Item No.
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: OFFICE OF THE CITY MANAGER
BY: VANIAH DE ROJAS, ASSISTANT CITY MANAGER
D ATE: JUNE 27, 2023
SUBJECT: ADJUSTMENT OF CITYWIDE USER FEES FOR FISCAL YEAR 2023-2024
EXECUTIVE SUMMARY
The City Council will consider approving Resolution No. 23-8175 Adjusting Citywide User Fees for Fiscal Year (FY) 2023-2024. The City has annually adjusted Citywide user fees by the annual March Consumer Price Index (CPI) for the Los Angeles-Long Beach- Anaheim area according to the U.S. Bureau of Labor Statistics. By applying this gradual increase in fees, it ensures that general fund revenues are not used to subsidize specialized services and prevents the need to enact large increases due to skipping annual fee analyses for a few years.
RECOMMENDATION
That the City Council:
Hold a Public Hearing and adopt Resolution No. 23–8175 Adjusting the City’s Uniform Schedule of Fees
BACKGROUND
Local government agencies are responsible for providing a variety of services to citizens.
These services range from public safety to building and planning. The methods of funding local government services are also varied, and most services are funded by tax revenues and user fee charges. Services that support the community and public safety are typically tax supported, while services that provide for specific individual beneficiaries are generally supported by user fee charges.
User fee charges in California are required to comply with the statutory requirements of the California Constitution and the California Code of Regulations. Specifically, Proposition 26, approved by voters in 2010, requires that user fees for activities that benefit specific user groups be set at no more than the actual cost to provide the services.
In late 2016, the City retained Matrix Consulting Group to conduct a Citywide Cost Allocation and User Fee Study to ensure that City fees and rates reflect the true and reasonable cost of delivering services. Matrix Consulting Group also provided, as part of the Study, a recommended range of cost recovery targets that are specific to the industry, end user group, and public purpose for which the activity is occurring. While State law

does permit the full recovery of costs associated with providing these services, actual cost recovery is a policy decision of the City Council based upon the general public benefit derived from the specific fee, the overall fee purpose, and the need to remain economically competitive.
Based on the findings from the 2016 Cost Allocation and User Fee Study, the City Council adopted Resolution No. 18-7813 – Adopting the FY 2018-2019 User Fees on June 26, 2018.
As part of the FY 2019-2020 budget process, the City Council approved on June 25, 2019 the annual adjustment to user fees based on the consumer price index (CPI) for the Los Angeles – Orange-Riverside Metropolitan Statistical area. An exception to this annual adjustment are those fees set by State statue or fees recently adopted that are already at full cost recovery.
ANLAYSIS
The proposed FY 2023-2024 City User Fee Schedule is attached as “Exhibit A” to Resolution 23-8175 (Attachment A).
Fees not set by State regulations and that do not currently achieve full cost recovery were increased by 3.7 percent based on the March 2023 CPI for the Los Angeles-Long Beach- Anaheim area according to the U.S. Bureau of Labor Statistics (Attachment B) and are highlighted in orange on the Fee Schedule. These fee changes account for the majority of the changes to the Fee Schedule. Fee increases were rounded up or down by one dollar if they were greater or less than $0.50, respectively. However, there was an exception in the Community Development Department–Building & Safety section where fees were increased by the actual dollar amount to the cent, without any rounding.
By applying this gradual increase in fees, it ensures that general fund revenues are not used to subsidize specialized services received by businesses and developers, among others. It also prevents the need to enact large increases, resulting from a need to “catch up” fee charges due to skipping annual fee analyses for a few years.
A few fees were amended to reflect market rates for facility rentals, reservations, and admissions. Those fees are highlighted in red in Exhibit A.
Lastly, a Citywide fee was included as “Credit/Debit Card Transaction Fee” to account for any credit card/debit transactions that involve a banking fee to patrons for the use of their credit card or debit card as payment for service. This is highlighted as yellow on the schedule.

RESOLUTION NO. 23-8175
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING FEES AND CHARGES FOR CERTAIN SERVICES PROVIDED BY THE CITY OF DOWNEY, ADJUSTING THE CITY’S UNIFORM SCHEDULE OF
FEES, AND ADOPTING A CREDIT AND DEBIT CARD TRANSACTION FEE WHEREAS, the City of Downey (the “City”) charges fees for various services, permits, licenses, and regulatory activity provided by the City (collectively, the “Fees”); and
WHEREAS, in order for the Fees to cover the costs of providing the services, permits, licenses, or regulatory activity for which the Fees are imposed, many of the Fees must be adjusted to reflect reasonable estimated costs of service; and
WHEREAS, the cost of rendering such services or regulatory activity should be borne by that limited group who are the beneficiaries rather than the citizenry at large; and
WHEREAS, the City Council now wishes to adopt the Fees as set forth in Exhibit “A”, effective July 1, 2023; and
WHEREAS, pursuant to Government Code Section 6159, the City may impose a charge for the transactional costs associated with credit and debit card payments for City services and amounts due to the City; and WHEREAS, certain Fees are subject to the adoption procedures set forth in Government Code section 66016, and others are subject to the procedures set forth in Government Code section 66018; and WHEREAS, in accordance with Government Code section 66016, the City has made available to the public at least ten days prior to its public hearing, data supporting the Fees, and notice of this hearing has been mailed to all interest persons that have requested such notice at least 14 days prior to the date of this hearing; and
WHEREAS, in accordance with Government Code section 66018, the City Council called a public hearing for June 27, 2023, for the purpose of receiving public comments to the proposed Fees. WHEREAS, the City is also expressly authorized to impose a charge for the credit and debit card payments for City services and amounts due to the City so long as the charge does not exceed the costs incurred by the City for providing the payment transaction; and
WHEREAS, the City finds that the transactional costs for the credit and debit card fees would otherwise be paid out of the City’s general fund and, therefore, borne by the general public, if said costs are not imposed on the persons using credit and debit cards as a payment method; and WHEREAS, in the interests of fairness to the general public, the City desires to recover the transactional costs for credit and debit card payments by imposing such charges on the persons using this payment method.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The above Recitals are true and correct and by this reference incorporated herein.
SECTION 2. The City Council hereby adopts the full City of Downey Fee Schedule described in Exhibit “A” attached hereto and incorporated herein by this reference. SECTION 6. If any section, subsection, clause or phrase in this resolution or the application thereof to any person or circumstances is for any reason held invalid, the validity of the remainder of this Resolution or the application of such provision to other persons or circumstances shall not be affected thereby. (8) Indexes on a 1987=100 base.
NOTE: Local area indexes are byproducts of the national CPI program. Each local index has a smaller sample size than the national index and is, therefore, subject to substantially more sampling and other measurement error. As a result, local area indexes show greater volatility than the national index, although their long-term trends are similar. Therefore, the Bureau of Labor Statistics strongly urges users to consider adopting the national average CPI for use in their escalator clauses.

Footnotes
(1) The C-CPI-U is designed to be a closer approximation to a cost-of-living index in that it, in its final form, accounts for any substitution that consumers make across item categories in response to changes in relative prices. Since the expenditure data required for the calculation of the C-CPI-U are available only with a time lag, the C-CPI-U is issued first in preliminary form using the latest available expenditure data at that time and is subject to four revisions.
Indexes are issued as initial estimates. Indexes are revised each quarter with the publication of January, April, July, and October data as updated expenditure estimates become available. The C-CPI-U indexes are updated quarterly until they become final. January-March indexes are final in January of the following year; April-June indexes are final in April of the following year; July-September indexes are final in July of the following year; October-December indexes are final in October of the following year.
