6. If LOCAL AGENCY determines that employees of a Subconsultant were not paid the general prevailing rate of per diem wages and if LOCAL AGENCY did not retain sufficient money under the AGREEMENT to pay those employees the balance of wages owed under the general prevailing rate of per diem wages, the CONSULTANT shall withhold an amount of moneys due the Subconsultant sufficient to pay those employees the general prevailing rate of per diem wages if requested by LOCAL AGENCY.

City Council Staff Report
Department: PUBLIC WORKS May 26, 2026
To: Mayor and City Council
From: George Avila, Public Works Director
By: Santillan Anna, Fiscal Analyst I
Subject: Resolution No. 2026-32 Authorization to Execute a Measure R Program Supplement Agreement for the 2026 Corridor Improvements Project (GA) RECOMMENDATION:
Council to approve Resolution No. 2026-32 authorizing the City Manager or his designee to execute a Measure R Program Supplement for the 2026 Corridor Improvements Project in the amount of $4 million.
EXECUTIVE SUMMARY:
The city has identified several major street corridors that are in need of pavement rehabilitation and traffic operation improvements along El Monte Way and Nebraska Ave. Staff is working with the Tulare County Association of Governments (TCAG) to fund these corridor improvements with Measure R Funds totaling $4 million. In order to access these funds, TCAG is requested that the City Council adopt Resolution No. 2026-32 authorizing the execution of a Measure R Program Supplement.
OUTSTANDING ISSUES:
None.
DISCUSSION:
On January 27, 2026, staff presented to the City Council a list of street projects that were identified as in need of major repair or rehabilitation to improve safety, connectivity, and extend the life cycle of the City's roadways. Based on the evaluation of these projects along with Council feedback, staff is recommending that W. El Monte Way from Alta Avenue to Englehart and Nebraska Avenue from Euclid to Crawford Avenue be included in the 2026/27 Corridor Improvement Projects. Both of these roadways carry a significant amount of traffic and improvements to these segments will extend the life of the pavement as well as enhance safety for motorists and pedestrians.
W. El Monte Way
W. El Monte Way is designated as an arterial in the City's Circulation Element. An arterial street is a high-capacity urban road designed to move large volumes of traffic between different areas of the city or region. W. El Monte Way not only provides mobility for residents of Dinuba but serves as a regional route with direct connections to Highway 99 to the west and State Route 65 to the east. W. El Monte Way was widened in the mid 2015's to include four travel lanes and a dedicated center left turn lane to accommodate increased traffic.
The segment from Alta to Englehart has shown some wear and is in need of rehabilitation and safety enhancements for motorists and pedestrians, particularly as there is major retial and commercial development along the south side of the roadway, creating multiple traffic movements. The scope of improvements includes grind and overlay of this section, striping, installation of raised medians with irrigation and landscaping, and high-visibility pedestrian crossings. The rehabilitation of the pavement will extend the life cycle of the roadway and the landscaped medians will transform the aesthetics.
Nebraska Avenue
Nebraska Avenue is designated as a collector street in the City's Circulation Element. A collector is a low-to-moderate capacity road that "collects" traffic from neighborhood streets and channels it toward broader thoroughfares (i.e., arterial streets).
Nebraska serves as the main collector for many of the residential neighborhoods on the south side of the roadway as well as a connection to unincorporated communities to the east. Although a portion of Nebraska Avenue was recently reconstructed from Englehart to Euclid, the segment from Euclid to the Roundabout is in poor shape, narrow, and the existing culvert needs to be replaced. The improvements on this segment include widening the roadway, new pavement, and installation of a new culvert over the canal. The section between Oak Street and Crawford Avenue is in need of rehabilitation. Improvements to this section include new pavement and the addition of a road shoulder to widen the outer lane on the north side. This shoulder will add a structural foundation for the roadway to provide lateral support to the asphalt, preventing the edges of the main road from crumbling and breaking away under heavy traffic and to facilitate proper water drainage away from driving lanes.
