BACKGROUND

Veteran’s Stand Together (VST) is a non-profit organization focused on empowering veterans and their communities through cooperation, support, and advocacy. VST tackles veteran integration, homelessness, mental health, and substance abuse through their comprehensive resource support program: the proprietary Milestone System.

In the past VST has partnered with Bastards American Canteen (BAC), who has a fixed business location at 11045 Downey Avenue, to bring this fundraising event to the community of Downey. BAS has held events in the past in honor of military veterans both

on private and public property. This year’s street closure request encompasses an area larger than last year’s event.

ANALYSIS

On October 3, 2024, the City received a street closure request to close Downey Avenue from 2nd Street to 4th Street and to close 3rd Street from New Street to the end of the US Bank Building. The closure will accommodate the Annual Marine Corps Birthday and Veterans Day Celebration Fundraiser Event scheduled from 12:00 p.m. – 10:00 p.m. on Sunday, November 10, 2024. The street closure would take place from Saturday, November 9, 2024, beginning at 8:00 a.m. and ending on Monday, November 11, 2024, at 2:00 a.m.

The event includes Veteran resources, food vendors, a music stage with live entertainment, and a beer garden. The majority of the event would be held on the public- right-of way and would necessitate the requested street closure. The applicant has proposed to limit the event to a target audience of 21 years of age and over. The Street closure would be completely enclosed with fencing, thereby designating the area as a beer garden in order to meet the State of California Department of Alcoholic Beverage Control (ABC) license requirements per the attached site plan (Attachment B). The number of anticipated participants is expected to reach up to 1,000 people.

The event organizers would be responsible for the complete set-up and breakdown of the beer garden fencing including the implementation of the street closure using a professional and licensed traffic control company approved by the Public Works Department. The street closure would be conditioned to require that the applicant notify the affected Downtown Downey businesses and notify the Downtown Downey Improvement Association (DDIA), specifically those directly adjacent to the street closure on Downey Avenue, 2nd, 3rd, and 4th Streets.

As with all Special Use Permits, fees are required of the applicant to receive required permits. Fees for this event are outlined in ‘Table 1’ below.

The City permit costs and labor costs associated with the street closure are as follows:

The City’s Development Review Committee (DRC), which is made up of representatives from the Police, Fire, Public Works, and Community Development Departments, has reviewed the site layout proposed for the event and have provided standard conditions to ensure the event will not cause adverse impacts on the health or safety of surrounding users. Those conditions include, but are not limited to, providing trash receptacles, portable restrooms, security guards, police officers, placement of road closure signs; approval from the Los Angeles County Health Department permits for food vendors, and assurance that the event site is to be properly restored to its previous state. Lastly, “No Parking” signs will be posted along Downey Avenue and 3rd Street 72 hours in advance of the street closure. The recommended conditions of approval have been included in “Attachment D.”

At the July 23, 2024, City Council meeting, Council adopted the Fee Waiver, Table Sponsorship, Foursome Golf Voucher Donation, and Showmobile Use Policy for Non- Profit Organizations. Per this policy, there has been a deduction of 50% applied to all eligible fees, as specified in Section 2.A of the policy. The total amount of fees waived equals to $2,587.82. The City’s non-profit fee waiver has not been applied to the Planning Division’s special event permit application fee of $234 as this fee is set to a discounted price specific to non-profit organizations.
