DISCUSSION
Earlier this year, staff applied for the Clean California Local Grant Program (CCLGP) Cycle 2 grant, a State program which is sponsored by the California Department of Transportation (Caltrans). The project application was in the amount of $2,945,000 for the Dinuba Entertainment Plaza Renovation & Beautification Project.

The Entertainment Plaza Renovation & Beautification Project includes both infrastructure and non-infrastructure community place-making elements such as urban greening, volunteer litter cleanup, and multicultural features. The installation of shade structures and shade trees will provide comfort and protection during extreme heat waves, mitigating the heat island effect. Benches and picnic tables will create more gathering spaces, encouraging social interactions. This project will install public art murals that embody Dinuba's creative spirit and culture. The pavilion stage renovation will allow for a wider variety of performances and events. Lastly, installing low-water use landscaping showcases our commitment to resource conservation while maintaining the plaza's aesthetic appeal. These renovations are aimed at creating a more vibrant, inviting, and sustainable cultural hub for all Dinuba residents to enjoy.

Staff received notice that the City of Dinuba has been awarded the Clean California Local Grant Program grant in the amount of $2,945,000 for the Dinuba Entertainment Plaza Renovation & Beautification Project. Agreement with Tulare County Consolidated Ambulance Dispatch for Dispatch Services (GC)

RECOMMENDATION
Council approve the agreement with Tulare County Consolidated Ambulance Dispatch (TCCAD) and authorize the City Manager to execute the agreement.

EXECUTIVE SUMMARY
For the past 15 years, the City of Dinuba has partnered with Tulare County Consolidated Ambulance Dispatch, Inc. (TCCAD) to provide the City with emergency medical dispatch services. The current agreement expired on June 30, 2023. Staff is recommending renewal of the agreement for dispatch services for an additional three years.

OUTSTANDING ISSUES
None.

DISCUSSION
The continued contract with TCCAD for emergency medical dispatch services is the best way for the City to provide this critical service at minimal cost. Without this agreement, the City would have to fund the entire operation for medical dispatch services, including the purchase of dispatch equipment, software, and hiring up to six full-time dispatchers. The agreement with TCCAD also provides operational and technological enhancements such as vehicle tracking, closest unit dispatching, and automatic coverage of our response area when all of our paramedic units are committed to other incidents.

The proposed agreement for dispatch services is enclosed herein as Attachment 'A'.

FISCAL IMPACT
TCCAD's compensation for services has changed from a flat monthly rate to a fee for each dispatched call. The compensation for services for the duration of this agreement is as follows; fiscal year 23/24-$19.55 per dispatched call, fiscal year 24/25-$21.50 per dispatched call, fiscal year 25/26-$23.65 per dispatched call.

Resolution No. 2023-53, Proposal for 44-lot Tentative Subdivision Map (Rose View Estates, Phase II), neighborhood park and offsite improvements (KSch)

RECOMMENDATION
City Council conduct a public hearing and adopt the following:

Resolution No. 2023-53 (Attachment “A”) approving a Vesting Tentative Subdivision Map (Rose View Estates, Phase II) to create 44 single family residential lots and associated improvements, including the extension of Wright Street to connect to Kamm Avenue and conversion of the existing park basin into seven single family residential lots.

EXECUTIVE SUMMARY
Public hearing to consider an application for a Planned Unit Development Tentative Subdivision Map (Rose View Estates, Phase II) to create 44 Single Family Residential lots on a 9.6-acre site located southeast of the intersection of Grace Lane and Wright Street, and also an extension of Wright Street to connect from La Vista Avenue to Kamm Avenue, and convert the existing ponding basin at the corner of La Vista and Wright into 7 single family residential lots.

OUTSTANDING ISSUES
None.

DISCUSSION
The project consists of the establishment of a new 44-lot single family residential planned unit development subdivision (Rose View Estates, Phase II) on a vacant 9.6- acre parcel, generally located southeast of the intersection of Grace Lane and Wright Street (see Attachment “B” (location map) and Attachment “C” (Aerial Photo)).

