SUBJECT: APPROVAL OF AGREEMENTS TO PURCHASE REAL
PROPERTY AT 13407 AND 13413 LAKEWOOD BOULEVARD
EXECUTIVE SUMMARY
The City Council will consider approving agreements to purchase real property at 13407 and 13413 Lakewood Blvd. in order to acquire portions of said properties and temporary construction easements to widen the sidewalk on the west side of Lakewood Boulevard to achieve the required sidewalk width required per Americans with Disabilities Act (ADA) standards.
RECOMMENDATION
That the City Council:
1.Authorize the Mayor to execute the Agreement to Purchase Real Property with Jay Shivshankar, LLC in the amount of $3,332, including any non-substantive amendments, up to the approved budget amount of $6,000, for the purchase of partial fee and temporary construction easement for the property located at 13407 Lakewood Boulevard; and,
2.Authorize the Mayor to execute the Agreement to Purchase Real Property with Jyotsanaben N. Patel, as a trustee for the Patel Family Trust dated December 11, 2009, in the amount of $5,404, including any non-substantive amendments, up to the approved budget amount of $6,000, for the purchase of partial fee and temporary construction easement for the property located at 13413 Lakewood Boulevard.
BACKGROUND
Lakewood Boulevard, formerly known as State Route 19, between Gardendale Street and Century Boulevard (west side only) was relinquished by the State Department of Transportation (Caltrans) to the City in 2019. As a condition of assuming ownership of the west side of this portion of Lakewood Boulevard, the City was given a one-time sum of $750,000 by Caltrans towards the cost of upgrading the traffic signal at the intersection

of Lakewood Boulevard at Gardendale Street as well as upgrading the pedestrian circulation infrastructure (i.e., sidewalks, curb ramps, drive approaches, etc.) along this portion of Lakewood Boulevard in order to achieve compliance with the Americans with Disabilities Act (ADA) and the City’s ADA Transition Plan. The east side of this portion of Lakewood Boulevard is located within the City of Bellflower, to which Caltrans relinquished said portion of the roadway to the City of Bellflower in 2019.
The traffic signal at the Gardendale Street intersection has since been upgraded and the next step will be to implement the pedestrian infrastructure improvements along the west side of Lakewood Boulevard between Gardendale Street and Century Boulevard, consisting of the construction of new sidewalk along the west side of the Lakewood Boulevard frontage road between the northern end of the frontage road located approximately 285 feet south of Gardendale Street and the southern end, located approximately 200 feet south of Deming Avenue. Said improvements will be completed through a capital improvement project referred to as the Lakewood Boulevard Pedestrian Improvement Project (Gardendale Street to Century Boulevard). In addition, the existing sidewalk between Rosecrans Avenue and the southern end of the frontage road adjacent to the commercial properties currently has five locations at 13331, 13343, 13407, 13413 and 13417-13441 Lakewood Boulevard where the width is constrained by utility poles, cabinets and other appurtenances. The sidewalk will be widened at these locations as part of the Pedestrian Improvement Project to ADA standards.
In order to increase the width of the sidewalk at the five aforementioned locations to meet ADA requirements, the acquisition of a small portion of each property along with temporary construction easements (TCEs) will be necessary. Property appraisals have been completed for the proposed acquisitions and offers to purchase the acquisitions, as proposed, have been submitted to the various owners. Two of the five property owners at 13407 and 13413 Lakewood Boulevard have agreed to the offer amounts of $3,332 and $5,404, respectively, to purchase the partial fee (property) and TCE acquisitions and have signed the purchase agreements. The locations of the two properties are shown on Attachment A. The specific locations of the proposed property and TCE acquisitions for the two properties are shown on Attachment B. The three remaining properties, from which partial acquisitions and TCEs will also be required, will be brought before the City Council for approval on future upcoming dates.
ANALYSIS
The approval of the agreements in Attachments C and D will be necessary in order for the purchases of the partial property and TCE acquisitions at 13407 and 13413 Lakewood Boulevard to occur. Following the approval of the agreements, the property and TCE acquisitions will then go through the escrow process and the City will take possession of the portions of said properties and TCEs approximately 30 days following the opening of escrow.

The Lakewood Boulevard Pedestrian Improvement Project is estimated to begin in fall 2025 with completion estimated by February 2026. This project is exempt from the California Environmental Quality Act (CEQA) under Section 15301(c), existing facilities.

FISCAL IMPACT
Approval of the recommended action(s) will result in an expenditure of $8,736 in Proposition C Local Return funds in Account No. 54-16769 as previously approved in the FY 2024-25 Capital Improvement Program. There is sufficient fund balance for the recommended actions.
