PARK GREEN, SAFE AND ACTIVE PARK IMPROVEMENTS PROJECT
CAPIT AL IMPROVEMENT PROGRAM (CIP) NO. 23-31

EXECUTIVE SUMMARY

The City Council will consider approving an amendment to the professional engineering services agreement with Tetra Tech BAS, Inc. for the development of a Waste Footprint Workplan. Additionally, the amendment would extend the term of the agreement to December 31, 2025 and amend the budget of the agreement to accommodate the additional needs of the Rio San Gabriel Park Green, Safe and Active Park Improvements Project CIP No. 23-31.

RECOMMENDATION

That the City Council:

1. Approve Amendment No. 1 to the agreement with Tetra Tech BAS, Inc. for additional professional engineering services for the Rio San Gabriel Park Green, Safe and Active Park Improvements Project CIP No. 23-31; and

2. Authorize an appropriation in the amount of $130,000 from the General Fund – Fund Balance to the Capital Improvement Project Fund, CIP 23-31 Rio San Gabriel Park Green, Safe and Active Park Improvements Project; and

3. Authorize the City Manager, or his designee, to execute any and all amendments to the agreement as deemed necessary.

BACKGROUND

The California Department of Transportation (Caltrans) developed the Clean California Local Grant Program (CCLGP) to provide funds to local communities to beautify and improve local streets and roads, tribal lands, parks, pathways, and transit centers. The intention of the CCLGP is to add beautification measures in public spaces along with the

removal of litter and debris. The CCLGP will enhance communities and improve spaces for public health, cultural connection, and community placemaking by improving public spaces for walking and recreation.

The City of Downey applied for a competitive statewide CCLGP grant for the Rio San Gabriel Park Green, Safe and Active Park Improvements Project (Project) and was awarded a grant in the amount of $749,405. In December 2022, the City Council adopted a Resolution authorizing the City Manager to execute agreements with Caltrans for the CCLGP grant for the Project.

The Project includes full depth pavement rehabilitation of both parking lots; new curbs, gutters and pavement; upgrade of pedestrian amenities such as damaged sidewalks, walkways, and access ramps; new decomposed granite trails/walkways with concrete curbs throughout the park perimeter joining all park amenities with the San Gabriel River regional bike path; bike path resting stations with shade structures, benches, bike racks, water bottle filing stations, and bike repair stations; solar-powered pedestrian lights and poles adjacent to park walkways and trails; a new gardens with wayfinding and educational signage; new shade structures with picnic stations; new waste containment area to hide and secure park dumpsters; and new trash receptacles throughout the park.

Rio San Gabriel Park is constructed on the former Downey Dump site which operated as an unclassified landfill from 1950 to 1955 and was closed prior to the promulgation of any solid waste regulations. Although it has been closed for nearly 70 years, the Downey Dump, along with all former landfills, is regulated by the County of Los Angeles Department of Environmental Health acting as the local enforcement agency (LEA) for the California Department of Resources Recycling and Recovery (CalRecycle). All former landfills are required to seek approval from the LEA and CalRecycle prior to any substantial development of the site. Additionally, while the State Water Board (Board) does not oversee landfills, the LEA and CalRecycle require that the Board reviews such projects for their potential impacts to the groundwater supply and are given an opportunity to assign conditions to a project should potential impacts be found.

ANALYSIS

On January 31, 2024, City staff met with the LEA and CalRecycle to identify the requirements for approval of the Project. The agencies advised the City to seek out a consultant to prepare a Post Closure Land Use Plan (PCLUP), an environmental plan/report outlining what impacts, if any, the Project would have on the existing waste footprint beneath the park.

On May 20, 2024, after procuring proposals consistent with the City’s Purchasing Policy, the City of Downey entered into a contract under the City Manager’s authority with Tetra Teach BAS, Inc. (Tetra Tech) to prepare a PCLUP to comply with the aforementioned State regulations and direction.

PAGE 3

On July 2, 2024, City Staff met with Tetra Tech, the State Water Board, the LEA and CalRecycle to review Tetra Tech’s proposed scope of work and ensure it would meet the agencies’ requirements. During the meeting, the three (3) agencies advised that a broader scope of work would be required, specially the need to develop a Waste Footprint Workplan prior to the preparation of the PCLUP.

Tetra Tech submitted an additional scope of work to incorporate the development of a Waste Footprint Workplan consistent with the agencies’ direction. Staff recommends approval of Amendment No. 1 with Tetra Tech (Attachment A), which will allow Tetra Tech to commence with the aforementioned environmental services. The cost of the additional scope of work is $179,360, bringing the total contract amount to $219,380. $49,360 of this amount was previously budgeted though a local match project fund, resulting in $130,000 needing to be appropriated for the additional work.