Measure R
The voters of Tulare County passed Measure R in 2006, a half-cent sales tax dedicated to improving transportation throughout the County. These funds have provided a critical source of revenue to the City of Dinuba for road repairs, rehabilitation and maintenance. The adopted Measure R Expenditure Plan allocates funds for local programs allocated to cities for street rehabilitation and maintenance. A total of $4 million is currently allocated to the City of Dinuba.
Staff anticipates using this allocation for the 2026 Corridor Improvements Projects that includes W. El Monte Way and Nebraska Avenue. In order to gain access to the funds, the City must execute a project-specific Measure R program supplement. It is requested that the City Council consider adopting resolution No. 2026-32 enclosed herein as Attachment '1', and thereby authorize the execution of the required Measure R Program Supplement in the amount of $4 million. The approval of the program supplement allows the 2026 Corridor Project to move forward with estimated construction set for summer 2027.
FISCAL IMPACT:
The total budget for the full scope of improvements is $4 million, which will be funded through the City’s Measure R regional projects allocation.

By: Elva Patino, Business Manager
Subject: Authorization to Award Professional Services Agreement to Black Water Consulting Engineers for the Sewer Master Plan and Sewer Management Plan Update (GA)
RECOMMENDATION:
It is recommended that the City Council by one motion:
1. Approve the selection of Black Water Consulting Engineers to complete the City’s Sewer Master Plan and Sewer System Management Plan (SSMP) Update; and,
2. Authorize the City Manager or the Public Works Director to negotiate and execute a Professional Services Agreement with Black Water Consulting Engineers for an amount not to exceed $308,999.
EXECUTIVE SUMMARY:
The City of Dinuba issued a Request for Proposals (RFP) on February 12, 2026 for preparation of a Sewer Master Plan and Sewer System Management Plan (SSMP) Update to evaluate the City’s wastewater collection system, identify current and future infrastructure needs, and develop a prioritized Capital Improvement Program. Following the proposal review, the selection committee recommends Black Water Consulting Engineers be awarded the subject contract for an amount not to exceed $308,999.
OUTSTANDING ISSUES:
None
DISCUSSION:
The City’s existing Sewer Master Plan was completed in 2010 and requires updating to reflect current infrastructure conditions, growth projections, regulatory requirements, and operational needs. The updated Sewer Master Plan will serve as a long-range planning document to guide future sewer infrastructure improvements, identify system deficiencies, and establish a prioritized Capital Improvement Program (CIP). In addition, the City intends to update its Sewer System Management Plan (SSMP) to comply with State Water Resources Control Board regulations.
On March 26, 2026, the City received three (3) proposals for the subject professional services:
• Black Water Consulting Engineers
• 4Creeks, Inc.
• Akel Engineering Group
A selection committee evaluated proposals based on the criteria outlined in the RFP.
Following review of the written proposals, the selection committee determined that Black Water Consulting Engineers provided the proposal and project approach that best aligns with the City’s needs. Black Water’s proposal demonstrated a comprehensive approach supported by detailed tasks related to flow monitoring, hydraulic modeling, CCTV review and condition assessment, capacity analysis and Capital Improvement Program development. Black Water Consulting Engineers has demonstrated experience working with similarly sized Central Valley agencies and wastewater systems comparable to Dinuba. Staff determined that this experience is highly relevant to the City’s existing infrastructure, operational challenges, and future growth planning needs.
Following discussions with staff regarding project scope and available grant funding, Black Water agreed to work with the City and submitted their best and final offer that was within budget parameters. Given their expertise and willingness to work with the City's available budget, it is recommended that the City Council authorize the City Manager to execute a Professional Services Agreement with Black Water Consulting Engineers for the completion of the Sewer Master Plan and the Sewer Sytem Management Plan Updte for an amount not to exceed $308,999.
FISCAL IMPACT:
The Sewer Master Plan and Sewer System Management Plan Update will be funded by the Community Development Block Grant (CDBG) and Local funds.
