Council Member Trujillo recused himself from Item No. 1, due to the commercial properties he owns in the area.
City Planner Crystal Landavazo presented the staff report for Item No. 1. She explained the purpose of the amendment to introduce a drive -through facility and monument signature in the Downtown Downey Specific Plan. She shared that the amendment was requested by the property owner of 8300 Firestone Blvd who would propose to remodel the existing commercial building to incorporate a drive -through facility if the amendment is approved. She reviewed the proposed development and operation standards and how the proposed remodel would comply with the standards.
Council Member Ashton expressed concerns regarding traffic and enquired about the business proposing the drive -through. City Planner Landavazo responded that there is no tenant at this time and that staff considered the issue from multiple perspectives. She stated that the Code requires a drive - through queue lane that allows a minimum of eight vehicles and the applicant proposed a queue allowing 11 vehicles to be lined up. She reported that a traffic analysis was completed on -site, which determined a less than 10% chance that the traffic would spill off -site at maximum peak times.
Council Member Ashton asked whether the same standards apply to the In N Out in Downey, which does experience spillover and reiterated his concerns regarding traffic. City Planner Landavazo responded that staff is aware that certain businesses such as In N Out experience higher turnout and conducts studies based on such businesses. She noted that, without a tenant, staff could not impose standards such as those applicable to an In N Out but did hold the project to a higher standard than what the Code requires.
Council Member Ashton requested to confirm the flow of traffic into the proposed drive -through.
City Planner Landavazo confirmed that vehicles would enter through Downey Ave. and circle the parking lot.

17. DISCUSSED THE PROCESS FOR ADDING CITY COUNCIL REQUESTED ITEMS TO THE AGENDA: Mayor Pro Tern Pacheco.
Mayor Pro Tern Pacheco requested this item be placed on the agenda.
Mayor Pro Tern Pacheco questioned whether the City should adopt a policy for adding City Council requested items to the agenda. She shared that she requested that staff research procedures in other cities. She referenced the City of Barstow's policy, which requires support from two Council Members to add items to the agenda. She stated her intention to discuss a policy and whether it should require the support of two Council Members or only require the Mayor's discretion.
Council Member Ashton commented that he did not believe the item was necessary. He stated that the Council Members were elected to place items before Council and represent residents. He expressed his desire to discuss items even when supported by only one Council Member. He commented in favor of the current process.
Mayor Pro Tern Pacheco suggested starting a discussion amongst the Council to implement a policy that would require the support of two Council Members to place an item on the agenda or a limitation to the number of items a Council Member can bring forth to ensure the agenda is not heavy.
Council Member Ashton responded in opposition to any limitation as Council Member requests typically come from constituents. He commented that limitations put the Council Member in the position of deciding which constituent issue is more important. He discussed his understanding of the need to manage the Council meeting schedule and suggested that Council work with staff to determine when items are brought before the Council.
Mayor Frometa asked City Clerk Duarte if there was any written correspondence received regarding Item No. 17. City Clerk Duarte confirmed no written correspondence was received. Mayor Frometa asked if there was anyone present who would like to comment regarding Item No. 17.
Joey Martinez, resident, commented in opposition to the item and regarding First Amendment rights, public comment period, and the role of Council Members to advocate for their constituents.
Armando Herman, non-resident, commented in opposition to the item and regarding First Amendment rights.
Rodolfo Cortes Barragan, non-resident, commented in opposition to the item.
Mayor Pro Tern Pacheco shared that, in Whittier, if a Council Member brings forth items during Council comments and two other Council Members are interested in discussion, it is then scheduled for an upcoming meeting. She stated that in South Gate, Council Members discuss items with the City Manager before adding items to the agenda, and, in Santa Fe Springs, the Council Member discusses the item with the City Manager and the City Manager brings the item to the Mayor for consideration.
Council Member Ashton commented regarding the similarity of the policies of other cities to that of Downey's. He commented that Council Members work with City staff to bring items before the City Council. He stated that the City Council assignment list assists in tracking Council Member requests.
Mayor Pro Tern Pacheco continued to discuss policies of other cities in the area, which require the Mayor's approval, support from three Council Members, or discussion with the City Manager. She commented regarding the effect of long work hours of staff.
Mayor Frometa commented regarding efficient use of time and utilization of staff time and resources. She commented regarding the result of placing items with no traction before Council and other items that are not discussed as a result.
City Council Minutes
Regular Meeting — August 24, 2021 8
Council Member Ashton commented regarding the need to allow public participation and an opportunity for public input on certain topics. He reiterated the importance of representing constituents who may have different needs.
Assistant City Manager Oskoui commented regarding the intent of the item and the inability to handle a large number of requests that come in at the same time due to limited staff resources. He commented regarding the City Council prioritizing which items are to be discussed first due to time sensitivity or other factors. He clarified regarding the purpose of the City Council assignment list, which consists of action items and commented regarding prioritizing requests to allow for staff's due diligence.
Council Member Ashton questioned how this differs from the Council's current process. Assistant City Manager Oskoui responded that if Council Members come to staff and request to place an item on the agenda, the item is placed on the agenda.
Council Member Ashton commented that everything proposed by Assistant City Manager Oskoui is already being done. He stated that he has discussed with staff whether an item should be placed on the agenda immediately or can be postponed. He questioned what is being changed. He reiterated his opposition to requiring support from a second Council Member to bring an item to the Council for discussion.
Mayor Pro Tern Pacheco clarified that her intent was to have a dialogue with her Council colleagues regarding what other cities have in place and implementing the City's own policy.
It was moved by Council Member Ashton, seconded by Mayor Pro Tern Pacheco, and carried 4- 0, with Council Member Alvarez absent, to take no action.
STAFF MEMBER COMMENTS: None.
