(5) "Responsible bidder," is one who is able to perform the contract if awarded. To be considered responsible, the bidder must

(6) "Responsive Bid" means the bid conforms to the material terms of the bid package and promises to do what the bid instructions require.
(b) The dollar amount thresholds provided in this chapter shall automatically adjust to the dollar amount thresholds provided under Public Contract Code section 22032 upon the effectiveness of any adjustment notification by the State Controller in accordance with Public Contract Code section 22020, without the necessity of amending this chapter or any section or subsection herein to reflect any such adjustment.
1. Public projects of seventy-five thousand dollars ($75,000.00) or less may be performed by city employees by force account, by negotiated contract, or by purchase order. Notwithstanding any provision in the Dos Palos Municipal Code to the contrary, and provided the expenditure is within the budget limitation, the city manager is authorized to approve the use of city employees for public projects, and may approve and sign any contract or purchase order for public projects not exceeding seventy-five thousand dollars ($75,000.00).

information about the project, and state the time and place for the submission of bids. The notice shall be mailed, faxed, or emailed, not less than ten (10) calendar days before bids are due, to all contractors on the contractors list 4 for the category of work to be bid. The City may elect to send the notice to all construction Trade Journals as
specified by the California Uniform Construction Cost
Accounting Commission in accordance with section 22036 of the Public Contract Code. Additional contractors and/or construction trade journals may be notified at the discretion of the department soliciting bids, provided, however:
i. If there is no contractors list maintained by the city for the particular category of work to be performed, the
notice shall be sent to the construction Trade Journals specified by the California Uniform Construction Cost
Accounting Commission.

or contractors, the notice may be sent exclusively to

4. In cases of emergency when repair or replacements are necessary, replacement or repairs may proceed at once on any public facility without adopting plans, specifications, strain sheets, or working details, or giving notice for bids to let contracts. The work may be done by city employees, by contractor, or by a combination of the two. In case of an emergency, if notice for bids to let contracts will lot be given, the city shall comply with Public Contract Code Chapter 2.5 (commencing with Section 22050)
(c) A list of qualified contractors shall be developed and maintained in accordance with the provisions of section 22034 of the Public Contract 5 Code and criteria promulgated from time to time by the California Uniform Construction Cost Accounting Commission. (d) Determination that a bidder is not responsible entitles the bidder to a hearing, if requested, before the contract may be awarded to the next lowest bidder.
1. The City must notify the bidder that they are entitled to a hearing and inform the bidder of the evidence against him/her.
2. The City must give the bidder the opportunity to present evidence that he/she is responsible before the City rejects the bid.
3. Such hearing may be requested by the bidder upon filing with the city clerk, within ten (10) days after notice of the "not responsible determination, a written statement setting forth the grounds for the hearing request. The city clerk shall transmit the written statement to the city council and at its next regular meeting the council shall set a time and place for a hearing on the appeal. Notice of the time and place of such hearing shall be mailed to the bidder. The decision of the city council on such appeal shall be final and binding on all parties concerned.
(e) Prevailing Wages: Contracts for city-funded public works projects shall require payment of prevailing wages in accordance with the requirements of the California Labor Code.
(1) Notwithstanding anything to the contrary, nothing in this section shall prohibit the city from identifying and/or utilizing other lawful methods for awarding contracts for public projects should it be determined that such other methods are in the best interest of the city."

If any article, section, sub-section, sentence, clause, or phrase of this Ordinance is held by a court of competent jurisdiction to be invalid, such decision shall not affect the remaining portions of this Ordinance.
