RESOLUTION NO. 23-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING SALARY AND BENEFIT CONTINUANCE PROVISIONS FOR
REGULAR FULL-TIME EMPLOYEES ACTIVATED AS MEMBERS OF THE ARMED
FORCES OF THE UNITED STATES OF AMERICA
WHEREAS, the City of Downey currently provides employees on temporary military leave salary continuation for 30 days per fiscal year in accordance with the California Military and Veterans Code; and
WHEREAS, the California Military and Veterans Code acknowledges the right of public agencies to authorize payment of compensation in an amount greater than the pay for 30 days by resolution of the legislative body; and
WHEREAS, the City of Downey is supportive of those employees of the City who have been called into active military duty and believes that it is in the public interest to provide these employees with continuity of compensation that will provide a portion of their City salary that may be lost due to leave of absence for active military duty.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Any regular full-time employee of the City Downey with a minimum of one year of service with the City shall receive the difference between their base military monthly salary and their regular City salary (base pay including any special pays) when called into active military duty.
SECTION 2. This pay will extend paid leave beginning July 1, 2022, beyond the 30th day per fiscal year required under current law through the 365th day of active military service.
SECTION 3. Pay under this pay shall be subjected to a monthly maximum of $5,000.
SECTION 4. While receiving differential pay in accordance with this resolution employees will continue to receive all applicable City benefits.
SECTION 5. Employees must provide acceptable documentation regarding their deployment and military pay for approval.
SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