The negotiated project budget is anticipated to include:
• Sewer Master Plan: $290,200
• Sewer System Management Plan Update: $18,799
Total anticipated project cost: $308,999.

Subject: Ordinance No. 2026-09 – Second reading and Adoption to change the zoning for the Hernandez site (42778 N. Alta) (KSch))
RECOMMENDATION:
Council to conduct the second reading, waive reading in full, and adopt Ordinance 2026-09 (Attachment "A") pertaining to an amendment of the zoning on a 0.12± acre parcel on the east side of N. Alta Avenue between Griggs Avenue and Union Avenue.
EXECUTIVE SUMMARY:
The action would result in an amendment to the zoning of a single parcel on the east side of N. Alta Avenue (between Griggs Avenue and Union Avenue) to facilitate a resumption of commercial use of the site.
OUTSTANDING ISSUES:
None.
DISCUSSION:
On May 12, 2026, the City Council conducted a first reading of Ordinance No. 2026-09 to amend the zoning of a 0.12± acre parcel (located on the east side of Alta Avenue, between Griggs Avenue and Union Avenue - see Attachment "B").
This site was annexed into the City in 2007 and at that time was zoned “R-1-7.5” (Single Family Residential), but had been used for commercial purposes before (and since) being annexed. Commercial use on a residentially-zoned parcel (in this case) is considered to be a legal, non-conforming use.
However, no commercial activity has been conducted for the past few years. Recently, the property owner came to the City to request a business license to start a new commercial use but was informed that commercial use is not permitted under the residential zoning of the site, and that a zone change would be needed to allow commercial activities. The property owner then elected to submit an application to
rezone the site to the “C-4” (General Commercial) zone (this also triggered a General Plan land use amendment).
Staff and the Planning Commission recommended in favor of the zone change for several reasons, including that the site has been used commercially for many years in the past, and also that the site is adjacent to a major roadway and is not optimal for residential use. In addition, there is commercial and industrial zoning to the north and the west.
The City Council conducted the first reading and public hearing for Ordinance No. 2026-09 on May 12, 2026. Staff recommends City Council conduct the second reading, waive the reading in full and adopt the Ordinance, which will take effect 30 days after it is adopted.
FISCAL IMPACT:

Subject: Resolution No. 2026-33 Renewal of Delegation of Investment Authority to Meeder Public Funds (KS)
RECOMMENDATION:
Council to adopt Resolution No. 2026-33 renewing the delegation of investment authority to Meeder Public Funds for a one-year term pursuant to California Government Code Section 53607.
EXECUTIVE SUMMARY:
California Government Code Section 53607 permits local agencies to delegate investment authority to an external investment manager for up to one year. The current delegation to Meeder Public Funds is expiring and requires annual renewal by the City Council. Staff recommends renewing the delegation for an additional one-year term, as Meeder Public Funds has continued to manage the City’s investment portfolio in compliance with the City’s Investment Policy and applicable state law.
OUTSTANDING ISSUES:
None.
DISCUSSION:
The City maintains surplus funds that are not required for immediate operational needs and invests those funds in accordance with the objectives of safety, liquidity, and yield.
California Government Code Sections 53600 through 53609 govern the investment of local agency funds and authorize the annual delegation of investment authority to qualified external investment managers.
Pursuant to California Government Code Section 53607, the City Council may delegate investment authority for a one-year period, subject to ongoing oversight and reporting
requirements. The City previously delegated discretionary investment authority to Meeder Public Funds to assist with professional management of the City’s investment portfolio.
The existing investment management agreement with Meeder Public Funds remains in effect pursuant to its automatic renewal provisions. The proposed action is limited to the annual renewal of the City Council’s delegation of investment authority as required under California Government Code Section 53607.
Under the proposed renewal, Meeder Public Funds will continue to manage investments in compliance with:
• California Government Code Sections 53600–53609;
• The City’s adopted Investment Policy; and
• The terms and conditions of the investment management agreement.
The Administrative Services Director will continue to oversee the relationship with Meeder Public Funds and provide regular investment reports to the City Council. These reports include portfolio holdings, market values, investment performance, and confirmation of compliance with applicable investment regulations and policies.
