Ordinance 2023-05 improves upon urgency Ordinance No. 2023-04, while complying with federal law by balancing the constitutional rights of individuals experiencing homelessness with the city’s obligation to protect the public’s health and safety and facilitate the intended uses of city parks, recreational facilities and designated public property.

OUTSTANDING ISSUES

DISCUSSION
Background
On April 12, 2022, the City Council adopted urgency Ordinance No. 2022-04 “Adding Section 190, ‘Prohibited Activities in Public Parks and Recreation Facilities’ to Title 9, Chapter 48 Public Parks of the Dinuba Municipal Code”. This ordinance clarified what activities are allowed in public parks and recreational facilities and provided enforcement procedures while respecting the constitutional rights of violating individuals. Subsequently, on May 23, 2023, the City Council adopted urgency Ordinance No. 2023-04, which effectively extended Ordinance No. 2022-04. Urgency Ordinance No. 2023-04 will be in effect until Ordinance No. 2023-05 receives final approval by the City Council and goes into effect (30 days after the Ordinance's second reading). On 6/13/2023, the Dinuba City Council voted to approve Ordinance No. 2023-05 with minor revisions.

The purpose of Ordinance No. 2023-05 is to remedy any shortcomings of the current urgency ordinance by adding or removing certain procedures and/or authority of the City’s enforcement officials. The City of Dinuba seeks to be community which protects the intended uses of its public parks and recreational facilities, as well as the public’s health and safety, while respecting the constitutional rights of those experiencing homelessness.

Ordinance No. 2023-05’s New Provisions
As a result of City Council’s discussion of Urgency Ordinance No. 2023-04 on May 23, 2023, the following new provisions and language are proposed in Ordinance No. 2023-05:

ENCAMPMENTS PROHIBITED BEYOND CITY PARKS: In compliance with the federal law, Ordinance No. 2023-05 prohibits encampments regardless of the availability of shelter beds if the encampments pose a significant threat to the public safety, or are within two blocks of a school or senior center, or is within any waterway or open space.

SPECIFIC ENCAMPMENT ABATEMENT PROCEDURES ADDED: Section 9.49.040 now provides the City with the ability to provide 24 hour notice– or 3 hour notice in extreme cases– of encampment abatements as well as procedures for giving notice of any resulting impounded property.

USE OF PARK/RECREATIONAL FACILITY WATER: Section 9.49.060 prohibits the use of park waters, including ponds, pools, fountains, drinking fountains, sinks or hydrants to bathe or for cosmetic purposes such as coloring one’s hair. This prohibition also forbids polluting these waters by depositing trash or foreign objects into them.

TAMPERING WITH VALVES AND UTILITIES PROHIBITED: Section 9.49.060 prohibits the opening and closing of valves and switches pertaining to water, electric, or any other utility in any park or recreation facility.

MISTREATMENT OF ANIMALS IN PARKS PROHIBITED: Section

9.49.060 generally prohibits the taking, killing, wounding, or disturbing or any bird or animal in city parks, recreational facilities or designated public property.

PERMANENT METAL SIGNAGE AT PUBLIC PARKS REGARDING
REGULAR CLEAN-UPS: In accordance with Ordinance No. 2023-05, City staff has already installed permanent metal signage in City parks and recreational facilities providing notice of weekly cleanups.

PARKING ADJACENT TO PARKS PROHIBITED: Section 9.48.060 of the Dinuba Municipal Code already provides that “No person shall, between the hour of ten-thirty p.m. of any day and the hour of six a.m. of the following day, stop, park or leave standing any motor vehicle or other vehicle on that portion of any streets adjoining a park owned or operated by the city.” Ordinance No. 2023-05 contains express language to this effect.

Carry-over Provisions of Urgency Ordinance No. 2023-04
City Council should be aware that some of the regulations found in urgency Ordinance No. 2023-04 are incorporated into Ordinance No. 2023-05. The following are key provisions of the urgency ordinance which will remain in effect:

DEFINITIONS OF TERMS: Including definitions of “Abandoned Personal Property”, “Available Shelter”, “Camping” and “Personal Property” to aid enforcement officials in taking appropriate action. Ordinance No. 2023-05 adds a definition of "City Enforcement Official".

ENFORCEMENT EXCEPTIONS IF NO AVAILABLE SHELTER: In
compliance with federal law, the City of Dinuba shall not cite or criminalize an individual or family for camping between the hours of 10:00PM and 6:00AM if there is no shelter practically available, unless the persons are in the designated public property enumerated in Ordinance No. 2023-05 (Section 9.49.030(E)).

IMPOUNDMENT PROCEDURES FOR PROPERTY STORED IN PARKS:

The City shall continue to provide notice and opportunities for any cited individuals to reclaim or remove any personal property before it is impounded.

FISCAL IMPACT
Any costs resulting from increased enforcement but mitigated by reduced future enforcement costs.

