2. Authorize the Mayor to execute the agreement; and

3. Authorize the City Manager to execute all amendments to the agreement.

BACKGROUND

On October 1, 2014, the City of Downey entered into a Professional Services Agreement (PSA) with Nationwide Environmental Services (NES) in the amount of $97,564 for Citywide bus stop cleaning and maintenance services. The initial term of the agreement was three years expiring September 30, 2017. On September 18, 2017, in accordance with the terms of the original agreement, the contract was amended,

thereby extending the term for an additional two years. The amended contract expired on September 30, 2019.

Subsequently, on September 24, 2019, the City Council approved an extension to the original agreement with NES for bus stop cleaning and maintenance services. The initial term of the contract was four years, with an option to extend it for one additional year at the City’s discretion. On September 29, 2023, the City exercised the option and extended the term of the contract for one year; the current contract expires September 30, 2024.

At the September 24, 2024 City Council Meeting, City staff presented the City Council with a professional services agreement with JoncoW est for Citywide bus stop cleaning and maintenance services. The City Council asked staff to return at a future City Council meeting with additional information regarding the proposals and in the meantime enter into a month-to-month agreement with NES until the item is returned.

Staff contacted NES to enter into a 1-month extension of the agreement. NES agreed to continue to provide services at the current rate..

The PSA is for the cleaning services at 157 City and Metro- Shared bus shelters throughout the City which include shelters, benches, signs and trash receptacles.

Services include removal of all surface graffiti, stickers, markings, trash and debris from all bus stop areas on a weekly basis and steam cleaning and pressure washing of all bus stop furniture and hardscapes to remove gum, grease and stain once a month.

ANALYSIS

Per the City’s Purchasing Policy, on July 1, 2024, Public Works staff advertised a Request for Proposals (RFP) on PlanetBids. A total of 378 prospective proposers received the notification of the RFP. Of these prospective proposers, 49 firms downloaded the RFP. Proposals were due on August 9, 2024. A total of 11 firms submitted proposals:

The RFP outlined the City’s desire to seek a qualified service provider with a proven track record of providing quality pressure washing and cleaning maintenance services to municipalities and commercial clients throughout Southern California.. A demonstrated experience changing out trash cans, cleaning surfaces, removing stickers, gum, grease, and using pressure washing equipment on sidewalks, walls, and trash cans matches the tasks to maintain a bus shelter. As such, the proposals were reviewed and evaluated based on the firm’s relevant experience, expertise, qualifications, staffing levels, understanding of the City’s service needs and expectations, proven performance, completeness of the proposal, references, and cost- effectiveness.

Additionally, as part of the evaluation process, firms were checked against the Department of Industrial Relations for “active” status. It should be noted that a contractor’s license with the California State Contractors Board is not required for this work. The Board has a designated license for Sand and Water Blasting (D-38 license) that is intended for the use of high-pressure application of sand or water to remove coatings such as paint from a surface in the preparation of applying new coatings. This license is not required for the use of pressure washing to remove dirt, grease, gum, stickers, and graffiti paint from sidewalks, poles, trash cans, and walls for the purpose of cleaning. For this reason, the RFP did not require this license for this contract. Instead, the evaluation focused on relevant experience pressure washing and cleaning of municipal and commercial facilities, including sidewalks, in high-traffic areas.

Additionally, while no business is immune to litigation, the RFP a requested that all firms submit a 5-year history of any litigation that has resulted in a judgment against or settlements by the firm. This helps identify any possible wrong doings by a firm and the firm’s financial feasibility of carrying through with the requested work, Staff reviewed the history for the top 5 firms, and none had litigation resulting in judgments or settlements.

Based on these criteria and proposal review, a committee made of Public Works staff, , evaluated the proposals and developed the following rankings:

1. JoncoW est

2. Webco

3. Parkwood Landscape Maintenance

4. Nationwide Environmental Services (NES)

The top candidates all demonstrated significant experience providing pressure washing and cleaning services. In the case of JoncoWest, their municipal cleaning service includes pressure washing several blocks of the downtown commercial, shopping, and beach districts along major corridors in the City of Santa Barbara, a highly trafficked tourist community for shoppers and beach-goers. These services include pressure washing sidewalks, bus and tourist benches, trash cans, as well as the removal of graffiti, stickers, grease, gum, and biohazardous waste.

JoncoW est submitted the most comprehensive and cost-effective proposal. Of all proposers, they provided the most detailed description of their methodology for pressure washing and they have provided detailed specifications of all the equipment they use, as well as the training their staff goes through to perform the services. They demonstrated a good understanding of the City’s service needs; proposed the most effective scope of services and approach; assembled the most qualified and appropriate staffing levels; and successfully provided similar cleaning and maintenance services to the City of Santa Barbara, City of Pasadena, California Department of Motor Vehicles, and California Highway Patrol Inland Empire. Staff contacted these agencies and each shared their satisfaction with JoncoWest. JoncoWest also has significant experience at heavily trafficked commercial facilities such as Sam’s Club and 99 Cent Store locations in Southern California, including pressure washing sidewalks, walls, trash cans, benches, and parking lots.

JoncoW est is the City’s current janitorial service provider. They have been providing satisfactory janitorial services for the last six months. They have been responsive to staff requests and have actively worked with staff to address issues as they arise. Staff recommends that the City Council approve a services agreement with JoncoWest for the bus stop cleaning and maintenance services.

As stated previously, the top five firms all have solid experience when it comes to pressure washing and cleaning services, but JoncoWest distinguished their proposal on price. Staff evaluated their proposed cost of $90,300 to perform maintenance services at 157 bus stop locations throughout the City and found that the labor hours needed to complete the work and service the contract would be sufficiently covered by the cost they would be invoicing the City. This cost would also adequately cover any material and overhead costs incurred by JoncoWest.

The agreement's initial term is two years, commencing November 1, 2024, with an option to renew for three additional one-year periods.
