EXECUTIVE SUMMARY
The City Council will consider authorizing the purchase of 11 Dodge Durango and 10 Ford Explorer police vehicles in the amount of $1,441,090 to replace 21 Ford Explorer police vehicles currently in service with the Downey Police Department. Police vehicles play a vital role in law enforcement, providing the means to respond throughout the community to emergency and non-emergency calls for service. In addition, police vehicles are used to proactively patrol the community, and deter and enforce traffic violations.

RECOMMENDATION
That the City Council:

1.Approve the purchase of 11 Dodge Durango Police Vehicles from the Elk Grove Auto Group at an amount of $597,974.

2.Approve a transfer of up to $1,441,090 from Fund 17 Measure S Operating to Fund 33 Measure S Capital.

3. Approve the appropriation of $1,441,090 in Account No. 33-4-2120-0920 Fund 33 Measure S Capital for the purchase of 21 police vehicles.

BACKGROUND
Police vehicles are the primary transportation source in the Downey Police Department’s fleet. Police vehicles play a crucial role in maintaining law and order within communities.

The presence of marked police vehicles serves as a constant reminder that law enforcement is actively patrolling and ready to respond to emergencies. The distinctive markings and lights on police vehicles make them easily recognizable, helping to establish a sense of security among the public. The mobility and emergency lights on police vehicles enable officers to quickly reach crime scenes, accidents, or other incidents, allowing them to intervene promptly and address situations before they escalate. The distinctive appearance and functionality of police vehicles contribute to their effectiveness in preventing and responding to criminal activity, ultimately promoting public safety.

Additionally, the high visibility of marked police cars serves as a deterrent, encouraging motorists to adhere to traffic laws and promoting responsible driving behavior.

The proposed purchase of 21 new police vehicles would replace 21 current police vehicles, which are more than five years old and well past their normal service life in condition and mileage per industry standards. Additionally, it will replace a vehicle that was totaled in a traffic collision. During the regular budget approval process for Fiscal Year 2022-2023, the City Council approved $796,737 in the General Fund to purchase 10 replacement police vehicles; however, based upon the competitive bid process, the actual cost will be $843,116. The budgetary authority for the purchase of these police vehicles was not carried over as the City was unaware of when the vehicles would be ready, and the City planned to appropriate funds at the time the purchase became possible. There are available funds in the Measure S operating fund for this purchase.

The funds for the purchase of these vehicles would need to be appropriated from the Measure S operating, Fund 17, into the Fiscal Year 2022-2023 Measure S Capital Expense, Fund 33. The allocated budgetary funds were never utilized due to production shortages and supply chain disruptions, impeding the Downey Police Department's procurement of available vehicles. With the recent availability of vehicles, this acquisition catches department up with its vehicle replacement requirements.

During the budget approval process for Fiscal Year 2023-2024, the City Council approved $796,737 in the General Fund to purchase 11 replacement police vehicles, consisting of $457,500 for the actual vehicles themselves and $339,267 in additional costs to install emergency lighting and police equipment in each vehicle. However, based on the competitive bid process, the actual cost for just the purchase of the vehicles is $597,974.

ANALYSIS

The Downey Police Department has 30 total police vehicles. The Department’s primary patrol vehicle fleet consists of Ford Explorers ranging from 2016 - 2021 models. The fleet also consists of one 2011 Chevy Tahoe. The majority of the Department's fleet is well past their normal service life in condition and mileage according to industry standards, necessitating their replacement.

In January 2019, the City of Downey approved a contract with Enterprise Fleet Management Inc., and the City agreed to lease/purchase vehicles through the contract.

In 2021, police vehicles were added to this leasing program, and the City began ordering approximately 10 Ford Explorer vehicles each fiscal year in an effort to develop a maintenance and replacement cycle. However, in 2022, Ford began experiencing an inability to keep up with the demand for police vehicles, resulting in the Downey Police Department receiving vehicles two years after they are ordered, forcing the current fleet’s age to extend well beyond its normal service life. The City has currently locked in a request for the purchase of 10 Ford Explores, which are expected to be delivered this year. As part of this Council action, an appropriation for the order for these 10 police vehicles would be placed with Enterprise Fleet Management Inc. The average build and delivery time of the police vehicle is three months.

In regard to the Fiscal Year 2023-2024 purchase, it has come to the City's attention that Ford will not accept any new purchase requests until the end of the 2024 calendar year and will not guarantee the City will be allocated any vehicles during the next purchase window. This led the Downey Police Department to evaluate suitable replacements for the needs for the year. After conducting research and testing, the Dodge Durango was selected as the primary patrol vehicle of the fleet based on overall performance as well as consistency as they are very similar to the Ford Explorer in use. The Dodge Durango is also a commonly used vehicle by police departments across the nation. Additionally, the cost of each Dodge Durango is $5,791 less than each Ford Explorer being purchased through Enterprise.

In May 2022, the State of California Department of General Services Procurement Division conducted a bidding process, and they awarded a contract to Elk Grove Auto.

Staff is recommending that the City “piggyback” on the competitive bidding process used by the State of California Department of General Services Procurement Division for the acquisition of the police vehicles, which is consistent with the City of Downey’s Cooperative Purchasing Policy.

This reservation of 11 Dodge Durango’s has already been initiated through City Manager action to secure the vehicles and the pricing, and the authorization under this proposed Council action provides authority for the purchase The order for these 11 police vehicles would be placed with the Elk Grove Auto Group. The average build and delivery time of the police vehicle is four months once the order is received.

FISCAL IMPACT

Approval of the recommended action will result in an expenditure of $1,441,090 from the Measure S Capital Fund 33 Expense Account number 33-4-2120-0920. This total amount was previously approved in the Fiscal Year 2022-2023 and Fiscal Year 2023-2024 operating budgets.