Following approval by the City Council, the anticipated timeline of the review process by LEA/CalRecylce is as follows:

City submits Waste Footprint Workplan October 2024
Approval of Work Plan December 2024

lateral and vertical extents, etc.), waste disposal manifests, permits, and Site as-builts including existing utilities. It is assumed that Tetra Tech will provide the City with a list of requested information and the City will provide all available information. No time and effort have been included at this time for Tetra Tech to conduct an outside landfill gas data/information request. This initial effort will allow Tetra Tech to provide the City with a preliminary assessment of potential LFG surface emissions and/or subsurface migration from buried solid waste that may be occurring at the Site. Tetra Tech will utilize the field sampling activities discussed in Task 3 and Task 4 below to try and further determine if there is potenttat methane and Volatile Organic Compounds (VOCs) migration or surface emissions from the Site
Task 1 – Deliverables, Meetings, and Conference Calls:

The following summarizes the work products to be prepared and submitted for this task:
– Review and evaluation of existing Site data and a summary to assist in the preparation of a Work Plan and for inclusion in the Report of Findings (Report) described in Task 6 below.

Task 2 – Work Plan Preparation and Submittal
Upon receiving approval to proceed from the City and receipt of requested background information, Tetra Tech will prepare a Work Plan for the proposed field activities including the conceptual design and installation of the temporary soil vapor monitoring probes (probes), subsequent monitoring and sampling criteria for these probes, and instantaneous surface emission monitoring at the Site. The design of the soil vapor monitoring probes will adhere to the design criteria (depth and spacing) in Title 27 California Code of Regulations (CCR) section 20925
The following items will be included in the Work Plan:

Proposal for Professional Engineering Services – Provide Engineering Support and Field Services for the Rio San Gabriel Park (Downey Dump - SWIS #19-AA-5382) in Downey, California July 18, 2024
Monitoring locations are recommended to be surveyed and marked. Tetra Tech has not included surveying services in this proposal. Unless the City provides a surveyor to mark the locations, Tetra Tech is proposing to utilize visual identification and hand-held global positioning satellite (GPS) device with standard civilian accuracy to identify the monitoring probe location coordinates Task 2 – Deliverables, Meetings, and Conference Calls:

The following deliverables and activities will be completed under this task:
- Preparation and electronic submittal of the draft Work Plan as a PDF to the City for review and cornrnents;
One (1) teleconference caII with the City to discuss comments and approach; Incorporation of comments from the City’s review and electronic submittal of the Work Plan as a PDF to the LEA; and
Incorporation of potential comments from the LEA and electronic re-submittal of updated final Work Plan as a PDF to the LEA.

Task 3 – Installation of Soil Vapor Monitoring Probes
This task includes the installation of up to four (4) soil vapor monitoring probes (8 probe casings total) at strategic locations along the perimeter of the Site that will be identified in the Work Plan discussed in Task 2 above. It is assumed that a hollow stem auger drill rig will be utilized for drilling. Prior to drilling, Tetra Tech will coordinate with Dig Alert and will utilize a geophysicist to identify any potential utilities in the area, so they are not intercepted during drilling activities. This proposal assumes an encroachment permit will be obtained by the City. Each probe will be constructed with %-inch diameter Schedule 40 screened and solid polyvinyl chloride (PVC) pipe. Additionally, each probe will be installed to a depth of 30 feet below grade and will include 2 probe casings (shallow and deep). A bentonite seal will be installed near the ground surface to prevent air intrusion and water infiltration into the probe casings and between the shallow and deep probe casings. The soil vapor monitoring probes will be finished with an Asahi labcock valve within a flush mounted circular concrete vault. The probes can then be used to monitor subsurface gasses to identify any potential subsurface migration of LFG. The soil vapor monitoring probes will be installed in strategic locations along the perimeter to allow for the collection of data needed to aid in the assessment of potential LFG subsurface migration at the Site.

Tetra Tech will utilize a state-licensed drilling contractor to drill and install the soil vapor monitoring probes into the ground a depth of 30 feet below grade surface. This proposal assumes all four (4) probe locations will be installed within three (3) days inclusive of mobilization and demobilization.

Task 3 – Deliverables, Meetings, and Conference Calls:

The following deliverables and activities will be completed under this task:

Installation of four (4) push probes (8 probe casings total) using a hollow stem auger drill rig per the conceptual probe design included in the LEA approved Work Plan (Task 2); and Preparation and submittal of letter including drilling boring logs and probe construction details to City and LEA.

Task 4 – Monitoring of Soil Vapor Probes
Upon installation of the soil vapor probes, initial monitoring of the probes will be completed using a portable LFG analyzer unit (QED GEM-5000 or equivalent) and a photoionization detector (PID) within 24 to 48 hours after installation. These instruments will be used to measure the probe static pressure, gas temperature, methane, carbon dioxide, oxygen and Volatile Organic Compounds (VOC) concentrations from each of the probe casings as noted below. After the initial monitoring event, Tetra

Tech will continue monitoring these probes for a period of three months on a monthly basis to determine if any potential LFG may be migrating away from the Site. Tetra Tech will summarize the findings of each monitoring event and will submit to the City and LEA as described in a letter report.

