this chapter shall not apply to real or personal property or money subject to confiscation pursuant to state or federal law, to personal property that constitutes evidence of a crime, evidence in an ongoing criminal investigation and/or civil proceeding pursuant to state or federal law.
SECTION 5- TENTS AND OTHER ENCLOSED TEMPORARY STRUCTURES PROHIBITED A. It is unlawful for any person to set up and utilize a tent or similar temporary shelter or improvised make-shift structure from random items, that is not open on all sides in a public park/recreation area, except as when authorized by a permit issued pursuant to Article 2. Only the use of umbrellas or sun shades is permissible in a public park/recreation area.
B. Notwithstanding these prohibitions, an individual or family unit experiencing homelessness may not be cited for violation of this section between the hours of 10:00 p.m. and 6:00 a.m. unless it is confirmed that there is available shelter as defined in Section 2 of this urgency ordinance.
SECTION 6- POSSESSION AND CONSUMPTION OF ALCOHOL PROHIBITED A. The purpose of this section is to prohibit the possession and consumption of all alcoholic beverages in all city parks and recreation facilities except in specially designated city parks with a permit.
B. It is unlawful for any person to possess and/or consume any alcoholic beverage within the boundaries of every public park/recreation area. The City Manager or designee may maintain a listing of the park and recreation facilities where possession and consumption of alcoholic beverages may be allowed with a valid permit issued by the City of Dinuba. 7 SECTION 7. FIRES PROHIBITED IN PARKS.
A. No person shall kindle or build a fire in any park or recreation facility, including the use or portable fire rings or any other receptacle or park amenity for the purpose of creating or containing a fire, unless prior written permission is obtained from the City of Dinuba. A fire that is lighted and maintained in a barbecue grill being utilized for cooking purposes only, and only in designated areas, shall be exempt from this prohibition. Installed park grills are designed for charcoal based cooking, and no other flammable material may be used in them. Grill fires shall be completely extinguished before leaving the park and recreation facility. Fires solely for the purpose of personal warmth are not allowed, and park grills shall not be used as a trash receptacle.
SECTION 8. PENALTY.
A. Any person violating the provisions of this urgency ordinance shall be guilty of a misdemeanor and subject to the penalties set forth in section 1.16.015 of the Dinuba Municipal Code. At present, pursuant to Government Code Section 36901, the maximum penalty for a misdemeanor is a fine not exceeding one thousand dollars and imprisonment not exceeding six months, or both. (Ord. 96-2 § 2, 1996: Ord. 580 § 2, 1978) The City Manager, Chief of Police, City Attorney or their designee shall have discretion to reduce said violation to an infraction subject to the penalties set forth in section 1.16.010 of the Dinuba Municipal Code.
SECTION 9. SEVERABILITY.
A. Each of the provisions of this ordinance is severable from all other provisions. If any article, section, subsection, paragraph, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.
SECTION 10. PUBLICATION OF URGENCY ORDINANCE.
A. The City Clerk is hereby directed to cause a summary of this Ordinance to be published by one insertion in a newspaper of general circulation in the community at least five (5) days prior to adoption and again one week following its adoption. If a summary of the ordinance is published, then the City Clerk shall cause a certified copy of the full text of the proposed ordinance to be posted in the office of the City Clerk at least five days prior to the Council meeting at which the ordinance is adopted and again after the meeting at which the ordinance is adopted. The summary shall be approved by the City Attorney.
This Ordinance shall take effect and be in full force immediately following its adoption and shall continue for a period of 45 days (unless extended).