The project also includes an extension of Wright Street from La Vista Avenue to Kamm Avenue, and to convert the existing mini park at La Vista and Wright into seven single family residential lots. The purpose of the extension is to improve traffic flow in the area.

The subdivision is proposed by the same applicant as the recently-approved Rose View Estates Phase 1 that was approved on the adjacent 5.5-acre parcel immediately to the east. The Phase 2 subdivision is designed to be an extension/continuation of the Phase 1 subdivision, which was approved by the Planning Commission and City Council earlier this year. Similar to the Phase 1 project, the Phase 2 site is zoned “R1-7.5” (the Single-Family Residential zone (7,500 square foot minimum lot size). The applicant is again requesting a Conditional Use Permit to apply the “PUD” (Planned Unit Development overlay zone). This zone allows flexibility with respect to zoning standards such as lot size and setbacks, provided the Planning Commission and City Council are able to make a finding that the design is “superior” to what could be achieved under standards of the underlying zone.

The subdivision proposes a grid street pattern with two streets running east-west and two streets running north-south. The proposed Tentative Subdivision Map is attached herein as 'Attachment A.' Lot sizes in the proposed subdivision range from 5,874 square feet to 7,062 square feet, with an average lot size of 6,478 square feet Planned Unit Development zone
As noted above, the applicant is requesting a Conditional Use Permit to apply the “PUD” (Planned Unit Development overlay zone).

The PUD zone can only be applied when the resulting subdivision design is “superior” to what could be achieved with conventional zoning. Specific findings are listed in Resolution 1127. Such findings can be difficult to make but simply getting more and smaller lots is not justification for finding of a superior design. For Phase 1, the City applied requirements to help make the finding of superior design, and these are also recommended with Phase 2 and include:

Tree-lined streets. Parkways will be provided between the curb and sidewalks and street trees established, with root barriers to protect concrete. Trees will be maintained through a landscape contractor with funding from the Landscape and Lighting District established for the project. Trees will shade and cool streets and beautify the neighborhood.

Pedestrian-scale streetlamps. Antique-style street amps will be installed to further strengthen the desired pedestrian-oriented character of the project.

Stamped/colored paving at crosswalks
Architectural Control of the homes. The recently-adopted Residential Design Guidelines strongly recommends that home façade design contributes to the desired pedestrian-oriented character of residential neighborhoods. A large part of this strategy is to reduce the dominance of large, blank garage doors and create more of a human-oriented façade design. With this concept in mind, it is recommended at least half of the homes in the subdivision feature large, useable front porches with the garage door set at or behind the front plane of the dwelling.

Circulation Improvements
When Phase 1 was approved there was some concern expressed at both Planning Commission and City Council that circulation into and out of the subdivision was not optimal. With the addition of Phase 2, staff has identified an opportunity to improve connectivity from the subdivision up to Kamm Avenue to the north. This is illustrated in Attachment “F” and consists of extending Wright Avenue north (through an existing mini park) to connect to Kamm.

Staff believes this new connection will afford better street connectivity and help to improve traffic flow in this area by dispersing traffic over a wider network of streets. Also, as the area continues to grow (with future subdivisions (to the south)) there will be additional opportunities to establish street connections west, directly to Alta Avenue, helping to further alleviate congestion in the area.

As part of this project the City would then exchange the remaining land in the park with the developer who would then create individual lots, each to be developed with a single family home. The existing storm-water ponding basin within the stubdivision is already subdivided with seven lots; these existing lots would need to be modified to accommodate the new Wright extension, and the applicant would need to submit a Lot Line Adjustment to achieve this.

Utilities
The Public Works Department reports that there is adequate capacity in the City’s water and sewer systems to accommodate the project. Each home will also be assessed the City’s utility development impact fees. Funds accrued by these fees are used for capital improvements within each utility system.

Environmental Analysis
Because of the small size of the project, staff believes the project can be exempted from the requirement to prepare an analysis of potential environmental impacts (per Section 15061 (b) (3)of CEQA) which states that where it can be seen with certainty that a project will not have significant impacts, then an analysis is not required.

