RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPOINTING A MEMBER TO FILL THE CITY COUNCIL SEAT FOR DISTRICT 2 PURSUANT TO DOWNEY CITY CHARTER SECTION 503(b)
WHEREAS, on November 6, 2018, Sean Ashton was elected to the City Council of the City of Downey to represent Council District 2, with a scheduled four-year term running from November, 2018 through November, 2022; and
WHEREAS, on March 14, 2022, Councilmember Sean Ashton submitted his letter of resignation to the City Clerk resulting in the District 2 Council seat becoming vacant; and,
WHEREAS, Downey City Charter, Section 503(b) provides that if a vacancy on the City Council occurs less than one year before the next general municipal election, the City Council shall, within 60 days of the vacancy, appoint an eligible person to serve during the term of such vacant office; and
WHEREAS, on March 22, 2022, the City Council directed that the City initiate the process of appointing an eligible successor to fill the District 2 Council seat for the remainder of the term; and,
WHEREAS, the City solicited applications from eligible residents in District 2; said applications were reviewed by the City Council; and eligible candidates were interviewed by the City Council at duly noticed public hearing; and,
WHEREAS, at the special meeting of April 27, 2022, the Downey City Council appointed a candidate to serve the remainder of said term until the City’s next general municipal election on November 8, 2022, at which time voters in District 2 would then elect a person to fill a new four- year term.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The above recitals are true and correct and shall be the findings of the City of Downey City Council.
SECTION 2. Pursuant to Downey City Charter Section 503(b), _______________________is appointed as a member of the Downey City Council for District 2.
SECTION 3. The person appointed as set forth in this Resolution shall take office and be sworn-in after appointment by the City Council at a Special Meeting on May 3, 2022, and shall serve on the City Council until the person who is elected by District 2 voters at the November 8, 2022 general municipal election has been certified as the successor to serve on the Downey City Council for District 2 for a new four-year term.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
