(2) The distribution system shall include the network of conduits used for the delivery of water from the source to the system.

13.09.030 Responsibility.

The City will be responsible for the protection of the potable water distribution system from contamination or pollution due to the backflow of contaminants or pollutants, through implementation and enforcement of the cross-connection control program. An appropriate backflow prevention and assembly will be installed by and at the expense of the water user at each connection where required to prevent backflow from the water user's premises to the domestic water system. A Cross Connection Specialist will be employed by or contracted with the City Water System to carry out the Cross Connec- tion program.
6 13.09.040 Backflow Prevention Assemblies.
(a) No water service connection to any premises will be installed or main- tained by the Water Supplier unless the water supply is protected as required by law and this Ordinance. Service of water to any premises will be discontinued by the Water Supplier if a backflow prevention assembly required by these regulations is not installed, tested and maintained in good working condition by the water user, or if it is found that a backflow prevention assembly is not in use where required. Service will not be restored until such conditions or defects are corrected. All backflow assemblies will be tested when first installed, when repairs are made (using original manufacturers parts or repair kits), when assembly is relocated, upon depressurization for winterizing and annually by a certified American Water Works Association ("AWWA*) or American Backflow Preven- tion Association ("ABPA") tester with results of testing, repairs and parts given to the water supplier or designated parties having authority for the Cross-Connection program. (b) The Cross Connection Specialist will notify the user reasonably in ad- vance of scheduled testing. If such testing reveals an unprotected cross-connections or other structural or sanitary hazards, including violations of this chapter, the City may deny or discontinue service until such conditions are brought into compliance. (c) When the Cross Connection Specialist encounters waters that represent an immediate hazard to the potable water supply that cannot be immediately abated, the procedure for terminating water service will be instituted. Water service termination will include but is not limited to:
(1) Refusal to install or to test a backflow prevention assembly, or to repair or replace a failing backflow prevention assembly. (2) Direct or indirect connection between the public water system and a wastewater line or system.
(3) Unprotected direct or indirect connection between the public water system and a system or equipment containing contaminants or pol- lutants.
(4) Unprotected direct or indirect connection between the public water system and an auxiliary water system.

An approved backflow prevention assembly shall also be installed on each service line to a building, or a plumbing appliance/fixture being served. However, in in- stances where the following conditions exist, additional preventative measures may be (1) In the case of premises having an auxiliary water supply which is not, or may not be, of safe bacteriological or chemical quality and which is not acceptable as an additional source by the Water 7 Commissioner or Health Officer, the water system shall be protect- ed against backflow from the premises. To provide this protection, an approved backflow prevention assembly must be installed on the service line commensurate with the degree of hazard. (2) In the case of premises on which any industrial fluids or any other objectionable substance is handled in any way that creates an ac- tual or potential hazard to the water system, the water system shall be protected against backflow from the premises. To provide this protection an approved backflow prevention assembly must be in- stalled on the service line commensurate with the degree of hazard.

