Subject: Downtown Civic Square and City Hall Draft Conceptual Designs (DJ)
RECOMMENDATION
Council review designs for the new Downtown Civic Square and City Hall Draft Conceptual Designs and provide input and direction to staff.
EXECUTIVE SUMMARY
RRM Design Group has prepared draft conceptual exhibits for the Downtown Civic Square and City Hall project. The purpose of the presentation is to collect feedback and direction from Council.
OUTSTANDING ISSUES
None.
DISCUSSION
Downtown revitalization and beautification has been a focus of the City Council and staff for many and years. In 2018, the City contracted with the Cal Poly Urban Planning and Regional Design Program to develop a set of conceptual designs and development strategies which identified opportunities for enhancements in the Downtown. A major component of these strategies is the future relocation of City Hall and the development of a Civic Square into the Downtown area.
The next step in the process for planning for a new City Hall and Civic Square in the Downtown is to develop a conceptual design. last year, RRM Design Group was selected as the most qualified firm to design the future Civic Square and City Hall near the intersection of L St. and Fresno St. The RRM team has worked closely with staff and City Council to review possible uses of the Civic Square, as well as various city functions which may be located in the new City Hall. The firm has prepared a series of design alternatives for the proposed Civic Square and City Hall in preparation of a final preferred conceptual plan which will be used to design future construction plans.
The RRM Design Group will be presenting options for future project, and will cover the various design elements and pros and cons of each site. Staff recommends Council receive information and review the draft conceptual designs for the City Hall & Civic Square Conceptual Plan and provide input direction to staff and the consultant team.

To: Mayor and City Council
From: Jason Watts, City Engineer
Subject: City-Wide Street Improvements Project Discussion (JW)
RECOMMENDATION
Council to receive presentation on major street rehabilitation projects and provide direction on prioritizing projects for funding.
EXECUTIVE SUMMARY
Staff evaluated the condition of existing roadways per the city's pavement management system and identified several streets that were in need of reconstruction or pavement rehabilitation. The streets staff identified were Kamm Avenue from Greene Avenue to College Avenue, El Monte Way from Crawford Avenue to Road 92, El Monte Way from Hayes to Crawford Avenue, College Avenue from Uruapan Avenue (RR Crossing) to Kamm Avenue, Crawford Avenue from Nebraska to El Monte Way, and Crawford Avenue from El Monte Way to Kamm Avenue.
OUTSTANDING ISSUES
None
DISCUSSION
Staff identified several major street rehabilitation projects for possible funding. The streets identified for the rehabilitation were determined by the city's pavement management system which prioritize street maintenance, repair and reconstruction based on their condition. The streets that were identified for possible repair and rehabilitation include the following. Staff has listed the projects from what we believe is the highest priority to lowest priority. Staff is seeking Councils recommendation on project priority for the following projects:
1. College Avenue from Uruapan Avenue (RR Crossing) to Kamm Avenue - $1,200,000.00
2. El Monte Way from Crawford Avenue to Road 92 - $1,700,000.00
3. Kamm Avenue from Greene Avenue to College Avenue - $1,100,000.00
4. El Monte Way from Hayes Avenue to Crawford Avenue - $870,000.00
5. Crawford Avenue from Nebraska Avenue to El Monte Way - $3,100,000.00
6. Crawford Avenue from El Monte Way to Kamm Avenue - $2,400,000.00 The two pavement rehabilitation methods staff has elected to use will be full depth reconstruction on and grinding and overlaying. The first option will consist of removing the old asphalt concrete and base material down to native material. Once the old roadway is removed, the City selected contractor will rebuild the new pavement section with a thicker aggregate base and asphalt section. The second option will consist of grinding off a portion of the asphalt and then performing base repair which will consist of reconstructing areas where potholes, rutting, and sinking have occurred. Once those areas are fully reconstructed, the Contractor will crack fill the grinded pavement, lay a pavement reinforcing mat, and then pave back over the top.
Additionally, staff has included the cost to install median islands along Kamm Avenue and El Monte Way. Installing median islands not only provides aesthetic features when landscaped, but also provides safety enhancements. According to the FHWA (Federal Highway Administration), median islands can provide the following benefits.
Reduction in motor vehicle crashes by 15%
Reduce vehicle speeds
Allow for pedestrian refuge islands
Provide space to allow for additional supplemental signage.
Reduction in pavement maintenance cost.
With the reallocated Measure R Funding, staff recommends performing pavement rehabilitation on these roads to continue the effort on addressing deteriorated pavement throughout town, and is seeking input and direction on the priority of these proposed street rehabilitation projects.
FISCAL IMPACT
The City would have to budget $1.0 million dollars of local operating funds along with the $3.0 million dollars of reallocated Measure R Funding in order to fund at least three of these projects.