PUBLIC HEARING
None required for the second reading of this Ordinance No. 2023-05.

Description
A. Ordinance No. 2023-05 "Adding Chapter 49, "Unauthorized Encampments and Prohibited Activities on Public Property" to Title 9 of the Dinuba Municipal Code 1 ORDINANCE NO. 2023-05

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DINUBA
ADDING CHAPTER 49, “UNAUTHORIZED ENCAMPMENTS AND PROHIBITED ACTIVITIES ON PUBLIC PROPERTY” TO TITLE 9 OF THE DINUBA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF DINUBA DOES HEREBY ORDAIN:

SECTION 1. FINDINGS.
(a) The City administers the Dinuba Municipal Code (“DMC”), including Title 9 of the DMC, “Public Peace, Safety and Morals”, which regulates a wide range of activities meant to ensure public order and safety.
(b) Chapter 48, “Public Parks”, of Title 9 of the DMC regulates activities in public parks but lacks clear rules pertaining to unsafe and unauthorized encampments and other prohibited activities at public parks, recreational facilities and public property. (c) Article XI, § 7 of the California Constitution empowers cities with regulatory authority to protect the public health, safety and welfare and the City of Dinuba is currently experiencing an increase of encampments in public parks which is negatively impacting the overall welfare of the community.
(d) Unsanctioned encampments are not consistent with the intended use of the City parks and public property and are almost always associated with a host of major health and safety impacts, including: open and obvious drug use and related crimes, serious fire safety concerns, major impacts related to human and animal waste and accumulation of trash, vandalism, and related nuisance conditions impairing the enjoyment of city parks recreational facilities and public property by city residents. (e) The above negative impacts are borne by the City of Dinuba in the form of financial costs expended on legal enforcement and abatement and these resources being unavailable for other urgent purposes and needs of the City of Dinuba. (f) Longer term encampments have the effect of essentially privatizing property that is intended for public use, as the greater community is no longer able to use public spaces that are used for round-the-clock encampments. 2 (g) Unlike some larger cities within the state, the City of Dinuba generally does not receive significant funding from the state or federal government to provide housing, health, or other services to persons lacking shelter and the City must appropriately consider competing interests and formulate policy to best protect public health, safety, welfare, property, and the environment, with limited resources.
(h) It is the purpose and intent of the City Council to provide standards for the use of public parks and recreation facilities which are intended to be as compatible as possible with the protection and preservation of health, safety, and welfare of the inhabitants of the City of Dinuba.
(i) The City Council calls on the County, the State, and the Federal Government to expand shelter-capacity and very low income long-term housing options regionally, statewide, and nationally, and also to provide street outreach, case management, diversion, housing problem-solving, mental health support, and drug rehabilitation services to adequately address and solve homelessness.

SECTION 2. CODIFICATION.

Upon the Dinuba City Council’s final passage of Ordinance No. 2023-05, Chapter 49, “Unauthorized Encampments and Prohibited Activities on Public Property”, the same is hereby added to Title 9 of the Dinuba Municipal Code.

SECTION 3. SEVERABILITY.

Each of the provisions of this ordinance is severable from all other provisions. If any article, section, subsection, paragraph, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.

SECTION 4. ENVIRONMENTAL DETERMINATION.

The City Council finds that the adoption of implementation of this Ordinance are exempt from the provisions of the California Environmental Quality Act under Section 15061(b) (3) in that the City Council finds there is no possibility that the implementation of this Ordinance may have significant effects on the environment.
3 SECTION 5. PUBLICATION.

The City Clerk is hereby directed to cause a summary of this Ordinance to be published within 20 days following its second reading and adoption, in a newspaper of general circulation in the City or, if there is no newspaper of general circulation in the City, by posting in three public places. The City Clerk shall cause a certified copy of the full text of the proposed ordinance to be posted for a period of 30 days in the office of the City Clerk after the meeting at which the ordinance is adopted and then be made available upon request. __________________________

Description
Attachment 'A' - SRO Agreement FY 2023/24
Campus Based Peace Officer (CBPO)
City/School Agreement
This agreement is entered into, and recognized as a vital working partnership agreement (based on the City/School JPA), between the City of Dinuba referred to as the CITY, and the Dinuba Unified School District, referred to as the DISTRICT.

The City and District desire to place one School Resource Officer (SRO) on the campus of the Dinuba High School and one School Resource Officer on the campus of the Washington Intermediate School and Sierra Vista School. This represents a total of two SROs assigned to the District for the purpose of providing police presence and police services in the areas of prevention, intervention/enforcement, training and counseling.

It is the intent of the City and District that the establishment of the SRO partnership will improve the safety, behavior, attendance and grades of the students on the campuses as measured by a decrease in suspensions, student expulsions, illegal offenses and juvenile crime. It is also the intent of both parties that the presence of the SROs on the campuses will help troubled students avoid involvement with the juvenile justice system.

