APPROVED BY
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL CITY MANAGER FROM: OFFICE OF THE CITY MANAGER
BY: IRMA HUITRON, DIRECTOR OF COMMUNITY DEVELOPMEN
DATE: OCTOBER 10, 2023
SUBJECT: WAIVER OF CITY RELATED FEES, REQUESTED BY THE DOWNEY PATRIOT
ON BEHALF OF THE DOWNEY FOUNDATION FOR INDEPENDENT
JOURNALISM, ASSOCIATED WITH THE STREET CLOSURE PERMIT FOR THE
INAUGURAL KICK-OFF FESTIVAL FOR DOWNEY-WARREN WEEK
EXECUTIVE SUMMARY
The City Council will consider a request for a waiver of City fees, staff labor, and material costs associated with the "Crosstown Kickoff' event street closure that took place on Saturday, October 7, 2023. The street closure took place along Brookshire Avenue between Firestone Boulevard to 5th Street, accommodating an inaugural kick-off festival to celebrate Downey -Warren (High Schools) Week. The Crosstown Kickoff event was produced by the Downey Patriot on behalf of the Downey Foundation for Independent Journalism, a 501(c)(3) non-profit organization ("Applicant").
RECOMMENDATION
That the City Council:
Consider and provide direction to staff regarding the Applicant's request for a fee waiver of City fees, staff labor, and materials costs associated with the street closure for the Saturday, October 7, 2023 "Crosstown Kick-off' event.
BACKGROUND
On September 12, 2023, the City Council approved a Street Closure Permit request for the inaugural Crosstown Kick-off event that took place on October 7, 2023, to celebrate Downey -Warren (High Schools) Week. The Crosstown Kickoff event was produced by the Downey Patriot on behalf of the Downey Foundation for Independent Journalism, a 501(c)(3) non-profit organization ("Applicant"). During the month of October, the Downey and Warren High Schools have rivalry traditions that lead up to the anticipated Downey vs. Warren football game that will take place this year on October 13, 2023. The Crosstown Kickoff festival, a family -friendly event, included vendor booths, food trucks, fun zone, and live entertainment, which took place on Saturday, October 7, 2023 from 3:00 p.m. to 9:00 p.m. along Brookshire Avenue.

OCTOBER 10, 2023
PAGE 2
On September 26, 2023, the City Council requested that a fee waiver of City related fees be placed on a future City Council agenda for consideration.
ANALYSIS
The applicable City fees and labor costs associated with the event are summarized below.
If the waiver request is approved, the Applicant would not be responsible for paying the fees to the City. However, in the event the request is not granted, then the City will invoice the Applicant for the fees listed below, which would reflect the actual costs expended by the Public Works Department associated with road closures and traffic control services.

The street closure took place two hours prior to start time of the event to allow for set up, and ended two hours after the close of event for cleanup. Inclusive of clean up time, the closure was in effect from 1:00 p.m. to 11:00 p.m. During the event, there were an

estimated 150 vendor booths, ten (10) food trucks, live music/entertainment, and a beer/wine garden.
The City's Police, Fire, Public Works, and Community Development Departments reviewed the event site layout and provided standard conditions to ensure the event will not cause adverse impacts on health or safety to surrounding uses. Those conditions included, but were not limited to, providing trash receptacles, portable restrooms, security guards, police officers, Department of Alcoholic Beverage Control (ABC) approval for the beer/wine garden, Los Angeles County Health Department for food vending, and traffic control including placement of road closure signs. The Applicant has requested that the City provide the coordination for a traffic control plan and implement the street closure on its behalf. This is an atypical request as street closure applicants generally procure and contract a traffic control company to perform these services. The City Public Works Department estimates that the City's labor and materials costs associated with the street closure would total approximately $4,800. The actual labor and material are still being calculated, and staff expects to have the final calculation of labor and materials expended by October 10, 2023.
It was anticipated at the time of the Street Closure Permit approval, on September 12, 2023, that the Downey Foundation for Independent Journalism would cover all costs associated with the event. However, the Applicant notified the City that there were unforeseen costs that have resulted in a financial burden and thus is seeking relief from City fees.

FISCAL IMPACT
Approval of the request for waiver of City related fees will result in an estimated revenue decrease in the approximate amount of $6,522 to cover costs associated with the Crosstown Kickoff Festival between the Police, Fire, and Public Works Department accounts in the General Fund.