The initial summary and following three-monthly summaries of the monitoring probes monitoring/sampling results will include the following:
•
•
The concentrations of methane, carbon dioxide, oxygen, balance gas and VOCs, as measured in each probe casing within each probe location;
The documentation of date, time, barometric pressure, atmospheric temperatures, general weather conditions, and probe’s static pressure at the time of probe monitoring and/or probe sample collection;
The names of monitoring/sampling personnel, field instrument(s) utilized, and a brief description of the methods used; and
An identification numbering system to correlate monitoring results to a corresponding probe location.
•
•
Please note that lab samples further described in Task 5 below will have to be collected and lab- analyzed for trace gas concentrations as the field instruments used for probe monitoring typically do not have the capability of analyze speciated trace gas concentrations in LFG.

Once the monitoring and sampling activities are completed, the probes can be formally abandoned under a separate contract
Task 4 – Deliverables, Meetinqs, and Conference Calls:

The following deliverables and activities will be completed under this task:

Perform initial monitoring of all monitoring probes within 24 to 48 hours after installation, and once a month for a three-month period after installation; and Electronic submittal of the initial and monthly monitoring letter reports as PDFs to the City and LEA
Task 5 – Soil Vapor Sampling and Lab Analysis
Tetra Tech will collect initial gas samples from the eight (8) newly installed perimeter probe casings within 24 to 48 hours of installation and will submit the samples to a laboratory for analysis. Prior to collecting the gas samples, Tetra Tech will monitor the perimeter probes using a portable LFG analyzer (GEM-5000 or equivalent) and a PID as stated in Task 4. Prior to sampling each probe, Tetra Tech will evacuate the probe until the methane concentration remains constant for at least 30 seconds. Tetra Tech will coordinate with a certified analytical testing laboratory to have ten (10), 10-liter, helium passivated Summa gas sampling canisters shipped to Tetra Tech. Eight (8) of the Summa canisters will be used to collect the gas samples utilizing one (1) Summa canister per probe casing (2 summa canisters will be obtained as spares in case there are any leaks or issues with any of the other canisters)
The probe sampling will be completed using a sampling train designed to collect gas samples. The sample train will be configured to begin sampling while minimizing ambient air intrusion and the Summa canister valve connected to the sample train opened. The gas samples will be collected through a flow meter at a rate of approximately 500 milliliters per minute (mLJmin) or less until one liter of sample gas is obtained, at which point the valves will be closed and the Summa canister removed from the sample train
The Summa canisters will be sent to the testing laboratory to be analyzed within 72 hours of collection, for quality-assured analytical analysis with an accompanying chain-of-custody form to confirm sample

integrity. Shipping costs for the Summa canisters are included in this proposal. Probes will be sampled for the following constituents:
• Speciated Volatile Organic Compounds (VOCs) via U.S. Environmental Protection Agency (EPA) Method TO-15; and
• Fixed Gases (Methane, Carbon Dioxide, Oxygen, Nitrogen).

Task 5 – Deliverables, Meetings, and Conference Calls:

The following summarizes the items to be performed for this task:

Initial sampling of the eight (8) perimeter probe casings utilizing eight (8) Summa canisters (samples) sent to an analytical laboratory for testing. Two (2) additional Summa canisters will be obtained as spares in case they are needed during sampling; and Obtain lab analysis results of the EPA Method TO-15 and Fixed Gases analysis of the eight (8) probe samples for inclusion in the Report of Findings (Task 7).

Task 6 – Instantaneous Surface Emissions Monitoring
Tetra Tech will complete instantaneous Surface Emissions Monitoring (SEM) across all accessible portions of the Site using a flame ionization detector (FID or equivalent) to measure TOC concentrations per South Coast Air Quality Management District (SCAQMD) Rule 1 150.1. The entire surface of the Site will be walked by a field technician in a serpentine pattern recording instantaneous measurements of TOC concentrations immediately above the surface and any readings exceeding the 500 parts per million by volume (ppmv) regulatory limit for TOC. All readings above 20 ppmv will be recorded and generally located on a map. The FID probe will be held within three inches of the surface while traversing. A surface inspection will also be performed during instantaneous surface emissions monitoring to identify cracks or fissures in the cover that could be potential pathways for LFG to escape to the atmosphere. Tetra Tech will monitor the surface at identified surface cracks, around existing utility boxes and other structures, as needed. Instantaneous surface emissions monitoring will be completed once per month for a period of three (3) months.

Task 6 – Deliverables, Meetinqs, and Conference Calls:
