City Council Staff Report
Department: CITY MANAGER'S OFFICE August 12, 2025
To: Mayor and City Council
From: Chad Lew, City Attorney
By:

Subject: Ordinance No. 2025-02, Amending Chapters 6.28, 6.32, 6.50, 6.76, Title 6 (“ANIMALS”), Concerning the Regulation of Animals, Licensing and Permitting of Animals and Commercial Animal Establishments, Impounding of Animals, and the Sale or Transfer of Dogs (CML)
RECOMMENDATION:

Council to conduct a public hearing, waive first reading, and take the following action by one motion:

1. Hold the noticed public hearing and consider any public testimony; and

2. Approve and give first reading to Ordinance No. 2025-02, An Ordinance of the City Council of the City of Dinuba Amending Chapters 6.28, 6.32, 6.50, 6.76 of Title 6 (“Animals”), Concerning the Regulation of Animals, Licensing and Permitting of Animals and Commercial Animal Establishments, Impounding of Animals, and the Sale or Transfer of Dogs (by reading by title only and waiving further reading thereof).

EXECUTIVE SUMMARY:

The City Attorney’s office was tasked with reviewing and drafting proposed revisions to the City’s animal control regulations, specifically addressing updates to the City’s licensing, kennel, impounding, and sale requirements.

The proposed ordinance is aimed at controlling the stray animal population in the community, and reducing certain expenses that come with providing costly Animal Control services. A summary of Ordinance No. 2025-02 is provided for the City Council’s consideration for approval. If approved, the second reading and adoption of the Ordinance will be scheduled for the next regular City Council Meeting, with the Ordinance going into effect 30 days thereafter.

OUTSTANDING ISSUES:

Page 548 of 601 ends

None
DISCUSSION:

The following is a summary of the proposed changes to the City’s regulations.

Clarifications were made to the regulation limiting the number of dogs (4) that can be kept by individuals, and the limited exceptions permitting that number to be exceeded.

For example, the current regulations contained an outdated reference allowing more than 4 dogs, if dogs that had been in the City since 1984. The proposed revision eliminates that exception.

With regard to licensing, a microchip requirement is proposed in addition to the license tags that are already required. The draft also authorizes separate licensing fees (set by resolution) for spayed/neutered and animals that are not spayed/neutered, and allows the licenses to be transferred upon transfer of ownership.

As a requirement of the City’s contract with the City of Visalia for animal sheltering services, the proposed ordinance requires compliance with the impounding facility/animal shelter’s requirements, including but not limited to Visalia’s spaying/neutering requirements as a condition of an impounded animal’s release.

With regard to commercial animal establishments, this ordinance clarifies that business licenses and other specific permits (such as a kennel or breeders permit) from the City are required, with the permits placing certain conditions on the sale or transfer of animals, including the conditions and restrictions on sale of such animals in a public place. With regard to these particular conditions and restrictions, there are exemptions for other governmental agencies, nonprofit animal rescue organizations, humane societies, permitted dog shows, and pet stores. The full text of the proposed changes is attached herein as 'Attachment A.' City Council Staff Report
Department: ENGINEERING August 12, 2025
To: Mayor and City Council
From: Watts Jason, City Engineer
By: Watts Jason, City Engineer
Subject: Authorization to Purchase Amenities for Entertainment Plaza Renovation Project (JW)
RECOMMENDATION:

Council to authorize the Parks & Community Services Director to purchase amenities for the Entertainment Plaza Renovation Project.

EXECUTIVE SUMMARY:

The City received a $2.9 million grant through the Clean California program to support the renovation of Entertainment Plaza Park in downtown Dinuba. To ensure the timely delivery of playground equipment and other site amenities, staff is requesting authorization to proceed with the early procurement of a select group of items. This will help ensure all materials are available and ready for installation during the park’s construction phase.

This staff report includes only a portion of the items proposed for early purchase. The remaining items will be brought forward for City Council consideration at the next scheduled Council meeting.

OUTSTANDING ISSUES:

None
DISCUSSION:

The City of Dinuba was awarded a $2.9 million grant through the Clean California Local Grant Program, administered by Caltrans. This highly competitive, statewide initiative is designed to transform public spaces by reducing litter, upgrading public infrastructure, promoting community engagement, and fostering safer, more accessible environments—particularly in underserved and disadvantaged communities. The funds awarded to Dinuba will support a comprehensive renovation of Entertainment Plaza

Page 560 of 601 ends

Park, a centrally located and heavily utilized public space in the heart of downtown.

The planned improvements are aimed at revitalizing the plaza to better serve community events and gatherings, while creating a more welcoming, inclusive, and functional environment for residents and visitors. Enhancements will include the addition of shade structures, public art, site furnishings, drought-tolerant landscaping, and other key features that align with the goals of the Clean California program.

To ensure the project stays on schedule and to mitigate the risk of delays related to material procurement, staff is requesting City Council authorization to move forward with the early purchase of select site amenities. These early purchases are necessary due to long lead times commonly associated with specialty materials and equipment.

By acquiring these items in advance, the City can ensure all materials are available for installation when the construction phase begins.

It is important to note that this staff report includes only a portion of the proposed items for early procurement. The remaining materials will be brought to the City Council at the next regularly scheduled meeting for further consideration and approval.

All purchases will be conducted in accordance with the City’s adopted procurement policy, as outlined in Resolution No. 2023-03, and will comply with the applicable state and grant agency regulations governing the use of awarded funds. For reference, the City’s purchasing policy is attached as Attachment 'A', along with a summary table of purchasing thresholds below:

Portfolio and Managed Investments
The City invests with the Local Agency Investment Fund (LAIF). LAIF is a pooled investment fund established by the state to provide cities with safe investment option that is administered by the State of California Treasurer’s Office. Interest rates in LAIF lag behind the current economic trends; as such, earnings or returns are typically lower than other investment vehicles. At the end of the Fourth quarter, the interest rate for LAIF was at 4.48%.