Authorization to Execute Encroachment Agreement with Alta Irrigation District for Utility Crossings on the Kamm Avenue and Alta Avenue Roundabout (JW)
RECOMMENDATION
Council to approve a temporary Encroachment Agreement with Alta Irrigation District (AID) for various utility crossings in connection with Alta and Kamm Avenues Roundabout Project and authorize City Manager or designee to execute the agreement and any related documents.
EXECUTIVE SUMMARY
The City of Dinuba is proposing to enter into a temporary Encroachment Agreement with the Alta Irrigation District (AID) for the installation of various utilities in connection with Alta and Kamm Avenues Roundabout Project. The Agreement allows the City's contractor to continue with the installation of conduit for dry utilities across the AID irrigation right-of-way and avoid any further delays to the project. Once AID and PG&E finalize their respective Encroachment Agreement, the temporary Agreement will terminate.
OUTSTANDING ISSUES
None.
DISCUSSION
The City of Dinuba is currently constructing a roundabout at the intersection of Alta and Kamm Avenues. The contractor doing the work experienced some delays due to an encroachment issue between the Alta Irrigation District (AID) and PG&E. AID requires an encroachment agreement when an agency is proposing to install infrastructure or utilities across AID pipelines or ditches. The City's contractor was unable to complete all of the conduit installation for various utilities because PG&E does not have an encroachment agreement with AID. PG&E is currently working with AID on an encroachment agreement so that they can run dry utilities across AID rightof-way.
While AID and PG&E work on finalizing an encroachment agreement, the City is proposing to enter into a temporary Encroachment Agreement with AID so that the City's contractor can continue to work on the installation of conduit across AID rightof-way and avoid any further delays to the project. The AID Board approved the temporary Encroachment Agreement on June 13, 2024. The temporary Encroachment Agreement is for a 6-month period with an additional 6-month extension, giving AID and PG&E sufficient time to finalize their respective agreement. A copy of the temporary Encroachment Agreement is enclosed as Attachment 'A'.
The temporary Encroachment Agreement permits the City's contractor to install approximately 40 linear feet of PVC conduit and concrete transformer pad west of the Alta and Kamm Avenues. Under the terms of the Agreement, the work only includes the installation of necessary conduit, but excludes the installation of electrical wire until PG&E enters into a separate agreement with AID.
Executing the temporary Encroachment Agreement allows the City's contractor to complete installation of the conduit and begin work on all the surface level infrastructure. The contractor expects to complete the roundabout project by August 1 or sooner. The temporary Encroachment Agreement was reviewed by the City Attorney and found to be acceptable as to form.
FISCAL IMPACT
There is no fiscal impact upon authorizing and executing the encroachment agreement.

8. Rights Not Exclusive. The rights granted herein by the District are not exclusive and shall not in any way interfere with District’s use of the District Property. The District reserves the right to the full and beneficial use and enjoyment of the District Property for any and all District purposes. To maintain District facilities, Landowner shall construct, operate, or maintain the Encroachment in a manner that does not diminish or restrict the ability of the District to use District Property for any District purpose and Landowner shall have no right to encroach upon the District Property other than as expressly granted by the District pursuant to this Agreement.
Landowner shall have no right to increase the extent of the encroachment into the District Property as granted within this Agreement, without the express written authorization of the District.

After the initial six (6) months, the term of this Agreement is automatically extended for additional six (6) month term, unless at least fifteen (15) days prior to the end of the previous term either Party gives written notice of termination and terminates consistent with this Section.
The parties stipulate that this Agreement shall terminate immediately, upon receipt of written notice from the Landowner that provides: 1) the District has entered into an Encroachment Agreement with Pacific Gas and Electric Company (hereinafter referred to as “Utility”) for this Encroachment and Location, 2) Utility has secured an encroachment permit from District and any other required permits, and 3) Utility approves the construction and installation of the polyvinyl chloride pipes and transformer pad, and executes documents, to the satisfaction of Landowner evidencing that Utility assumes ownership and control of the polyvinyl chloride pipes and transformer pad, after construction and inspection thereof by Utility. Notwithstanding the above, District may terminate this Agreement upon the termination of use or abandonment of the Encroachment. Abandonment shall occur upon the non-use of the Encroachment for one (1) year. DISCUSSION
Effective July 1, 2024, most California employers are required to comply with Senate Bill 553. Senate Bill 553 requires employers to develop and implement a workplace violence prevention plan. This new legislation mandates the development and implementation of workplace violence prevention plans for most employers as part of their Cal/OSHA Injury and Illness Prevention Plan (IIPP). These prevention plans are critical for equipping employers with the knowledge and preparedness necessary to respond to potential incidents.
Senate Bill 553 is to prioritize the safety and well-being of workers. It is designated to establish a standardized framework for preventing workplace violence.
Most employers in California must establish, implement, and maintain a Workplace Violence Prevention Plan that includes:
Prohibiting employee retaliation
Accepting and responding to reports of workplace violence Employee workplace violence training and communication
Emergency response
Workplace violence hazard assessments
Other requirements, such as maintaining a Violent Incident Log The Workplace Violence Prevention Plan addresses workplace violence by raising awareness, improving reporting procedures and implementing protective measures.
Staff utilized the Central San Joaquin Valley Risk Mangement Authority (CSJVRMA) plan template for the Workplace Violence Prevention Plan and customized the plan for the City of Dinuba. The City's Workplace Violence Prevention Plan will be reviewed for effectiveness annually or when changes are needed with employee feedback.
Resolution No. 2024-54 is enclosed as Attachment 'A' which includes the City's Workplace Violence Prevention Plan.