Both parties acknowledge and agree that the SROs do not relinquish any of their constitutional powers or necessary discretion to enforce the law when there exists reasonable suspicion and/or probable cause to do so. The parties further acknowledge and agree that the public maintains their rights to hold the SROs accountable pursuant to Penal Code section 832.5 and any other applicable laws.

ATTACHMENT 'A'
The City and District are willing to enter into this agreement upon the terms and conditions set forth:

1. The City shall provide to the District:
a. Two SROs, one assigned to the campus of Dinuba High School on a shared basis with Sierra Vista campus and one assigned to the Washington Intermediate School campus.
b. All SROs will be scheduled to be at the schools of their respective assignment during the hours and times recommended by the schools’ principal and mutually agreed upon by the City and District. Generally, this will be between 7:30 AM and 4:30 PM Monday through Friday with consideration given for flexible scheduling on days with school events such as games and dances.
c. Generally speaking, the SROs will be available for a 40-hour workweek beginning the 2nd week of August through the 4th week of June. Vacations and time off will track as practical with the District’s vacation and time off schedules.
d. All SROs are Peace Officers under the Penal Code and are employed by the Dinuba Police Department answerable directly and solely to the Chief of Police or the Chief’s designee. Nothing in this agreement supersedes or negates any of SROs’ rights under the Public Safety Officers Procedural Bill of Rights Act (Government Code §§ 3300 et seq).

2. The District shall provide to support this program the following:
a. The Principal of each site shall designate a site administrator as the liaison and District operational coordinator to the SRO and will provide a system of accountability by which the SRO can follow which is conducive to the normal operations of the District and City.
b. Each school site shall provide adequate office space on-site; along with a desk, telephone, school site radio, and office supplies. c. Provide up to $2000 annually for training for POST certified and assignment related classes to further develop the skills and abilities of the SROs. Such training and classes will support a planned developmental program mutually developed by the District and City.
d. Designated parking spots will be available at each site for the SRO official vehicle.

3. School Resource Officers shall provide the following to the campus of their respective assignments:
a. The SRO attire will be the police service uniform with modifications authorized to include a police standard polo shirt and jacket. b. Each SRO will be assigned a patrol vehicle appropriately marked and identified as a police vehicle as a part of this program. c. SRO will work on their assigned campus as their primary workstation throughout the school year in a collaborative manner with the site administrators and staff, maintaining the highest level of visibility possible. It will be the intent of this agreement, for the SROs not to be called away from their assigned school work site for any form of routine police business. SROs may be called to leave their work site only for incidents of catastrophic scale jeopardizing citywide security after proper notification to the site administrator.
d. SROs will develop and maintain open communications and accountability with the administration of their assigned campus and foster and maintain that accountability with the management of the school so the District is always aware of the SROs’ status on and off campus.
e. SROs will make a positive effort to interact with students as a representative of the Dinuba Police Department and as an adult role model outside the classroom, on the school grounds or during any school activity. f. SROs will utilize intervention, prevention, teaching, counseling, and enforcement skills with all the students with special attention to those involved in criminal activity.
g. SRO Roles and Responsibilities: SROs will work with the District and campus staff to provide a safe learning environment, provide valuable resources to school staff members, foster positive relationships with the youth, and develop strategies to resolve problems affecting youth and protect all students, so that they can reach their fullest potentials. To accomplish this, SROs serve three main roles: educator (i.e. guest lecturer), informal counselor/mentor, and law enforcement officer. h. SROs will conduct investigations of criminal/juvenile related cases where either the victim, witness or suspect attends the school whether the case is on site or assigned as a follow-up investigation. When applicable, the SROs will work with the Tulare County Probation Department’s juvenile diversion program, also known as “T-Bolt” regarding out-of-custody referrals to the juvenile justice system.
i. SROs shall make every effort to see that school employees understand the instructional, intervention, or enforcement role of the SRO and how to best utilize the services provided by the Police Department. j. Student Discipline: District staff shall be responsible for student discipline and shall make all decisions regarding the imposition of discipline for students enrolled at their campus and to enforce the Education Code. The SROs agree to work with school staff regarding student discipline matters upon request by District staff.
k. Student Records. The parties agree that the SRO shall be allowed access to necessary student records for which the SRO has a “legitimate educational interest.” The SRO shall not provide student records to anyone else without first consulting with a District administrator. The SRO shall not inspect or copy confidential student records outside the scope of the SRO’s service, including any record related to a student’s place of birth or immigration status, except as allowed by law. The District remains in direct control of the use, maintenance and disclosure of student records in accordance with Education Code section 49076 and other applicable provisions of law. l. SRO’s will work in a coordinating role with District staff to plan and implement monthly meetings to strategically plan and target assistance on issues regarding critical information involving criminal activity related to the schools. These meetings shall involve appropriate City and District staff, representatives of the District Attorney’s Office, Tulare County Sheriff’s Department, Tulare County Gang Task Force, Probation, and other agencies as needed.
m. SRO’s will attend school expulsion hearings and other administrative meetings as requested by assigned school or district administration.

