Item No.

TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL

FROM: OFFICE OF THE CITY MANAGER
BY: SCOTT R. LOUGHNER, ACTING CHIEF OF POLICE

DATE: AUGUST 27, 2024

SUBJECT: ADOPTION OF RESOLUTION APPROVING AN AGREEMENT WITH THE

CALIFORNIA DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL

FOR ACCEPTANCE OF A GRANT

EXECUTIVE SUMMARY

The City Council will consider adoption of a Resolution for the Downey Police Department to enter into an agreement with the California Department of Alcoholic Beverage Control and accept grant funds for the Fiscal Year 2024-2025 Alcohol Policing Partnership program. The grant period will run between July 1, 2024 through June 30, 2025. The program will allow the Downey Police Department to provide education, conduct enforcement operations, and ensure alcohol licensees are adhering to existing laws.

RECOMMENDATION

That the City Council:

1. Adopt Resolution No. 24-8264, authorizing the Police Department to enter into an agreement with the California Department of Alcoholic Beverage Control for acceptance and expenditure of grant funds; and,

2. Approve an amendment to Police Department budget, in Fund 10, to reflect an increase in revenues of $67,064, and increase expenditures by the same amount as outlined within this report.

BACKGROUND

In March 2024, the Downey Police Department submitted a grant application to the California Department of Alcoholic Beverage Control (ABC), requesting $67,064 in grant funding for the Fiscal Year (FY) 2024-25 Alcohol Policing Partnership program (APP).

This program awards grant funding to local law enforcement entities to assist in developing and maintaining an effective, comprehensive, and strategic approach to eliminating crime and nuisance problems associated with alcoholic beverage outlets within their jurisdictions. The Police Department was notified on May 19, 2024 it was

awarded the grant and the finalized agreement was received on July 30, 2024. The Police Department was awarded $66,540 for the same grant for the FY 2023-2024 APP.

ANALYSIS

As a result of the Downey Police Department’s continuing effort to mitigate the growing problems associated with alcohol sales and consumption within the City of Downey, a grant request was submitted and accepted by the California Department of ABC. The grant requires a resolution to be passed by the governing body of the grant recipient in order to accept the funding.

If adopted, the Resolution will allow the allocated grant funding to be used on the following three components:

1. Public education focusing on local ABC licensed businesses and their employees;

2. Enforcement operations at ABC licensed businesses within our jurisdiction; and

3. Engaging the community by providing public service announcements and creating a social media campaign to update the community on grant efforts.

During the course of this grant, the Police Department will work with agents from ABC who have the authority to take administrative action against alcohol establishments who are found violating the law.

The majority of funds from this grant will pay Police Officer overtime costs devoted to training and enforcement activities.

There is no matching fund requirement for this grant.
