SUBJECT: UPDATE ON SOLID WASTE COLLECTION RATES FOR COMMERCIAL
AND MULTI-FAMILY CUSTOMERS
EXECUTIVE SUMMARY
The City Council will consider receiving and filing an update on solid waste collection rates for commercial customers, including multi-family housing properties with five or more units. Staff is returning with this update to provide information on the rate increases that were approved at the August 8, 2023 City Council meeting and take effect on Janu ary 1, 2024.
RECOMMENDATION
That the City Council:
Receive and file a report on solid waste collection rates for commercial customers, including multi-family housing properties with five or more units, as a result of the implementation of the mandatory organic waste diversion requirements under Senate Bill 1383 (SB 1383).
BACKGROUND
On August 8, 2023, the City Council approved an extension to the agreement for integrated waste management services with Athens Services, Inc (Athens). As part of the agreement, adjusted rates for providing additional State-mandated organic waste collection services required under SB 1383 were included and are to take effect January 1, 2024. In the agenda memo prepared by staff for the agreement with Athens, staff indicated it would return to the City Council for provide information on the rates effective January 1, 2024.
ANALYSIS
In 2016, Governor Brown signed Senate Bill 1383 (SB 1383) into law, which requires that all municipalities in the State of California provide organic waste collection services to solid waste customers. The purpose of the program is to divert organic waste from disposal in landfills so as to reduce the production of methane , a greenhouse gas considered 84 times more potent than carbon dioxide. Currently, approximately 50 percent of all waste entering landfills is comprised of organics such as food scraps, yard

trimmings, paper, and cardboard. Municipalities are required to begin enforcemen t on January 1, 2024 of their ordinances that require that solid waste customers recycle all of their organic waste by separating this waste stream into a dedicated bin. The key waste stream component different from past organic recycling requirements is food waste.
Municipalities are now required to target food waste and educate their customers on separating this waste from bin collection intended from landfill disposal.
As a result of the state-mandated SB 1383 organic waste program, Athens has to adjust their collection services to provide the following:
• Dedicated bins for organic waste collection with labeling that includes food waste as appropriate for recycling.
• Labeling on bins for landfill disposal that excludes food waste as an allowable waste stream for disposal.
• Education and outreach to its customers on organic waste recycling. • Organic waste recycling at facilities that can handle the expanded organic waste stream, such as composting facilities or anaerobic digesters. • Data collection and reporting of organic waste diversion. • Monitoring of waste bins for contamination through periodic audits. • Contamination protocols, which include affixing notices to any container with contaminated waste and instructions to customers on proper procedures for sorting waste.
The state-mandated requirements under the SB 1383 program result in additional incurred costs for Athens, which are being recovered through their commercial rate structure and charges for services to multi-family housing properties with five or more units. The new rates to take effect on January 1, 2024 are shown in Attachment A.
Previous rates for commercial and multi-family customers were focused on providing one bin for refuse collection for landfill disposal. The new rates are based on a bundled service for providing separate bins for landfill disposal, recycling, and organic waste processing (SB 1383 service), each handled at separate facilities.