4. Feedback and Evaluation. Both Parties will work together to develop and implement procedures to provide periodic feedback and evaluation data for the purpose of measuring crime trends at District schools, the development of positive working relationships with students, school staff and parents/guardians, and the SRO’s effectiveness.

5. Financial Agreement:
a. Fiscal Breakdown in Partnership Agreement.

1. The District and the City hereby agree to share in the costs, salary, benefits, vehicle maintenance, training, and estimated overtime, of the two SRO’s (All at the same pay level of a Police Officer) by each paying 50% of these expenditures. Each party shall pay an estimated $149,662 for the annual period of this agreement (See attachment A).

2. The City of Dinuba will bill the District at the end of each quarter for one-fourth of $149,662. The District shall pay that invoice within 30 days to the City of Dinuba. (Prorated for the first year of implementation.)

6. Indemnity:
a. The District shall indemnify, defend, and hold harmless the City, its officers, officials, employees, and volunteers from and against any and all liability, claims, damage, cost, expenses, awards, fines, judgements, and expenses of litigation (including, without limitation, costs, attorney fees, expert witness fees and prevailing party fees and cost) of every nature arising out of or in connection with the assigned officer’s performance of work or his or her failure to comply with any of its obligations contained in the Agreement, except such loss or damage which was caused by the active negligence by the City or the gross or willful misconduct of the assigned officer.

The City shall indemnify, defend, and hold harmless the District, its officers, officials, employees, and volunteers from and against any and all liability, claims, damage, cost, expenses, awards, fines, judgements, and expenses of litigation (including without limitation, costs, attorney fees, expert witness fees and prevailing party fees and cost) of every nature arising out of the active negligence by the City or the gross or willful misconduct of the assigned officer during the performance of work hereunder. b. If the District rejects a tender of defense by the City and/or the assigned officer under this Agreement, and it is later determined that the City and/or the officer breached no duty of care and/or was immune from liability, the District shall reimburse the City and/or officer for any and all litigation expenses (including, without limitation, costs, attorney fees, expert witness fees and prevailing party fees and cost). A duty of care or immunity determination may be made by a jury or a court, including a declaratory relief determination by a court after the City and/or officer settles a liability claim, with or without participation by the District.
c. The Parties acknowledge that it is not the intent of the Agreement to create a duty of care by the City or its assigned officer that they would not owe in the absence of the Agreement. The Agreement does not create an affirmative duty of care (including, without limitation, a duty to protect, a duty to deter and/or a duty to intervene) by the City or the assigned officer and the absence of the assigned officer and/or the patrol vehicle is not a material breach of this Agreement. The Parties further acknowledge that by entering into this Agreement neither the City nor its assigned officer intends to waive any immunities to which they would be entitled in the absence of the Agreement.

INTEGRATION OF PRIOR TERMS AND CONDITIONS
d. This Agreement, including all recitals, constitutes the entire agreement of the Parties. This Agreement may be amended or modified only by the mutual written agreement of the Parties. This Agreement is invalid unless approved by the legislative body of each Party, although it may be executed by an authorized agent of each Party. 1. Work Session - 4:30 PM

1.1. Presentation of Preliminary Budget for FY 2023/24 (KS) Mayor Reynosa opened the work session at 4:31 p.m.

Administrative Services Director Solis continued with the second work session on the Fiscal Year 2022/2023 projections and Fiscal Year 2023/2024 preliminary budget. Solis went over the Enterprise Funds including Water, Sewer, and Disposal funds. Solis reported that currently there is a utility rate study being conducted that will impact the funds. The sewer fund will have a deficit attributed to an increase in repairs and maintenance and a one-time expense for the clarifier.

Solis reported that the city's transit program has had extensive changes offset by TCRTA, with expenses over revenues due to loans given to transit, payment is expected in December 2027. Ridge Creek Golf Course is showing growth in revenue across the board. Future reporting will include separate golf capital expenses that will be provided to the council.

Solis stated that the Ambulance Fund has projected revenues exceeding expenses including the Inter-Governmental Transfer program. The Ambulance fund positions include a reclassification of three Firefighter/Paramedics with pending reimbursement from Alta Health District and one part-time Billing Clerk. The Council expressed the importance of funding the three Firefighter/Paramedic positions regardless of funding from the Alta Health District.

Solis reported that the city is exploring lease options for the CNG station. At this time the CNG station is used by transit buses, Pena's Disposal, the Dinuba School District, and private customers.

