The City Council of the City of Downey held a Special City Council Meeting on July 12, 2022, at 5:34 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, with Mayor Pacheco presiding.

APPROVED CLOSED SESSION MINUTES
Council Member Frometa abstained from the Closed Session Minutes of May 24, 2022 as she was absent.
Council Member Trujillo abstained from the Closed Session Minutes of June 14, 2022 as he was absent.
It was moved by Council Member Frometa, seconded by Council Member Trujillo and carried 5- 0, to approve the Closed Session Minutes of May 24 and June 14, 2022.
PUBLIC COMMENT ON CLOSED SESSION AGENDA ITEMS
Mayor Pacheco asked City Clerk Duarte if any written comments were received regarding Closed Session Items. City Clerk Duarte confirmed no written Public Comments were received. Mayor Pacheco asked if there was anyone present who would like to comment on Closed Session Items.
BC, resident, commented regarding water contamination.
Armando Herman, non-resident, commented regarding water contamination and corruption.
Having no one else, Mayor Pacheco closed public comment.
RECESSED TO CLOSED SESSION
Mayor Pacheco announced the City Council is recessing to Closed Session at 5:42 p.m. to discuss matters under the authority of the following sections of the Government Code:
Government Code Section 54956.9(d)(1) - Conference with Legal Counsel - Existing Litigation - Name of Case: City of Long Beach et al. v. Monsanto Co. et al., Case No. 2:16-CV-03493-FMO-AS (C.D. Cal.).

RECONVENED SPECIAL CITY COUNCIL MEETING
Mayor Pacheco reconvened the Special City Council meeting at 6:33 p.m. with all Council Members present.
Interim City Attorney Langer reported the Closed Session report as follows: In regards to Item No. 1, there was a motion made by Council Member Frometa, seconded by Mayor Pro Tern Alvarez, and carried 5-0, to accept a settlement in the amount of $2,023,189 and agreed to waive and release Monsanto Co. from future claims related to PCB contamination.
ADJOURNMENT
Mayor Pacheco adjourned the Special City Council meeting at 6:35 p.m.