Staff has reviewed the current arrangement and determined that renewing the delegation of investment authority continues to support prudent financial management practices and professional oversight of the City’s investment portfolio.

Staff is proposing to purchase (2) Shuttle 2+2 Personnel Transport Vehicles, (2) Hauler XL Longbed Utility Vehicles, and (1) Hauler Pro Utility Vehicle for a total of $95,132.26.
Quotes were solicited from California Turf Equipment & Supply, Inc. (see Attachment 'B').
Should grant funds be awarded, the City must purchase the vehicles and submit them for full reimbursement through the SJVAPCD.
FISCAL IMPACT:
The City will purchase the vehicles from the general fund and submit for full reimbursement through the SJVAPCD.

City Council Staff Report
Department: CITY MANAGER'S OFFICE May 26, 2026
To: Mayor and City Council
From: Maria Alaniz, City Clerk/HR Director
By:
Subject: City Vacancies Report Pursuant to Assembly Bill 2561 (MA) RECOMMENDATION:
Council to conduct a public hearing on position vacancies pursuant to Assembly Bill 2561.
EXECUTIVE SUMMARY:
Assembly Bill ("AB") went into effect on January 1, 2025, requiring public agencies to hold a public hearing to address the status of job vacancies and recruitment and retention efforts prior to the adoption of the agency's annual budget.
OUTSTANDING ISSUES:
None
DISCUSSION:
The intent of AB 2561 is to address the issue of job vacancies in local government, which can adversely impact the delivery of public services, may lead to heavier employee workload, and may also lead to increased employee turnover.
Pursuant to AB 2561, the City is required to do the following:
1. Public Hearing: At least once each fiscal year, at a public hearing before the governing body, the City shall present information regarding the status of vacancies and recruitment and retention efforts and identify any necessary changes to policies, procedures and recruitment activity that may lead to obstacles in the hiring process.
2. Employee Organizations: Allow the recognized employee organizations within the City to make presentation during the public hearing concerning vacancies and recruitment and retention efforts. There are three represented bargaining units at the City and all have been notified of the public hearing and advised of their right to address the Council on the matter.
3. Additional Reporting for High Vacancy Rates: If vacancies within a single bargaining unit meet or exceed 20 percent of authorized full-time positions in that bargaining unit, the City must provide additional information during the public hearing, including the following: (1) the total number of vacancies; (2) the number of applicants; (3) the average time to fill positions; and (4) opportunities to improve compensation and working conditions for employees in the bargaining unit.
The following table summarizes the City's vacancy rate by employee group as of May 1, 2026:
Employee Group Budgeted Vacancies Vacancy Rate
Employees' Association 57 1 1.7%
Firefighters' Association 33 5 15.2%
Police Officers' Association 41 0 0%
Mid-Managers/Confidential 14 0 0%
Department Directors 7 0 0%
City Overall 152 6 3.9%
There are no bargaining groups that have a vacancy rate that exceeds 20 percent (20%) of authorized full-time positions in that bargaining unit.
This report and Public Hearing fulfill the requirements of AB 2561. The City of Dinuba will continue to monitor staffing trends and address recruitment challenges.
FISCAL IMPACT:
None.
PUBLIC HEARING:
A notice of the Public Hearing was published in the May 14, 2026 publication of the Mid Valley Times.

City Council Staff Report
Department: PLANNING May 26, 2026
To: Mayor and City Council
From: Stephanie Hurtado, Park & Community Svs Director
By: Schoettler Karl, City Planner
Subject: Amendment to Dinuba Municipal Code Subsection 9.48.050 Concerning Park Operating Hours.(SH)
RECOMMENDATION:
Council to conduct a public hearing introducing and conducting the first reading, waive reading in full, of Ordinance No. 2026-10 to approve an amendment to the Dinuba Municipal Code concerning park closing hours.