Solis reported on Special Revenue, including Public Safety/Measure F, COPS, CDBG, Lighting and Landscaping Districts, and the new Community Facilities District that is similar to the Lighting and Landscaping Districts but with more flexibility in the utilization of funds. Internal Service Funds including Risk Insurance and Health Insurance.

Solis shared that Capital Projects Funds are similar to last year's with projects in progress and necessary adjustments to funds will be presented at the next council meeting. Solis presented the Debt Service summary by fund type along with the debt service payoff summary.

The Council requested that future budget requests be submitted to the Council for review. Mayor Reynosa advised that she contacted the City of Reedley for staff information for comparison to our city. Reynosa believes the Public Works department is understaffed. Reynosa would like another Code Enforcement Officer position under the Police department.

Reynosa inquired about how long before the city outgrows the Wastewater Treatment Plant. City Engineer Watts advised there is no threat at this time. A significant increase in industrial or commercial development would be the only threat.

Mayor Reynosa adjourned the work session at 6:18 p.m.

At 9:08 p.m. after the regular council meeting a motion by Council was made to extend the work session.

Mayor Reynosa inquired about the loss to the Fire Department budget. Administrative Services Director Solis advised that the expense was transferred from the general fund to other funds with no loss to budget. Fire Chief Webster advised that the Fire budget is funded by Measure F, Ambulance, and General fund. Webster advised the Council that the fire department is underfunded. Solis advised that the Ambulance fund does not have the flexibility to absorb any positions if CDFA taxes are withdrawn.

Council Member Launer asked if there were other departments where funds were transferred. Solis advised that there were at a smaller scale. Launer is concerned about funding if Alta Health District withdraws its funds. Council Member Thusu asked if there is a way to minimize liability and find funds, the Council wants to find a suitable solution.

Launer asked Webster what the fire department’s minimum need was. Webster advised the minimum need is 390k for three Firefighter/Paramedics.

Solis asked for council clarification and advised that funding is limited to the general fund.

Webster advised Council that the need is not for six positions now, but rather, once the second fire station is built. Webster is currently asking for three positions.

Reynosa advised that the Fire department would get their three positions. Webster expressed an issue with the transfer of funds. Council asked staff to review the rules for transfers to ensure that there are no violations.

The Council recommends moving forward with the review of the plans for the second Fire Station. Reynosa asked for the budget process to begin earlier in the year and for the Council to be included in the process.

The Council approved the budget as is with the funding of three fire positions and dropping the contingency of the Alta Health District funding.

Reynosa closed the work session at 10:02 p.m.

Extension of Urgency Ordinance No. 2032-04 Regarding “Prohibited Activities in Public Parks and Recreation Facilities” (DY)

RECOMMENDATION
City Council to receive staff report, open and close a public hearing, and vote, by a 4/5 majority to extend Urgency Ordinance No. 2023-04 related to “Prohibited Activities in Public Parks and Recreation Facilities”.

EXECUTIVE SUMMARY
Urgency Ordinance No. 2023-04 is currently in effect in the City of Dinuba and prohibits camping, and other specified activities, in City Parks and City recreational facilities. The urgency ordinance also attempts to improve compliance with recent federal case law regarding the constitutional rights of unsheltered individuals.

OUTSTANDING ISSUES
None.

DISCUSSION
The goal of this urgency ordinance, which is attached herein as 'Attachment A', is to provide clarification regarding the enforcement of camping, and other specified activities, in City Parks and City recreational facilities. The urgency ordinance also attempts to improve compliance with recent federal case law (Martin v City of Boise, 920 F. 3d 584 (9
th Cir. 2019)) regarding the enforcement of restrictions against camping and sleeping in public parks, and other activities such as alcohol consumption and fires in City parks and recreational facilities.

Section 2 of this urgency ordinance provides definitions for terms such as “Abandoned Personal Property”, “Available Shelter”, “Camping”, and “Personal Property”. The goal of this section is to provide clarification and aid enforcing officers in defining the parameters of their authority to enforce this ordinance.

Section 3 prohibits camping in City parks and recreational facilities. This section allows the City to remain in compliance with current federal case law, and provides clear language regarding the prohibition of camping in City parks and recreational facilities.

Section 4 of the urgency ordinance provides detailed procedures for the impoundment of personal property being stored in public parks. These procedures rely on the definitions of personal property and abandoned personal property and the section also complies with constitutional rights against unreasonable searches and seizures of personal property.

The remaining sections reasonably prohibit fires from being started in City parks and recreational facilities as well as alcohol from being consumed in these locations. Staff felt it prudent for clarification purposes to include a prohibition on alcohol at these locations, which is consistent with section 11.12.180 of the Dinuba Municipal Code which prohibits alcohol from being consumed in public places.