Planning Commission Review and Recommendation
The Planning Commission reviewed the project at their meeting on October 3, 2023 and voted unanimously to recommend approval. One resident in the area spoke, voicing concerns about storm drainage if the existing storm-water ponding basin at Wright/La Vista is eliminated. Staff ensured the resident and Commission that storm drainage will be adequately handled by the installation of a new storm drain line to serve the neighborhood, routing drainage west to the existing drainage basin located west of Alta (southeast of the intersection of Sierra and Monte Vista).

Consultation/Public Comment
The City mailed notices of the proposed project and public hearing to property owners within 300 feet of the site, and tenants within 100 feet of the site (including along the Wright Street extension and mini park conversion site).

Findings
The project complies with the required findings of the Dinuba Municipal Code for application of the PUD (Planned Unit Development) zone, and Tentative Subdivision Map contained in the attached resolutions.

Appeal of Planning Commission Decision on Application 2023-10, Variance for freestanding sign at Mercantile Row Shopping Center (KSch)

RECOMMENDATION
City Council consider the information provided regarding Application 2023-10, a Variance for a freestanding sign at Mercantile Row Shopping Center, and vote to affirm or overturn the decision of the Planning Commission, by adopting Resolution 2023-54.

EXECUTIVE SUMMARY
Mr. Robert Palmer previously requested a Variance to allow a third monument sign for the Mercantile Row Shopping Center. The proposed third sign will also exceed height and sign face size standards. The Planning Commission voted to approve the Variance except for the request to allow a taller sign. Mr. Palmer has appealed that part of the Commission's decision.

OUTSTANDING ISSUES
None

DISCUSSION
On October 3, 2023 the Dinuba Planning Commission conducted a public hearing to consider a Variance application regarding signage, submitted by Mr. Robert Palmer, representing the Mercantile Row Shopping Center on E. El Monte Way (see Attachment "B" (Location Map) and Attachment "C" (Aerial Photo).

The Variance proposed a third freestanding sign on the El Monte Way frontage of the shopping center property (whereas the sign ordinance rules only permit two signs in that area).

A second component of the Variance is that the proposed freestanding sign would exceed City standards for sign height and also the size of the sign faces. The sign proposed by the applicant is shown in Attachment "D". The maximum permitted sign height is 10 feet, whereas the applicant proposed a sign approximately 11 feet high.

In addition, the maximum permitted sign face is 35 square feet per face, whereas the applicant proposed each sign face contain approximately 66 square feet.

The purpose of these regulations are to allow commercial uses to identify themselves in an appropriate fashion while avoiding the visual clutter of numerous signs.

The Planning Commission conducted the public hearing and ultimately voted 5-0 to approve the Variance, except the Commission voted that the sign could not exceed 10 feet (instead of the approximate 11 foot height requested by the applicant.

The applicant has subsequently filed an Appeal of the Planning Commission's decision, in accordance with the procedures established by Dinuba Municipal Code Section 17.80.080 B (Appeals). The applicant also provided a written statement explaining the reason for their appeal (see Attachment "E").

In his statement, Mr. Palmer explains that he believes additional signage is necessary to help revitalize the shopping center, by offering each business space for a sign by the street (El Monte Way). The proposed sign (including the top one foot) does have architectural elements that help it to relate to the architectural character of the buildings in the shopping center. The decision of the Planning Commission would most likely eliminate some, or all of the architectural elements (along the top of the sign).

In denying this portion of the Variance, the Planning Commission explained they were not so much concerned about any aesthetic issue as they were more concerned about following the letter of the law, as embodied in the Sign Ordinance. However, it is not clear why they singled out the sign height and not the other components of the Variance (e.g. allowing the third sign and allowing an increase in size of the sign face).

In making its decision, the City Council will want to consider several factors; a single foot of height of a sign is not significant; the Commission's decision is based more on principle. In the long-term it may be more appropriate to amend the sign code - if the subject standard is causing repeated difficulty for applicants (however, this is the first such request under the new sign code adopted in 2018). At the same time the City Council needs to be mindful about standards and how they protect aesthetics and quality of life for the community.