The City also invests in Mechanics Bank’s Public Investment Money Market Account (PIMMA). At the end of June, the PIMMA interest rate was at 4.58%.

Investments with the Tulare County Investment Pool began on November 7, 2022. The Tulare County Treasury Pool objectives align with those of the city by making the primary objective to provide safety of principal, and secondly, to provide adequate liquidity to meet all requirements which might be reasonably anticipated; and lastly to earn a rate of return that is commensurate with the first two objectives. The Tulare County Pool interest rate at the end of the fourth quarter was 3.735%.

The city began investing in the California Asset Management Program (CAMP) Joint Powers Authority (JPA) in January 2023. CAMP’s Trust’s Cash Reserve Portfolio (Pool) is a short-term portfolio which seeks to preserve principal, provide daily liquidity and earn a high level of income. The Pool is a long-established short-term investment alternative for California public agencies. At the end of June, the interest rate for CAMP was at 4.40%.

In summary, the city’s interest earnings on cash investments through the fourth quarter of fiscal year totaled $2,694,335.

The City’s Cash and Investment Summary is enclosed as Attachment ‘A’.

The most recent Federal Reserve meeting was held a couple of weeks ago on July 30, 2025. As anticipated, the Committee voted to maintain the benchmark federal funds rate at 4.25% to 4.5% for the fifth consecutive meeting. Chair Jerome Powell reiterated the Fed’s cautious stance, emphasizing that while inflation remains elevated (rising to

2.7% in June) the uncertainty surrounding the impact of tariffs continues to influence policy decisions.

Page 588 of 601 ends

The tone of the meeting and Chair Powell’s press conference indicate to analysts that there are still rate cuts on the horizon, possibly as soon as September 2025. In the meantime, City staff will begin to invest in longer-term vehicles with the assistance of Meeder Public Funds. Together, city staff and Meeder will monitor the federal fund rate and investment returns to ensure the best outcome for the City’s investments.

FISCAL IMPACT:

The City’s monetary resources are organized and accounted for on a fund basis with some of those funds being restricted for specified uses and others that are unrestricted.

For investment purposes, all funds are invested as a pool.

The investment report for the period ending June 30, 2025 shows a combined pool balance of $69,899,495 of which, $2,694,335 was the combined pool interest earnings.

The combined pooled interest earnings of $2,694,335 are broken down as follows:

LAIF - Local Agency Investment Fund $225,440
PIMMA - Public Investment Money Market
Account
$883,352
CAMP - California Asset Management

Department: PUBLIC WORKS August 12, 2025
To: Mayor and City Council
From: George Avila, Public Works Director
By: Elva Patino, Business Manager
Subject: Resolution 2025-45 Designating Commercial Truck Parking Locations (GA)
RECOMMENDATION:

Council confirm designated commercial truck parking locations.

EXECUTIVE SUMMARY:

Pursuant to the Dinuba Municipal Code, the City Council holds the authority to designate truck parking locations through the adoption of a resolution. Exercising this authority, staff recommends ongoing efforts to identify and formally designate suitable truck parking areas. This will help maintain orderly truck parking throughout the city.

OUTSTANDING ISSUES:

None
DISCUSSION:

The establishment of designated truck parking locations within the City of Dinuba is essential to promote public safety, preserve infrastructure, and maintain the quality of life in residential areas. Clearly defined truck parking areas help minimize roadway damage, and reduce traffic and safety hazards. These designated areas also support local economic activity by meeting the needs of commercial transportation while facilitating zoning enforcement and preserving community esthetics. In addition, they assist in mitigating the noise, emissions, and visual impacts commonly associated with heavy truck traffic.

Pursuant to Section 10.32.080 of the Dinuba Municipal Code, the City Council has the authority to designate truck parking locations by adopting a resolution. In light of this authority, staff recommends the continued identification and formal designation of appropriate truck parking areas to ensure an orderly, compliant, and safe parking environment citywide. Included herein for Council consideration are Resolution No.

Page 591 of 601 ends

2025-45 as Attachment 'A' and the corresponding truck parking map as Attachment 'B'.

These locations were approved by the City Council on October 9, 2007, with Resolution No. 2007-88, and are identified as follows:
• Sierra Way, from Monte Vista Avenue, heading west approximately 1,800 feet • Monte Vista Avenue (west side), approximately 1,900 feet north of Sierra Way • Monte Vista Avenue (east side), approximately 700 feet south of Surabian Drive • Samantha Way from Sierra Way to Surabian Drive
• Surabian Drive, approximately 1,800 feet east of Monte Vista Avenue • Uruapan Drive, 400 feet south of Merced Street
• M Street at Fresno Street, on the west side
These locations remain appropriate for truck parking, and it is not recommended that they be modified at this time. However, East Davis Drive (approximately 500 feet east of Crawford Avenue) has been utilized informally as a truck parking area in addition to the locations listed above. Staff is seeking Council direction regarding the continued use of East Davis Drive as a truck parking location. Council may choose to either:

1. Formalize East Davis Drive as a designated truck parking location through Council action, or

2. Discontinue the use of this location for truck parking.

If Council directs staff to remove East Davis Drive from use as a truck parking area, staff recommends providing a 90-day notice period to current users in order to allow time for relocation to officially designated areas.

FISCAL IMPACT:

None.