Because urgency ordinance No. 2023-04 adopted by City Council on 5/23/2023 will expire on 7/7/2023, City staff recommends that City Council extend the ordinance for the length of time established by law (10 months and 15 days) and by the legally required four-fifths vote. An extension will prevent any gaps in enforcement. It is anticipated that the permanent changes proposed in Ordinance No. 2023-05 shall become effective on July 27, 2023.

FISCAL IMPACT
None.

PUBLIC HEARING
Government Code section 65858(a) requires a public hearing for the extension of any urgency ordinance as well as a four-fifths vote. Extensions of urgency ordinance last for 10 months and 15 days.

This notice will specify a date and time when the personal property will be impounded if it is not removed. The notice shall also state the legal authority for the impoundment of the property and the specific location of where the impoundment will occur.

E. If, after any notice required by subsection D. is given, personal property remains unlawfully stored in a public park/recreation area, that personal property may be impounded. The person impounding the personal property shall leave a notice in a conspicuous place at or near where the personal property was located prior to being impounded, advising where the personal property is being kept and when and where it may be claimed by its owner.

If the personal property consists of money, it shall be deposited with the Finance Director or designee for a period of not less than ninety (90) days, unless sooner claimed by its owner. All unclaimed money received by the Chief of Police, and not delivered to the owner during the ninety-day period, shall thereafter be deposited in the general fund.

I. Subject to the provisions of subsection I. below, any personal property coming into the possession of the Chief of Police or designee may be disposed of immediately and without notice, in a manner that the Chief of Police or designee determines to be in the public interest, when such personal property is perishable, contraband, or constitutes an immediate threat to the public health or safety.

J. The provisions of this chapter shall not apply to real or personal property or money subject to confiscation pursuant to state or federal law, to personal property that constitutes evidence of a crime, evidence in an ongoing criminal investigation and/or civil proceeding pursuant to state or federal law.

• Sewer Fund – Operating revenues in the Sewer Fund are anticipated at $3,902,748 and expenses are $4,265,933, which will result in a deficit of $363,185 that will be offset by fund balance.
• The Disposal fund is projected to have operating revenues of $3,491,740 and operating expenses of $3,241,704 resulting in revenues over expenses of $250,036. • The revenue in the Ambulance Fund reflects ongoing growth primarily due to the Intergovernmental Transfers for ambulance service reimbursements. The operating revenue for the fund is expected to come in at $5,226,700, while operating expenses are expected to be at $4,327,761.
• The Golf Course Fund is projected to have revenues of $3,722,671 and expenses of $3,593,851 which will result with a surplus of $128,820.

Special and Internal Service Funds
The proposed Special Revenue Funds and Internal Service Funds budget for Fiscal year 2023/24 total $18.5 million.

The Special Revenue Funds are used to account for restricted revenues such as the Measure F, Gas Tax, COPS grant, etc. The Public Safety Measure F Fund is anticipated to have revenues of $3,200,000 and operating expenses of 3,171,447 resulting in a small surplus of $28,553. One-time expenses consisting of the purchase of Tasers and the sales tax payment for the Fire Apparatus are proposed to be paid out of fund balance.

Internal Service funds account for charges assessed internally to City departments for operation, maintenance and replacement of vehicles and other services. These funds are derived from charges to the internal departments on a pro rata share.

Capital Projects
The ongoing Capital Project funds for Fiscal year 2023/24 total $53.4 million which include local, state and federal revenues to fund infrastructure projects throughout the City. These projects reflect an ongoing commitment to improve and expand City parks, streets and other major infrastructure throughout the City.

Capital Improvement projects are critical to maintaining and improving the City's infrastructure and public facilities. A few of the top traffic and street safety projects for fiscal year 2023/24 include the $17.2 million Active Transportation Program (ATP) Grant and the $1.3 million HSIP Cycle 11 grant for new traffic safety amenities throughout Dinuba. A summary of City-wide capital improvement projects is included in the attached budget document.

Resolution No. 2023-35 enclosed herein as Attachment 'A' includes a full copy of the proposed Fiscal Year 2023/24 Operating Budget as Exhibit 'A'.

Award of Contract to Avison Construction, Inc. for the FY 22/23 Street Reconstruction Projects (JW)

RECOMMENDATION
Council to award the contract for the FY 22/23 Street Reconstruction Projects to Avison Construction, Inc. in the amount of $2,088,095.00 and authorize the City Manager or designee to execute the contract documents.

EXECUTIVE SUMMARY
Staff evaluated the condition of existing roadways per the city's pavement management system and identified several streets that were in need of reconstruction. Staff put these streets projects out to bid and received a total of four (4) bids by the June 19, 2023 deadline. The lowest responsive bid was received from Avison Construction, Inc. in the amount of $2,088,095.00 which includes the addition of Add Alternate #2 for the reconstruction of Nebraska Avenue from Englehart Avenue to Viscaya Parkway. Staff is requesting that the City Council award the bid to Avison Construction, Inc.

