SUBJECT: Appeal of the Planning Commission Decision to Approve Prologis Stewart and Gray Road Warehouse Project (PLN-21-00025 [Site Plan Review, Variance] and PLN-23-00086 [Lot Merger]), including Final Environmental Impact Report (SCH No. 2022030758), located at 9300 Hall Road, 9350 Hall Road, and 9363 Stewart and Gray Road in the General Manufacturing (M-2) Zoning District Dear Mr. Bourgeois and Mr. Amaya,
On March 13, 2024, the City Clerk's office of the City of Downey received your letter that expresses your request to appeal the Planning Commission's decision to approve the Prologis Stewart and Gray Road Warehouse Project. Specifically, your letter addresses concerns related to the Final Environmental Impact Report (Final EIR) prepared for the project.
For context, the Planning Commission, at its regularly scheduled meeting of March 6, 2024, adopted (motion by Planning Commissioner Hector Lujan — District 1 and seconded by Planning Commissioner Elias Saikaly — District 3, for a 4-0-1 vote; Planning Commissioner Louis Morales — District 5, excused), Resolution No. 24-4022 {[1 ] to certify the Final EIR, [2] adopt a Statement of Overriding Considerations, [3] adopt the Mitigation Monitoring and Reporting Program), and Resolution No. 24-4023 {to approve PLN-21-00025 [Site Plan Review, Variance], PLN-23-00086 [Lot Merger]).
Pursuant to Section 9806.04 (b)(1) of the Downey Municipal Code, Written Notification and Timing, a decision of the Planning Commission, within fifteen calendar days after the date of such action, may be appealed by written notice of appeal filed in duplicate with the City Clerk, A written notice of appeal shall specify where it is claimed that the Commission's findings were in error, and where the decision of the Commission is not supported by the evidence in the matter.
Upon receipt of your letter, dated March 12, 2024, City staff reviewed and determined it to be incomplete, since it does not include the required information as prescribed in Section 9806.04 (b)(1) of the City's Zoning Code, specifically, the requirement to specify where the Planning Commission's findings were found to be in error, and where the decision of the Planning Commission UnlimitedFuture

is not supported by the evidence in the matter. The letter may be revised such that it provides the required information and resubmitted for City staff review to determine completeness. While the appeal letter was accepted by the Clerk because it was accompanied by the required fee, no other review is required or conducted at this time regarding the adequacy of the statement of appeal.
