EXECUTIVE SUMMARY

The City Council will conduct the sixth public hearing to consider and discuss the transition from the City’s current election system consisting of four individual districts and one at-large district to an election system consisting of five individual districts, in furtherance of the California Voting Rights Act and pursuant to State law. Over the first two public hearings held on January 14, 2025, and January 28, 2025, the City Council voted unanimously to implement a five-district system instead of a four-district election system with an at-large elected mayor, either as permitted by law. At the third public hearing held on February 25, 2025, the Council reviewed draft district maps for adoption and, by majority vote, preliminarily selected Map No. 104 for adoption. At the fourth public hearing held on March 11, 2025, the City Council provided input to the City’s demographic consultant for the preparation of additional maps and voted to continue the matter to another public hearing. At the fifth public hearing on April 8, 2025, the Council identified eight maps as focus maps for further discussion. At tonight’s public hearing, the Council will review the focus maps and any others, and if a map is selected, may introduce an ordinance based on the selected map. If an ordinance is introduced, the City Council will also need to confirm when the new district boundaries would take effect.

RECOMMENDATION

That the City Council:

1. Hold the sixth public hearing to consider any public input and to discuss the transition to an election system consisting of five individual districts;

2. Conduct further review of draft district maps, including the focus maps, and finalize selection of map for adoption or, alternatively, continue discussion at a further public hearing; and,

3. If a map is selected, based on that map, introduce an Ordinance amending Downey Municipal Code Section 2103 regarding election by five districts, defining district boundaries, and scheduling elections within the districts, pursuant to the California Voting Rights Act.

BACKGROUND

The City of Downey currently elects its five-member City Council through a mixed election system combining four individual districts and one at-large district. For each of the individual districts (1 through 4), each council candidate must reside in the district they represent and only voters within that district may vote for that district’s councilmember.

District 5, however, is an at-large district comprised of the entire City. This means that a council candidate for District 5 may reside anywhere in the City’s jurisdictional boundaries, and voters residing anywhere in the City may vote for that councilmember.

The City’s Mayor is not directly elected. Like many cities, the Mayor, as well as the Mayor Pro Tem, are selected annually by and among the members of the City Council to serve for a period of one year.

On October 3, 2024, on behalf of a potential plaintiff, the City received a letter from the law firm of Sarega Law, APC, alleging that the City’s election system violates the California Voting Rights Act (CVRA) because it contains an at-large voting district. The CVRA became law in 2003 and is intended to prevent the disenfranchisement of protected classes, meaning a class of voters who are members of a race, color, or language minority group. Under the CVRA, an at-large method of election may not be imposed or applied in a manner that impairs the ability of a protected class to elect candidates of its choice or its ability to influence the outcome of an election.

The CVRA considers a method of election to be at -large when it combines at-large elections with district-based elections (like Downey’s). The CVRA does not mandate the abolition of all at-large election systems but makes the use of at-large election systems more susceptible to legal challenge. The most common legal remedy for an alleged CVRA violation is to change from an at-large system to a by-district election system, or in Downey’s case, to either an entirely five district system or a four-district system with an at-large separately elected mayor, either of which is authorized by state law.

On November 12, 2024, the City Council adopted Resolution No. 24 -8277 declaring its intention to transition to either a five -district election system or a four-district election system with an at-large elected mayor (a “4+1” system) by the November 2028 General Municipal Election. Under state law, when a city adopts such a resolution, a CVRA plaintiff is barred from filing a lawsuit challenging the current election system for at least 90 days following the passage of the resolution in order to permit the consideration and adoption of an ordinance establishing either a five-district electoral system or a 4+1 system.

Tonight’s public hearing is the sixth hearing prior to the adoption of such an ordinance; at least four are required by California Elections Code Section 10010. By agreement with counsel for the prospective plaintiff in any potential CVRA lawsuit, the deadline to adopt the ordinance has been extended for 90 additional days, or until May 13, 2025.

DISCUSSION

As noted above, the City Council declared its intention to transition to a five -district election system or a 4+1 system and then, over the course of two public hearings held on January 14, 2025 and January 28, 2025, voted unanimously to implement a five -district system.

Preparation and Publication of Draft District Maps

The National Demographics Corporation was retained by the City to prepare draft district maps for consideration at the third, fourth, and fifth public hearings, and tonight’s public hearing. Under State and federal law, each district must be as nearly equal in population as possible, using the data from the most recent census. The districts must also be prepared in compliance with specific State and federal requirements, including consideration of contiguity, compactness, communities of interest, and natural geographic boundaries. Members of the public could submit draft maps for review as well.

State law is clear that no change in district boundaries may shorten or affect the current term of an incumbent Councilmember, each of whom shall continue to serve for the duration of their term of office. This means that no term of any current council member may be shortened by the transition in the City’s election system. At the Council’s direction, the change to five districts is proposed to occur either in the November 2026 or November 2028 elections.