OUTSTANDING ISSUES
None.

DISCUSSION
The FY 22/23 Street Reconstruction Projects will consist of the reconstruction of various intersections and streets around town. The streets identified for reconstruction were determined by the city's pavement management system which prioritize street maintenance, repair and reconstruction based on their condition. The streets located within the project scope of work consist of the intersection of Sierra Way and Englehart Avenue, the intersection of El Monte Way and Crawford Avenue, Emperor Estates Alley Extension from Mariposa Street to Alta Avenue, Alley east of L Street from Tulare Street to Kern Street, and Nebraska Avenue from Englehart Avenue to Viscaya Parkway as shown on Attachment 'A'.

Staff solicited bids and received a total of four (4) proposals on the June 26, 2023 deadline. The bids are summarized as follows:

Award of Contract to Pavement Coatings Company for the FY 22/23 Street Rehabilitation Project (JW)

RECOMMENDATION
Council to award the contract for the FY 22/23 Street Rehabilitation Project to Pavement Coatings Company in the amount of $536,342.85 and authorize the City Manager or designee to execute the contract documents.

EXECUTIVE SUMMARY
The project was formally advertised and bids opened on June 14, 2023. Staff received a total of three (3) bids. The lowest responsive bid was received from Pavement Coatings Company in the amount of $536,342.85 which includes the award of Additive Alternate #4 for Uruapan Way from Alta Avenue to Tulare Street. Staff is requesting that the City Council award the bid to Pavement Coatings Company.

OUTSTANDING ISSUES
None.

DISCUSSION
The FY 22/23 Street Rehabilitation Project will consist of asphalt dig outs, asphalt skin patches, crack filling, a type II slurry seal, and striping. The streets identified in this project follow the City's current pavement management program. The streets located within the project scope of work consist of Euclid Avenue from Saginaw Avenue to Roosevelt Elementary School, Euclid Avenue from El Monte Way to North Way, Tulare Street from Alta Avenue to the Dinuba Fire Station, L Street from Fresno Street to Ventura Street, and Uruapan Way from Alta Avenue to Tulare Street (Additive Alternate #4) as shown on Attachment 'A'.

The two preventative maintenance methods that will be used within the project limits will be crack filling and an application of a type II slurry seal. The intent of such pavement techniques is to apply the type II slurry seal before the pavement degrades to a point where preventative maintenance is no longer an option. With the reduced costs of projects like a type II slurry maintenance is no longer an option. With the reduced costs of projects like a type II slurry seal much larger project areas can be treated at a time, prolonging the life of the pavement across the City's roadway network. Once the pavement preventative measures are completed, the Contractor will be required to re-stripe the various streets affected.

Staff solicited bids and received a total of three (3) proposals by the June 14, 2023 deadline.

Award of Contract to JT2, Inc. DBA Todd Companies for the Nebraska Park Improvements Project (JW)

RECOMMENDATION
Council to award the contract for the Nebraska Park Improvements Project to JT2, Inc. DBA Todd Companies in the amount of $225,000.00 and authorize the City Manager or designee to execute the contract documents.

EXECUTIVE SUMMARY
During normal rain events, the Dog Park and areas surrounding the basin flood which makes the park not completely accessible in the winter months. In order to make the park more accessible for the residents in the surrounding neighborhoods, staff will be deepening the existing basin within the existing fence line as part of the base bid. In addition to the deepening of the basin, staff is recommending award of Add Alternate #1 consisting of running a water and sewer service for a future restroom. The project was formally advertised and one (1) bid was received. The lowest responsive bid was received from JT2, Inc. DBA Todd Companies in the amount of $225,000.00. Staff is requesting that the City Council award the bid to JT2, Inc. DBA Todd Companies.

OUTSTANDING ISSUES
None.

DISCUSSION
For years the City has experienced flooding at the Nebraska Park due to insufficient capacity of the existing basin. The existing basin was only intended to be temporary until the future master planned basin is constructed on the other side of Nebraska Avenue. In order to make the park more accessible and allow residents to potentially use the dog park in the winter months, staff prepared plans to deepen the existing basin within the existing fence line. In addition to the deepening of the basin, staff is recommending award of Additive Alternate #1 which consists of installing a sewer and water service to the future restroom similar to the recently installed Entertainment Plaza restroom. Attachment 'A' shows the location of the future restroom.

Staff solicited bids for the construction of the site improvements at Nebraska Park in preparation for the next rainy season and future restrooms. A total of one (1) proposal was received from JT2, Inc. DBA Todd Companies in the amount of $137,500.00 for the base bid and $87,500.00 for Additive Alternate #1.. A copy of the JT2, Inc. DBA Todd Companies bid proposal is enclosed herein as Attachment 'B'.

Staff recommends Council award the contract for the Nebraska Park Improvements Project to JT2, Inc. DBA Todd Companies in the amount of $225,000.00 and authorize the City Manager or designee to execute the contract documents.

