Labor Code section 1182.12 requires the State of California to annually make a determination and certify to the Governor and the Legislature whether an adjustment for inflation is to be applied to the minimum wage after the minimum wage reached $15 per hour. Pursuant to this section, the minimum wage of $15 per hour was implemented on January 1, 2022 for employers who employ 26 or more employees. The labor code requires minimum wage to be adjusted annually for inflation by the lesser of 3.5 percent or the rate of change, as specified, for the United States Bureau of Labor Statistics non -seasonally adjusted United States Consumer Price Index for Urban Wage Earners and Clerical Workers (U.S. CPI-W).
The State of California Department of Finance calculated the U.S. CPI-W for the 12-month period from July 1, 2021 to June 30, 2022 to have increased by 7.9 percent compared to the 12- month period from July 1, 2020 to June 30, 2021. As a result, the State of California has determined that minimum wage shall increase by 3.5 percent to $15.50 per hour effective for all employers on January 1, 2023.
In addition to the California minimum wage increases, staff proposes additional adjustments for certain aquatics and Ambulance Operator positions to address recruitment and retention issues.
Staff recommends implementation of the hourly pay ranges effective December 26, 2022, as required by the State of California and as proposed in the attached Resolution.