The City must publish and make the draft district maps available to the public, and the Council must hold at least two public hearings to consider them over a period of no more than 45 days, during which the public will be able to provide input regarding the draft

maps. The first draft maps must be published at least seven days before they are considered at a public hearing. If a map is revised at or during a hearing, it must be published again and made available to the public for at least seven days before being adopted.

Public Hearing for Consideration of Maps: Tonight
(prior hearings for map consideration were held on February 25, March 11, and April 8)

While in total there remain 22 draft maps presented for review at tonight’s hearing, the focus maps are those 8 maps identified by the City Council at the April 8 meeting: Map Nos. 101, 102, 105, 106, 110, 113, Lam1, and Lam9. Map Nos. 101, 102, 106, 110, and 113 were prepared by the City’s demographer, and Map Nos. 105, Lam1, and Lam9 were submitted by members of the public. All maps are attached (Attachment A) and were posted to the City’s website on or before Tuesday, April 15 as required by law. Under the CVRA, maps are required to be posted for seven (7) days prior to any hearing at which maps will be formally considered. No new maps were received by the public for tonight’s hearing.

At tonight’s hearing, the Council may select a map, or p rovide more input and direction for changes to any particular map(s) that would then be discussed and reviewed at a further public hearing. If a map is selected, the City Council will also need to confirm when the new district boundaries would take effect, either at the November 2026 or November 2028 General Municipal Election.

Introduction of Ordinance Implementing Five District Election System with New District Boundaries

If a map is selected for adoption tonight, the Council would then introduce an ordinance establishing a five-district election system with the new district boundaries and when those boundaries would take effect (Attachment B). The current deadline to adopt such an ordinance is May 13, 2025. If no map is selected tonight and/or if discussion is continued, additional public hearings will be held for this purpose.

This type of ordinance is not required to be considered by voters at an election. Under state law, local legislative bodies are authorized to adopt an ordinance requiring members of the legislative body to be elected entirely by-district without voter approval, if the change in the method of election is being made in furtherance of the CVRA, as is the case here.

Attorney’s Fees

Within 30 days of the adoption of an ordinance establishing a new election system, a prospective plaintiff may request reimbursement for the cost of the work product generated to support the original notice of violation of the CVRA. This demand must be made in writing and substantiated with financial documentation. Counsel for the prospective plaintiff has already made a demand in the amount of $25,300 and has been advised that his request will be considered following the adoption of the ordinance, in accordance with California Elections Code Section 10010. Reimbur sement is based on the financial documentation alone but also is capped under the law at an indexed $30,000, which as adjusted for inflation, currently amounts to approximately $36,000.

Counsel has not yet provided any documentation for evaluation but will be required to do so before any reimbursement is considered.

Public Engagement

To increase public awareness of the transition in the City’s election system, the City has been using a variety of public communication channels to engage the community.

Information has been featured on the City’s website at www.downeyca.org and on social media, including instructions on how to submit a draft map. The public is also encouraged to provide input by e-mail to [email protected], or by hand-delivery or U.S. mail to the City Clerk’s office.

FISCAL IMPACT

While no additional costs are connected to this specific step of the CVRA districting process, with the Council’s decision to implement a five-district system, an expert demographer was retained to prepare the draft district maps. That cost will be approximately $50,000, and will be taken from the elections account number 10 -1135- 0700. Additionally, the City could be responsible for attorney’s fees and costs for a maximum amount of approximately $36,000.

Subject: Map Submission for Downey 2025 Redistricting - Faraz Aqil Hello City of Downey. My name is Faraz Aqil, I'm a resident of Downey, and I submitted a redistricting map online. Here is the link: https://davesredistricting.org/join/bb5e4b12- c639-437f-bb8c-59ee38180079
And here is the description for my map. Thank you very much:

Hello Downey City Council. My name is Faraz Aqil, I’m a resident of Downey who lives in the Apollo Park Neighborhood. While this map does take inspiration from Map 101, I made this map in particular based on the feedback from all the city councilmembers during the 02/25/25 city hall meeting. Here is the best I can do to address the concerns I heard:
*Councilmember Dorothy Pemberton concern was that she wanted a map that allowed residents to be in a specific area to campaign so that they’ll need less funding/resources to run for an election. This map has clear boundaries (it’s delineated by major streets) and covers smaller areas in the city when compared to map 104. Map 104 has District B which crosses from Rancho Los Amigos South Campus to near Downey Gateway/Porto’s in the Downtown area. And Map 104’s District E crosses from the Lakewood Blvd. C (Green) Line Train Station (105 FWY) to Honda World at Florence Ave. My proposed map areas are more compact, don’t cross throughout the city and can easily be divided into: south-west, south- east, north-west, north-east, & central Downey.
*Councilmember Claudia Frometa had a concern about not breaking up neighborhoods & to following major streets. This map keeps many neighborhoods intact and follows along major/busy streets. And I made sure to address the concern of Map 101 crossing over the Firestone Blvd’s railroad tracks by making my map’s Firestone Blvd be the dividing line between District B and C & Districts A and D. And although I couldn’t fully address her concern about 1 district being mainly in Downtown Downey, I was able to delegate some of the Downtown area into her District D since District D was in need of more population (the area between Downey Ave & Lakewood Blvd to Florence Ave & 5th Street). *Mayor Hector Sosa also wanted boundaries to follow major streets (which this map does better than Map 104). Also the Mayor was concerned about the high concentration of Downtown Downey into 1 District. So in my map I made District E more stretched into Imperial Hwy and it gives part of Downtown Downey to District D. Also I wanted to politely say that as resident of the current District 2 (in your district), I absolutely do not like how Map 104 is dividing up my community in the Paramount Blvd/Imperial Hwy area. Map 104

divides up Los Amigos North Campus & South Campus (the future Southeast Gateway train station), and divides up Apollo Park residents that live south-west & south-east of Apollo Park & the Barbara Community Senior Center. I think Map 104 would harm my community’s representation in city hall and Map 104’s District A & E (in my opinion) are not compact. In my map, although District E does go to Paramount Blvd/Imperial Hwy, I made sure District E was compact (no T shape like in Map 104’s District A), it keeps Rancho Los Amigos North/South Campus together, and keeps the Apollo Park neighborhood intact. *Councilmember Horacio Ortiz concern was that his district would dramatically change too much. My map follows the current city council map structure by delegating each district to a corner of the city. District 1 would be represented by the south-east District A.

Everything else population-wise is still well balanced. Again, my map's Districts are following major main streets without trying to break up neighborhoods. Thank you for your time in reading this.
1) District A:
*Total Populations: 23,188 (Deviation +246)
*Major Streets: Firestone Blvd/Lakewood Blvd to Lakewood Blvd/Imperial Hwy. And Imperial Hwy/Brookshire Ave.
2) District B:
*Total Population: 22,424 (Deviation of -518)
*Major Streets: Imperial Hwy./Brookshire Ave. to Imperial Hwy/Paramount Blvd. And Paramount Blvd/Firestone Blvd.
3) District C:
*Total Population: 22,755 (Deviation: -187)
*Major Streets: Paramount Blvd/Firestone Blvd to Paramount Blvd/Florence Ave. It then goes to Downey Ave/Florence Ave. and Downey Ave/Gallatin Rd. And finishes at Lakewood Blvd/Gallatin Rd & Lakewood Blvd/Telegraph Rd.
4) District D:
*Total Population: 22,582 (Deviation: -360)
*Major Streets: Lakewood Blvd/Telegraph Rd to Lakewood Blvd/Firestone Blvd (but due to needing more people, I extended this district to Downey Ave. by including the areas

between Downey Ave/Gallatin Rd & Downey Ave/5th Street [which becomes Cecilia St, a street used by many to get to Stonewood Mall in the back]). 5) District E:
*Total Population: 23,763 (Deviation: +821)
*Major Streets: Imperial Hwy/Paramount Blvd to Imperial Hwy/Lakewood Blvd. Florence Ave/Paramount Blvd to Florence Ave/Downey Ave. And finally Downey Ave/5th Street to Lakewood Blvd/5th Street

Subject: Bill's Downey 2025 Districting with 5 Single Member District Map Hi I want to comment on thanking the council on changing the Downey election system in which I am strongly supporting the 5-district election system because everybody should take turns becoming Mayor and Mayor Pro Tem. The new 5th district would be converted from At-Large citywide to a new district-based system in which the new 5th district seat should be placed at the central area of Downey because the central area of Downey is considered to be a better and stronger community of interest when it comes to districting. I have attached 8 of my own proposed maps as well as the link below where District 5 is going to be placed on the central area of Downey since the city decided to go with the 5-district system. In regards to the sequencing of the 5-district system, the sequencing of all 8 of my proposed maps below would remain the same where Districts 1, 3, and 5 would continue to be held along with the presidential election every 4 years(2028, 2032, 2036, etc.) while Districts 2 and 4 would continue to be held along with the state governor's election every 4 years(2026, 2030, 2034, etc.).