City Council Staff Report
Department: PUBLIC WORKS May 23, 2023
To: Mayor and City Council
From: George Avila, Interim Public Works Director
Subject: Authorization to Request Proposals for Street Sweeping Services (GA)
RECOMMENDATION
Council receive information on the City's current street sweeping program and consider authorizing staff to issue a Request for Proposals (RFP) to outsource street sweeping services to a third-party vendor.
EXECUTIVE SUMMARY
The City's current street sweeping program is carried out by Public Works staff. The City offers street sweeping services twice a month for residential neighborhoods and arterial streets and three times per week for the downtown area. Street sweeping is an essential City function that promotes road safety, facilitates storm drainage and enhances neighborhoods. Recent developments have created an opportunity to improve the program's efficiency and provide some cost savings. Staff wishes to request proposals for street sweeping services to explore this opportunity further.
OUTSTANDING ISSUES
None.
DISCUSSION
The City's street sweeping program provides an important service to Dinuba residents. Regular street sweeping keeps streets clear of trash and debris creating safer road conditions for both drivers and pedestrians. Street sweeping is also critical for storm drainage. Keeping storm drain inlets free of leaves and other obstructing materials helps avoid localized flooding and improves storm water quality.
Additionally, street sweeping contributes to more attractive neighborhoods improving home value and quality of life.
The City's current street sweeping program has an annual budget of approximately $200,000 and includes a full-time employee, a primary sweeper and a backup sweeper. The primary sweeper is a 2016 model and the backup sweeper is a 2013. A few weeks ago the primary sweeper motor failed causing street sweeping services to be suspended for approximately one week. Repairs to the primary sweeper are estimated at about $20,000. Pending a decision on the primary sweeper the backup sweeper has been used to perform street sweeping services for the last few weeks.
However, the backup sweeper is 10 years old and reliability is somewhat questionable.
Staff has reached out to vendors for a quote on a new sweeper and received a reply for approximately $400,000. The City can choose to finance this acquisition for a five year term at $92,000 per year or a seven year term at $69,000. This cost is significant and not included in current disposal rates; making this purchase would require staff to use disposal reserves.
This situation presented an opportunity for staff to review current operations and determine if efficiency could be improved. Staff reached out to a street sweeping company that serves a neighboring community and was told that the current scope of work could be performed for a savings of about $25,000 per year. This would also eliminate the need to make the significant investment of purchasing another street sweeper. The full-time employee currently operating the sweeper would be moved to the transportation division providing much needed reinforcements to current staff.
For the reasons identified, Staff believes that procuring a third-party contract for street sweeping services would be in the best interest of the rate payers and would also improve operational reliability. It is therefore requested that the City Council authorize staff to prepare and issue a Request for Proposals (RFP) for street sweeping services. A report to the City Council regarding the outcome of the RFP and requesting authorization to award would be presented at a later date.

Subject: Letter of Support for SB 244 - Right to Repair to Reduce E-waste (DJ)
RECOMMENDATION
Council to consider a letter of support for SB 244, "Right to Repair to Reduce Ewaste".
EXECUTIVE SUMMARY
The proposed SB 244 - Right to Repair to Reduce E-waste aims to provide Californians the resources they need to fix electronics, keeping electronic waste out of landfills.
OUTSTANDING ISSUES
None.
DISCUSSION
A new Senate bill (SB-244) was introduced this year which aims to provide Californians the resources they need to repair the electronic devices they purchase, rather than replacing them; keeping electronic waste out of landfills. This proposed bill would require manufacturers of an electronic or appliance product to "make available, on fair and reasonable terms, sufficient service documentation and prescribed functional parts and tools to owners of the product, service and repair facilities, and service dealers for specified time frames. The bill provides that a city, a county, a city and county, or the state may bring an action in superior court to impose civil liability on a person or entity that knowingly, or reasonably should have known that it violated, these provisions as provided."
Existing law provides a comprehensive set of procedures for the enforcement of express and implied warranties on consumer goods, as defined. Under existing law, every manufacturer making an express warranty with respect to an electronic or appliance product, including televisions, radios, audio or video recording equipment, major home appliances, antennas, and rotators, is required to make available to service and repair facilities sufficient service literature and functional parts to effect the repair of the product for at least 3 years after the date a product model or type was manufactured, regardless of whether the 3-year period exceeds the warranty period for the product.
The proposed Right to Repair Act bill would require manufacturers to make available to product owners, information on service and repair facilities, and service dealers, the means, as described, to effect the diagnosis, maintenance, or repair of the product, as provided. The bill would also require a service and repair facility or service dealer that is not an authorized facility or dealer of a manufacturer to provide a written notice of that fact to any customer seeking repair of an electronic or appliance product before the repair facility or service dealer repairs the product. SB244 also provides that a city, a county, or the state may bring an action in superior court to impose civil liability on a person or entity that knowingly violated this chapter, or reasonably should have known that it violated this chapter, in the amount of one thousand dollars ($1,000) per day for the first violation of this chapter, two thousand dollars ($2,000) per day for the second violation, and five thousand dollars ($5,000) per day for the third and subsequent violations.
Staff recommends Council consider submitting a Letter of Support for SB-244 "Right to Repair Act" which is attached herein as 'Attachment A' in support of this proposed legislation.

RE: Support for SB 244 - Right to Repair to Reduce E-waste Dear Senators Hurtado:
On behalf of the City of Dinuba, I want to thank you for your leadership in working to support public safety efforts in California. We write today to urge you to support the proposed SB 244 - Right to Repair to Reduce E-waste bill (Eggman).
The City of Dinuba wholeheartedly supports this, and any effort, to reduce or divert e-waste from State landfills, and empower consumers to repair, rather than replace, their electronics. This new legislation empowers consumers with the information and means to extend the life of their electronic devised, thus reducing the frequency of the replacement of such devices, and reducing the burden on our landfills. The proposed bill also provides tools for cities, counties, and the State the necessary resources required to hold manufacturers accountable for the products they sell through an action in superior court to impose civil liability on a person or entity that knowingly violated the requirements imposed by the bill.
We request that you support this legislation that would improve existing and outdated requirements of the manufacturers of electronic products to provide consumers with adequate information about the products they purchase.
Sincerely,
Maribel Reynosa