This requirement shall apply to the handling of processed waters and waters originating from the water supplier's system which have been subject to deterioration in quality.
(3) In the case of premises having (i) internal cross-connections that cannot be permanently corrected or protected against, or (il) intri- cate plumbing and piping arrangements, or where entry to all por- tions of the premises is not readily accessible for inspection pur- poses, thus making it impracticable or impossible to ascertain whether or not dangerous cross-connections exist, the water sys- tem shall be protected against backflow from the premises. To provide this protection an approved RP must be installed in the ser- vice line. All water hose outlets shall be clearly labeled "NON- POTABLE, DO NOT DRINK."
(e) The type of protective assembly required under subsections (d)(1) -(3), shall depend upon the degree of hazard which exists, and shall be as further prescribed in this subsection:
(1) In the case of any premises where there is an auxiliary water sup- ply as described in subsection (d)(1) of this section and it is not subject to any of the following rules regarding the backflow preven- tion assembly standards and testing, the water system will be pro- tected by an approved air gap or an approved reduced pressure principle backflow prevention assembly.
(2) In the case of any premises where there is water or substance that would be objectionable, but not hazardous to health, if introduced into the water system, the water system will be protected by an ap- proved double check valve backflow prevention assembly. (3) In the case of any premises where there is any material dangerous to health, which is handled in such fashion as to create an actual or potential hazard to the water system, the water system will be pro- tected by an approved air gap or an approved reduced pressure 8 principle backflow prevention assembly. Examples of premises where these conditions will exist include sewage treatment plants, sewage pumping stations, chemical manufacturing plants, hospitals mortuaries and plating plants.
(4) In the case of any premises where there are unprotected cross- connections, either actual or potential, the water system will be pro- tected by an approved air gap or an approved reduced pressure principle backflow prevention assembly at the service connection. (f) Any backflow prevention assembly required by this Ordinance shall be a make, model, and size approved by the water purveyor and the State of California Health Department. An approved backflow prevention assembly is one that has been manufactured in conformance with AWWA standards and has met the laboratory and field performance standards outlined by the Foundation for Cross-Connection Control and Hydraulic Research of the University of Southern California. A list of approved backflow prevention assemblies may be provided upon request.

13.09.050 Testing.
(a) Testing of backflow assemblies will be conducted by the City, using quali- fied testers. Backflow prevention assemblies will be tested immediately after installa- tion, relocation, or repair and no less than annually. More frequent testing may be re- quired if deemed necessary by the City. Records of such tests, repairs and overhaul will be kept and made available to the Cross Connection Specialist. All certified testers will give the City a copy of current tester certification and backflow gauge calibration. (b) The following testing laboratory has been qualified by the Water Commis- sioner or Health Officer to test and approve backflow prevention assemblies:

Foundation for Cross-Connection Control and Hydraulic Research University of Southern California
1150 S. Olive Sreet, Suite 1700
Los Angeles, California 90089-2531
(c) Testing laboratories other than the laboratory listed above will be added to an approved list as they are qualified by the water purveyor or State of California Health Department.
(d) Backflow preventers, which may be subjected to backpressure or back- siphonage, that have been fully tested, have been granted a Certificate of Approval by said qualified laboratory and are listed on the laboratory's current list of approved back- flow prevention assemblies may be used without further tests or qualifications. (e) All presently installed backflow prevention assemblies which do not meet the requirements of this section but were approved devices for the purposes described 9 herein at the time of installation and which have been properly maintained, will, except for the field testing and maintenance requirements under subsection (a), be excluded from the requirements of these rules so long as the cross connection specialist is as- sured that they will satisfactorily protect the water purveyor's system. Whenever the ex- isting device is moved from the present location, or requires more than minimum maintenance, or when the Cross Connection Specialist finds that the maintenance con- stitutes a hazard to health, the unit will be replaced by an approved backflow prevention assembly meeting the requirements of this section.
(f) The Cross Connection Specialist is authorized to provide input on neces- sary and reasonable rules and policies with respect to the enforcement of this chapter.

All such rules and policies will be consistent with the provisions of this chapter." SECTION 4. VALIDITY OF ORDINANCE
If any article, section, sub-section, sentence, clause, or phrase of this Ordinance is held by a court of competent jurisdiction to be invalid, such decision shall not affect the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each article, section, subsection, sentence, clause, and phrase hereof, irrespective of the fact that one or more articles, sections, subsec- tions, sentences, clauses, and phrases be declared invalid.

SECTION 5. SUMMARY OF ORDINANCE
The City Clerk is hereby directed to cause a summary of this Ordinance to be published by one insertion in a newspaper of general circulation in the County at least five (5) days prior to adoption and again fifteen (15) days after its adoption. If a sum- mary of the Ordinance is published, then the City Clerk shall cause a certified copy of the full text of the proposed Ordinance to be posted in the office of the City Clerk at least five (5) days prior to the City Council meeting at which the Ordinance is adopted, and again after the meeting at which the Ordinance is adopted.