City Council Staff Report
Department: PUBLIC WORKS June 27, 2023
To: Mayor and City Council
From: George Avila, Interim Public Works Director
Subject: 2023 Water and Sewer Utility Rate Study - Rate Option Selection (GA)

RECOMMENDATION
Council to receive information regarding the 2023 Water and Sewer Utility Rate Study, selected a preferred option, and direct staff to prepare the required Proposition 218 notice to utility customers.

EXECUTIVE SUMMARY
The City contracted with Willdan Financial Services to prepare a Water and Sewer Utility Rate Study. This comprehensive review has confirmed that an adjustment to water and sewer utility rates is necessary to continue funding current operations, provide more capacity for capital maintenance and to construct new capital improvements. Staff has prepared three tiered options for consideration and recommends Council select a preferred option and direct staff to prepare the required Proposition 218 notice.

OUTSTANDING ISSUES
City Water and Sewer operations are projected to operate in a deficit unless rate adjustments are implemented. Upon receipt of the Utility Rate Study presentation, a public hearing will also be scheduled to give residents an opportunity to offer testimony regarding the proposed rate adjustment. If no majority protest is received, new rates can become effective on October 2, 2023.

DISCUSSION
The city's water and sewer utilities provide essential services to Dinuba residents. To a significant extent, the health and safety of our community depends on the city's ability to continue offering these basic services. The city operates these utilities with the revenue generated from approximately 6,000 utility customers. Annually, operating costs are roughly $3.5M for water and about $4M for sewer. Revenues and expenditures are monitored regularly by staff and every attempt is made to reduce costs and operate as efficiently as possible. However, periodic rate adjustments are unavoidable given rising operating costs for items such as utilities, supplies, fuel, as well as the cost to maintain or replace aging infrastructure.

Another factor is that that due to the lasting financial effects of the Covid-19 pandemic, the city decided to postpone raising rates for as long as possible. It has now been four years since the last increase to water rates and five years since the last increase to sewer. During that same time the consumer price index increased by

14.7%. This has created a significant impact to available cash reserves. Starting in the current fiscal year expenses are expected to exceed revenues by over $100,000 annually and the shortfall grows progressively year-over-year unless additional revenue is available.

In addition to the need for additional funding for current operations, the city's infrastructure is many decades old in some parts of town and requires significant repair and maintenance. Given the delay in increasing rates many of these maintenance projects have been postponed. This has increased the incidents of water leaks and sewer main failures. The wastewater treatment plant must also be regularly upgraded to respond to new regulatory mandates and to accommodate the city's growing population. Lastly, the city's water and sewer crews operate with fewer staff than comparator cities. In order to provide the highest level of service to the community, additional staffing is required to perform preventative maintenance, improve response times, and improve overall safety for utility workers and the community at large
All of these factors have been considered in the development of new rate options.

The City Council will be presented with three options or tiers as shown in the presentation prepared for this agenda item enclosed herein as Attachment 'A'. These tiers are summarized as follows:

Tier 1
Provides funding to cover current operations only with no new staffing or capital improvements.

Tier 2
Adds three (3) full-time Utility Workers.

Adds one (1) full-time Wastewater Treatment Plant Superintendent.

Includes funding for annual sanitary sewer lift station maintenance program.

Tier 3
Includes all items in Tier 2.

Includes funding for steel water pipe replacement program.

Includes funding for the preparation of waster master plan.

Includes funding for the construction of Whitney water main replacement.

Includes funning for the construction of Parkway water main replacement.

Includes funding for the construction of W. El Monte Way water & sewer main replacements.

Includes funding for the construction of Tulare sewer main replacement.

Includes funding for the construction of Alta Avenue sewer main replacement.

Includes funding for the construction of Sierra Way sewer main replacement.

Includes funding for the construction of Euclid Avenue sewer main replacement.

Staff has worked with Willdan Consulting Services for many months to mitigate the impact of the proposed increases. Every attempt has been made to reduce the impact to rate-payers, and spread the cost increases evenly over the five year planning period. The proposed increases in the various options presented by tier range from $1.51 to $11.64 per month for the first year. The range of increases reflects what is included in each tier and how many days of operating reserves are available for emergency situations. To simplify the benefits of the three tiered options, lower rates result in providing no additional staff or capital maintenance and improvements and lower reserves, and only provide the revenue that essential to avoid an operating deficit. The higher rates provide additional staff, new capital maintenance and new capital improvements and a healthier cash reserve.

Staff recommends Council review the presented information, selected a preferred option, and direct staff to prepare the required Proposition 218 notice to utility customers.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. However, moving this item forward will ensure that the City has sufficient operating revenue to maintain and perhaps improve on existing service levels in the water and sewer utilities.

PUBLIC HEARING
