Re: Item D-7, Consider Extending the Farm Lease with Frank Cardoza Frank Cardoza has been in a lease with the City to farm our property at the Wastewater Facility since 2019. The lease has expired and there is no clear method or process for us to choose someone to farm our property.

Staff recommends approval of the extended lease until December 31, 2025 and recommends the City Council create a process for choosing interested parties to lease our properties.

MEMO
Date: March 13, 2025 Project No.: 250013/
To: Dwayne Jones, City Manager
From: Garth A. Pecchenino, PE, PLS
Subject: City Project Status
The following will provide a brief report on the status of various projects and items being addressed by QK staff or working with City Staff to provide assistance for the last month.

Water Plant replacement project:

The progression of work since the last Council meeting is as follows:

The Operations Building: The Operations Building is the main focus at the site with the assembly of the steel frame for the building, placing the metal siding and roof panels.

The Chemical Feed/Storage building has its foundation poured and the contractor is working on the placement of the tanks and equipment.

The first treatment unit was delivered and set in place, with the delivery of the second unit the contractor can start to frame out that portion of the building.

Above ground pipe assembly is going on for the piping related to the water treatment.

Phase 2 Construction - Siphon pipe replacement at Aqueduct; We address the comments from the DWR response letter and have submitted the package back to them for review, we are waiting on their response.

The continuation of submittal review and approval.

East Blossom Street - We have a scope of services backdown for the stages of the project to develop the Construction Documents, bidding/award of the project, and construction phase. When we estimated the project for the funding request the Professional fees for design, bidding, construction observation, construction staking and construction testing was estimated at $650,000. The revised approach has this number reduced to $550,000. Construction Documents (field survey, improvement plans, specifications), Bidding, Award, Contracts - $247,500; Construction Testing - $40,000; Construction Staking - $50,000; Construction Management/Observation - $167,500.

Under the On-call agreement QK only charges for the hours applied to the project and the hourly rates are at the 2017 rate schedule.

Also, asking for Council to approve placing this project out for Public Bid so we can work to achieve a construction start after the High School is out for the summer, mid-June.

Q
MEMO PAGE 2 OF 2
CV Salts - Nitrate Control Program - Wastewater Plants and other discharges in the Central Valley have a new compliance order from the State Water Board to manage the output of Slats and Nitrate.

There are two approaches to meet this compliance Order, 1.) to develop a plan and monitoring approach to obtain a discharge permit for your facility 2.) join a group and be part of a regional approach to address the concerns of the Water Board Order.

The second approach is joining a Management Zone, where you work collectively to comply with the Nitrate Control Program, this approach is more economical. I have attended a meeting for the group in the area and they have established a budget and are working on the distribution of the annual fee. The group includes: Irrigated Agricultural (65%), Dairy (6%), Municipality (14.5%), Poultry (0,5%) and Wine/Food Processors (14%). In the Merced area Management Zone this group has split the fee amount based on the volume of the allowable discharge, so the larger discharges pay a larger portion of the fee amount to the industry sector. The also are reaching out to get all those permitted dischargers signed up to the group, as many have not notified the Water Board on their intent. Will update Council as things progress.

Have completed the filing for the Drought & Water Conservation data upload to the State Water Board Portal SAFER for last month.

Any changes or updates will be provided at the meeting. GAP 2816 Park Avenue 4 Merced, California 95348 • Tel (209) 723-2066 • Fax (559) 733-7821 www.qkinc.com
