The City Council's right to terminate Employee pursuant to this Section 3.4 shall not be subject to or in any way limited by the City's Personnel Rules or past City practices related to the employment, discipline or termination of the City's employees. Nothing herein, however, shall be construed to create a property interest, where one does not exist by rule of law, in the position of city manager. Upon appointment to the city manager position, Employee remains an at-will employee serving at the pleasure of the City Council.
(a) Termination by City for Cause. The City Council may terminate this Agreement for cause at any time by providing Employee with five (5) business days' written notice of the termination for cause and the facts and grounds constituting such cause. In such event, City shall, if desired by Employee, afford Employee a public name-clearing hearing before Council. Request for a name clearing hearing shall be made to the City Clerk within seven (7) days of Employee's receipt of notice of termination. Notwithstanding the foregoing, Government Code Section 53260 provides that all contracts of employment with a city must include a provision limiting the maximum cash settlement for the termination of the contract to the monthly salary (excluding benefits) multiplied by the number of months left on the unexpired term, but not more than 18 months if the unexpired term exceeds 18 months. Accordingly, should such proposed severance payment exceed the amount authorized to be paid under Government Code Section 53260, then the amount paid to Employee shall be reduced in the amount necessary to comply with such statute. (For example, if termination occurs with two (2) months left in the term, severance would be equal to the monthly base salary multiplied by two (2) rather than the three (3) months provided in this Section.)
4.2 No Severance Pay if Termination for Cause or Initiated by Employee. As provided in Section 3.4(a), should Employee be terminated for cause, the City shall have no obligation to pay the severance provided for in Section 4.1 above. As provided in Section 3.3, should Employee initiate termination of this Agreement, the City shall have no obligation to pay the severance provided for in Section 4.1 above.
4.3 Sole Rights. The severance rights provided in this Section 4.0 shall constitute the sole and only entitlement of Employee with respect to severance pay in the event of the termination, other than for cause. 5.2 Annual Evaluation. The City Council shall review and evaluate the performance of Employee annually in June of the first year of the term of this Agreement (i.e.
June 2027) and thereafter in July of each year beginning in July 2028. The Operation of the New Water Plant has been taken over by City Staff and is producing potable water to the standards of the State Water Board requirements. The City Staff continue to operate the Plant and provide data on the operations to the State Water Board Staff. The Contractor has completed all but one of the tie-in's. The New Water plant switched over to the Distribution System on September 1st, The Contractor is starting on the Demolition of the Old Water Plant.

Prop 218 Rate Study Funding - QK staff has submitted the application for funding and developed a scope of services, along with a timeline. The State Water Board financial staff has pointed out tha the ability to receive the grant funds is that a monthly utility rate be in place that addresses the funding needs for the operation of the new facility. State Water Board Staff will fund the Water portion of the rate study and QK staff has submitted a funding request for both water and sewer. 2816 Park Avenue • Merced, Callfornia 95348 • Tel (209) 723-2066 • Fax (559) 733-7821 www.akinc.com

City of Dos Palos
Energy Services Proposal SYSERCO
Executive Summary
The City of Dos Palos (City) selected Syserco Energy Solutions, Inc. (SES), a qualified energy services ompany (ESCO), to develop a City-wide, comprehensive energy services project. The process o leveloping the energy conservation measures (ECMs) for the City involved performing an Investment Grade Audit (IGA) at the majority of the City-owned facilities. The IGA established a historical energy and utility baseline and identified a comprehensive list of ECMs that would provide the best overall value to We are pleased to present the following energy efficiency and facility enhancement project proposal to the City of Dos Palos.
The primary goals of this project are:
1. Reduce energy consumption across City-owned infrastructure.
2. Reduce the City's ongoing utility and operational costs.
3. Reduce overall City greenhouse gas emissions.
4. Upgrade aging infrastructure by improving efficiencies of existing equipment and systems.
5. Create safer and more comfortable conditions for City staff and the public.
The following table is the firm-fixed project cost and estimated utility and operational savings.
Total Project Cost* $5,327,897
Investment Tax Credit (IRA ITC) (Est.) ' ($1,139,874)
Low Income Tax Credit (IRA ITC) (Est.) ' ($379,958) |
PG&E Infrastructure Upgrade Budget? $237,000
Net Project Cost $4,045,065
1 - Values are estimated and not guaranteed
2 - Customer controlled budget for PG&E upgrades included as part of the financing but not included in SES Contract value 30-YEAR CUMULATIVE SAVINGS** = $11,083,640
* Pricing assumes the City Council approves this project at a regularly scheduled public hearing in December, public notice of which is given at least two weeks in advance. Pricing may be subject to change if the approval is delayed.
** Projected energy reduction and cost avoidance figures are calculated based upon existing building occupancy, operation, and stipulated assumptions of performance; assumes future wastewater treatment facility production and expansion plans. All calculations are based upon industry best practices and methodologies. Based on 5% estimated PG&E annual utility cost escalation and 3% operational cost escalation.
