SUBJECT: AWARD OF CONSTRUCTION CONTRACT FOR THE FIRESTONE
BOULEVARD AT LAKEWOOD BOULEVARD INTERSECTION
IMPROVEMENT PROJECT, CAPITAL IMPROVEMENT PROJECT (CIP)
NO. 14-09
EXECUTIVE SUMMARY
The City Council will consider approving a contract agreement with Palp, Inc. dba Excel Paving Company for the construction of the Firestone Boulevard at Lakewood Boulevard Intersection Improvement Project in order to increase capacity, enhance safety and improvement the infrastructure at said intersection.
RECOMMENDATION
That the City Council:
1.Reject the bid submitted by Aneen Construction, Inc.;
2. Award Capital Improvement Project No. 14-09 to Palp, Inc. dba Excel Paving Company, the lowest responsive, responsible bidder, for the total bid amount of $4,288,700.00 and waive any and all minor irregularities in the bidding documents as submitted by said bidder; and,
3.Authorize the City Manager, or his designee, to execute the construction contract with Palp, Inc. dba Excel Paving Company in the amount of $4,288,700.00, including any non-substantive extensions, change orders, purchase orders and amendments up to the authorized budget amount of $4,717,570.
BACKGROUND
The Firestone Boulevard at Lakewood Boulevard intersection (Attachment A) currently accommodates an average daily traffic (ADT) volume of approximately 82,000 vehicles

per day (VPD) with existing Levels of Service (LOS) of “E” and “F” during AM and PM peak hours, respectively. The traffic volume at the intersection is expected to increase by a minimum of eight (8) percent to approximately 88,375 VPD by year 2035. As such, it is expected that the LOS during AM and PM peak hours will further deteriorate with congestion and delay worsening for motorists without improvements to the intersection.
In addition, the existing left-turn pockets on Lakewood Boulevard frequently overflow and block the adjacent through lane, thus, negatively affecting capacity at the intersection.
The purpose of this project is to improve traffic circulation and mobility within the I-605 Freeway corridor by minimizing congestion along the Firestone Boulevard and Lakewood Boulevard corridors, thereby increasing capacity and improving operations at the intersection during peak hours by year 2035. The improvements include the installation of additional left-turn lanes in the northbound and southbound directions at this intersection on Lakewood Boulevard.
ANALYSIS
The proposed improvements to the intersection include the reconstruction of the intersection and approaches in concrete pavement, resurfacing the remainder of the pavement within the project limits in asphalt concrete, the construction of additional left- turn lanes in the northbound and southbound directions on Lakewood Boulevard; modifications of the existing median islands including the placement of decorative rock material within the median noses and replacement of landscaping plant material; modification of the traffic signal and lighting and irrigation systems; installation of custom city bus shelters and trash receptacles; and the replacement of striping, pavement markings, and signage.
The project was posted on Planet Bids on March 24, 2025, advertised in the Downey Patriot on March 27, 2025 and April 3, 2025 and published in various trade publications.
On April 10, 2025, the City received three bids electronically through Planet Bids ranging from $4,151,408.85 to $5,324,096.90. The bid results were as follows:
CONTRACTOR LOCATION BID AMOUNT
Aneen Construction, Inc. Riverside Nonresponsive
Palp, Inc. dba Excel Paving Company Long Beach $4,288,700 Sequel Contractors, Inc. Santa Fe Springs $5,324,097
Based on a review of the bids submitted, staff determined that the bid submitted by Aneen Construction, Inc. was unresponsive for the following reasons:
1. A signed copy of the addendum issued for this project was not included in the bid.

BOULEVARD INTERSECTION IMPROVEMENT PROJECT, CAPITAL IMPROVEMENT PROJECT (CIP) NO. 14-09
MAY 27, 2025

2. The contractor’s bid bond and bid proposal lacked notarized signatures from the contractor.
3. Per the Bidder’s Qualifications Statement included in the contractor’s bid proposal, the contractor, as a prime contractor for a public agency, must have completed a minimum of three projects similar in scope to this project within the last three years and each of the three projects must be approximately 75 percent of the total contract amount bid under this project. The three projects listed by the contractor had contract amounts listed as $2.7 million, $1.5 million and $1.5 million, respectively. Each of the three amounts fall well below $3,113,557, which is 75 percent of the contract amount bid of $4,151,409.
4. The Designation of Subcontractors form within the contractor’s bid proposal did not include subcontractors for the traffic striping/signage and landscaping/irrigation items pertaining to the project. Per the project specifications, if the contractor fails to specify a subcontractor for work to be performed under the contract in excess of one-half percent of the contractor’s total bid or $10,000, whichever is greater, the contractor agrees that he/she is fully qualified to perform that portion of the work himself/herself and that he/she shall perform the work himself/herself. The contactor failed, however, to demonstrate that they were qualified to perform these portions of the work.
In consideration of the above facts, staff recommends the rejection of the bid submitted by the low bidder and awarding the project to the second low apparent bidder, Palp, Inc. dba Excel Paving Company in the amount of $4,288,700 (Attachment C). Staff reviewed the bid submitted by Palp, Inc. dba Excel Paving Company and confirmed their bid is responsive and found that said contractor has satisfactorily completed similar projects for the Cities of Anaheim, Huntington Park, Santa Monica and the County of Orange. Palp, Inc. dba Excel Paving Company’s state contractor’s license is “current and active,” and said contractor is registered with the California Department of Industrial Relations (DIR) for Labor Compliance.
Therefore, staff Recommends that the City Council award a contract to Palp, Inc. dba Excel Paving Company for the construction of the Firestone Boulevard at Lakewood Boulevard Intersection Improvement Project, Capital Improvement Project No. 14-09.
Construction is anticipated to begin in June 2025 and be completed by December 2025.
Staff will be issuing traffic notices to the public ahead of the start of construction, as well as during the entire project timeline, through the City’s website, and via social media.
Businesses immediately impacted by the work will receive targeted notifications, as well.
This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301(c), Existing Facilities.