FISCAL IMPACT
None.

PUBLIC HEARING
A public hearing notice for the appeal of the decision was published in the Visalia Times Delta, at least ten days before the City Council's hearing.

BEFORE THE CITY COUNCIL

CITY OF DINUBA, COUNTY OF TULARE

STATE OF CALIFORNIA

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DINUBA CONCERNING AN APPEAL OF THE DINUBA PLANNING COMMISSION’S DECISION ON APPLICATION 2023-16 (A REQUEST FOR

A VARIANCE FOR AN ADDITIONAL FREESTANDING SIGN WITH INCREASES IN HEIGHT AND SIZE

ABOVE THAT ALLOWED BY THE SIGN ORDINANCE) AT THE MERCANTILE ROW SHOPPING CENTER
WHEREAS, an application was filed by Robert Palmer, Trustee, Inc. PO Box 30874, Santa Barbara, CA 93102 for a Variance to allow an additional monument sign and also an increase in height and size of the sign at the existing Mercantile Row shopping center at 2108-2290 E. El Monte Way. The Assessor Parcel Numbers are 018-180-035, -036, -037 and -025; and WHEREAS, the subject site is zoned “C-3” (Community Commercial) and standards for the number and size of commercial signs are established in Section 17.72.110 of the Dinuba Zoning Ordinance. For the subject shopping center, the ordinance allows two freestanding monument signs along El Monte and each sign can be up to ten feet high containing up to 35 square feet of sign face per side; and
WHEREAS, the applicant is proposing a third monument sign that is 11 feet high and containing 66 square feet of sign face (Exhibit “A”), and WHEREAS, the Dinuba Planning Commission conducted a public hearing on October 3, 2023 to consider the Variance application. Following discussion, the Commission voted to approve the request, except that the Commission voted to not allow an increase in height of the sign (specifically that the sign could not exceed 10 feet in height (rather than the approximate 11 foot height requested by the applicant)), and WHEREAS, the applicant has filed an appeal of the Planning Commission’s decision, in accordance with procedures established in the Dinuba Municipal Code, Section 17.80.080 B. Page 2 of 3 ends

WHEREAS, the Planning Department has prepared a staff report and declared the proposed project categorically exempt from the California Environmental Quality Act (CEQA) (Section 15305 of the CEQA Guidelines), and
WHEREAS, the City Council held a public hearing on this Appeal and accepted testimony.

NOW, THEREFORE, BE IT RESOLVED that the City Council, after considering all the evidence presented, determined the following findings were relevant in evaluating the Appeal of the Planning Commission’s decision:
a. That strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary hardship inconsistent with the objectives of the zoning title;
b. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property which do not apply generally to other properties classified in the same zone;
c. That strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties classified in the same zone;
d. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zone; e. That the granting of the variance will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity.

The Planning Commission’s decision is overturned; the subject Variance is approved subject to the following conditions:

1. The height of the sign may be increased to no more than 11 feet, maximum.

Appeal of October 3, 2023, Planning Commission decision to limit Monument height Dear Council,
I am the owner of MercanPle Row Shopping Center. I purchased it four years ago with the intenPon of bringing it back to life. We have made substanPal progress over the last few years; only slowed down by the pandemic.

We expect to see anchor tenants return to the Center over the next year or so. Superior Market has signed a lease for the 35,724 SF space previously occupied by Save Mart. Superior’s store is currently under construcPon and we expect it to open no later than the first quarter of 2024.

The Old Rite Aid space 31,456 SF is being divided into two stores and that shell division is nearing complePon, as I write. We have a signed lease with Ross Dress for Less for nearly two thirds of that space. We expect Ross to open in 2024. The balance of that space is under lease negoPaPons with naPonal novelty retailer, Five Below. We expect to be able to sign that lease, soon.

Starbucks is coming to one of the out parcels; possibly by summer.

Other work is planned to improve the Center and make it vibrant.

To help bring it all together, I felt like the center needed proper signage to expose to the passersby the diversity of businesses which will once again grace the Center.

With the help of your Planning Commission we are happy to announce that we have the signage we need.