EXECUTIVE SUMMARY:
Public Hearing to consider an amendment to the Dinuba Municipal Code concerning operating hours for KC Vista and Rose Ann Vuich Parks. KC Vista Park has several new amenities, including a walking trail, basketball and pickle ball courts that encourage active recreation well into the evening hours. Staff recommends to extend hours at KC Vista Park to 11:00pm during the warmer months (May through September), when the weather is cooler in the evening. Rose Ann Vuich Park hosts several city-sanctioned events that provide entertainment, food, and carnival rides through 10:00pm. Staff recommends extending the hours at this park to 11:00pm during city-sanctioned community events provides additional time for residents to enjoy the festivities.
OUTSTANDING ISSUES:
None.
DISCUSSION:
Dinuba Municipal Code Section 9.48.050 establishes regulations for the opening and closing times for parks within the City. The purpose is to ensure that no activity is occurring within public parks during overnight hours, while allowing use during daytime and evening hours. As currently written, all parks are required to be closed by 10:30 pm, with reopening at 6:00 am.
Recently concern has been expressed that at least one park should be open later during warm months to allow for recreational activities (when the weather is cooler in the evening). With this
goal in mind, staff recommends Council consider amending the park hours to reflect a closing time of 11:00 for KC Vista Park. This would only be permitted during warmer months (from the beginning of May through the end of September).
In addition, various City events and large community events such as Raisin Day and Cinco de Mayo have occasionally run past the current park hours of 10:30 pm at Rose Ann Vuich Park. In order for event guests to have time to enjoy their food purchases and remaining ride tickets, staff recommends that a closing time of 11:00 pm be established for this park. These extended hours would only apply to City-sponsored and cosponsored events. It should also be noted that the extended park hours do not apply to live music and the noise regulations outlined in Section
9.54.040 (Exterior noise limits) of the Dinuba Municipal Code still apply in cases where park hours are extended.
If approved, the closing time extension for KC Vista Park and Rose Ann Vuich Park will go into effect thirty days after the second reading of the ordinance.
FISCAL IMPACT:
None.
PUBLIC HEARING:

DINUBA CITY COUNCIL
ORDINANCE NO. 2026-10
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DINUBA AMENDING THE TEXT OF THE MUNICIPAL CODE
CONCERNING THE CLOSING TIME FOR PUBLIC PARKS
THE CITY COUNCIL OF THE CITY OF DINUBA HEREBY DOES
ORDAIN:
SECTION 1: FINDINGS,
(a) The City of Dinuba administers a municipal code that includes regulations for the operation of public parks.
(b) Specifically, Subsection 9.48.050 establishes a closing time of 10:30 pm for all public parks in Dinuba. The purpose of this regulation is to ensure that no activity is occurring within public parks during overnight hours, while allowing use during daytime and evening hours.
(c) It has been expressed that extending operating hours to 11:00 pm at KC Vista Park will allow continued use of this park during warmer months of the year. (d) It has also been determined that City-sanctioned events at Rose Ann Vuich Park have been hampered by the existing closing time requirements and that extending closing time to 11:00 pm will resolve this issue.
SECTION 2. Amendments were made to Chapter 9.48.050 (Hours of operation) of Chapter 9.48 (Public Parks) of Title 9 (Public Peace, Safety and Morals) and are shown in Attachment “A” of this Ordinance. Text additions are shown in underline format. Text deletions are shown in strikeout format.
SECTION 3. SEVERABILITY.
Each of the provisions of this ordinance is severable from all other provisions. If any article, section, subsection, paragraph, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.
SECTION 4. The City Clerk is hereby directed to cause a summary of this Ordinance to be published by one insertion in a newspaper of general circulation in the community at least five (5) days prior to adoption and again fifteen (15) days after its adoption. If a summary of the ordinance is published, then the City Clerk shall cause a certified copy of the full text of the proposed ordinance to be posted in the office of the City Clerk at least five days prior to the Council meeting at which the ordinance is adopted and again after the meeting at which the ordinance is adopted.
The summary shall be approved by the City Attorney.