Here are my 8 proposed maps since Downey chooses the 5-district system(below I forgot to add my name an all 8 of them and it should be Bill's Downey 2025 Districting with 5 Single Member District Map):

ORDINANCE NO. 2025-____

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING DOWNEY MUNICIPAL CODE SECTION 2103 REGARDING

ELECTION BY FIVE DISTRICTS, DEFINING DISTRICT BOUNDARIES,

AND SCHEDULING ELECTIONS WITHIN THE DISTRICTS, PURSUANT

TO THE CALIFORNIA VOTING RIGHTS ACT

WHEREAS, the City Council of the City of Downey is an elected legislative and deliberative public body serving the citizens of the City of Downey, a California charter city; and

WHEREAS, the City presently has a “mixed” election system, whereby Districts 1 through 4 divide the City into geographical districts and District 5 is an “at-large district” providing Citywide representation on the City Council; and

WHEREAS, Downey does not currently have a directly elected Mayor but rather the City Council appoints the Mayor to serve annually; and

WHEREAS, in 2003, the California Voting Rights Act (“CVRA”) became law, and in an attempt to prevent the disenfranchisement of protected classes of persons, establishes a low bar for attorneys and other persons seeking to compel cities and other public entities to convert from at-large to by-district elections; and

WHEREAS, the CVRA considers a method of election to be at-large when it combines at-large elections with district-based elections (like Downey’s); and

WHEREAS, public agencies that have been sued under the CVRA have typically been forced to pay large sums to settle with plaintiffs’ attorneys; and

WHEREAS, on October 3, 2024, the City received a letter from the law firm of Sarega Law APC, alleging that the City’s current mixed election system contains an “at large” element in District 5 and therefore violates the CVRA, and demanding that the City change its election system; and

WHEREAS, to avoid the high costs and legal risks associated with a CVRA lawsuit, on November 12, 2024, the City Council adopted Resolution No. 24-8277 declaring its intention to transition to either a pure five-district election system or a four- district election system with an at-large elected mayor by the November 2028 General Municipal Election; and

WHEREAS, in accordance with California Elections Code Section 10010, the City Council held two “pre-map” public hearings on January 14, 2025 and January 28, 2025 to obtain public input regarding the proposed transition, including the boundaries of the districts, and over the course of these hearings, voted unanimously to implement a five- district system that would change District 5 from its current citywide geography into a discrete portion of the City like current Districts 1 through 4; and

Ordinance No. 25-___

Page 2 ends

WHEREAS, the City engaged an expert demographic firm to assist the City with the process of analyzing the City’s population, gathering input from residents, and preparing draft district maps for consideration by the City Council that are legally compliant with applicable state and federal guidelines; and

WHEREAS, in accordance with California Elections Code Section 10100, the City Council held four “post-map” public hearings on February 25, 2025, March 11, 2025, April 8, 2025, and April 22, 2025 to consider and review the draft district maps, including any maps or other input that were submitted by members of the public; and

WHEREAS, at the public hearing held on April 22, 2025, the City Council selected Map No. ____ for adoption and, based on that map, introduced this Ordinance for adoption; and

WHEREAS, California Government Code Section 34886 permits the City Council to adopt an ordinance requiring the members of the legislative body to be elected completely by district or by district with an elective mayor, without having to submit the ordinance to the voters for approval; and

WHEREAS, pursuant to California Government Code section 34886, it is declared that the purpose of the change in the method of electing members of the City Council of the City of Downey made by this Ordinance is to implement the guarantees of Section 7 of Article I and of Section 2 of Article II of the California Constitution, as set forth in the California Voting Rights Act (Sections 14025 through 14032 of the California Elections Code).

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY
DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The City Council finds that all of the foregoing recitals are true and correct and are hereby incorporated and adopted as findings of the City Council as if fully set forth herein.

SECTION 2. Section 2103 (Council Members: Election by Districts) of Article II (Administration) of the Downey Municipal Code is amended to read in its entirety as follows:

§ 2103. COUNCIL MEMBERS: ELECTION BY DISTRICTS.

A person appointed or elected to fill such a vacancy shall hold the office in accordance with State law.

(b) Commencing with the November _____ General Municipal Election, all five Councilmembers shall be elected on a “by-district” basis from the Council districts shown and numbered on the map titled “City of Downey District Map” attached as Exhibit A, a copy of which shall be on file in the City Clerk’s office. CEQA Guidelines Sections 15061(b)(3) and 15378(b)(5). In the event adoption of this Ordinance does constitute a project, it is categorically exempt under the Class 20 (Changes in Organization of Local Agencies) categorical exemption. CEQA Guidelines Section 15320.

SECTION 4. If necessary to facilitate the implementation of this Ordinance, the City Clerk is authorized to make technical adjustments to the district boundaries that do not substantively affect the populations in the districts, the eligibility of candidates, or the residence of elected officials within any district. The City Clerk shall consult with the City Manager and City Attorney concerning any technical adjustments deemed necessary and shall advise the City Council of any such adjustments required in the implementation of the districts.

SECTION 5. If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is declared by a court of competent jurisdiction to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining portions of this Ordinance or any part thereof. The City Council declares that it would have adopted this Ordinance, and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
