The City Council will consider accepting the delivery of a 2024 Pierce Enforcer fire truck This apparatus has been fully outfitted and ready for service as a frontline truck company serving the City out of Fire Station 1
RECOMMENDATION
That the City Council
1. Accept the delivery of a 2024 Pierce Enforcer tractor-drawn aerial fire truck and sign the Acceptance Certificate in accordance with the Master Equipment Lease Purchase Agreement
2. Appropriate $8,395 from the General Fund to account for changes in the sales tax rate between the time of ordering to delivery
BACKGROUND
On May 10, 2022, the City Council approved the purchase of a new tractor drawn aerial fire truck. The truck was designed and built by Pierce Manufacturing. In May 2025, the construction of the truck was completed and final outfitting commenced. On August 3 2025, the new fire truck was ready for service
ANALYSIS
Downey Fire Department maintains a fleet of emergency response apparatus, providing comprehensive fire and life safety services to the community. To meet the unique needs of the City, these vehicles are fully customized in both design and construction. The new fire truck, identified as Truck 611, is a highly specialized apparatus that has been built to strict specifications to not only support the public safety mission of the Downey Fire Department, but to provide decades of service to the City,

This most recent addition to the Downey Fire Department fleet, built by Pierce Manufacturing, replaces the 2005 fire truck that was at its end of life. The new fire truck features a 107' aerial ladder, allowing access to the tallest buildings in Downey. Staffed by a crew of four trained firefighters, this truck will serve the City when on emergency incidents that require technical rescue or expanded firefighting operations.
The standard frontline service life of this type of apparatus is 20 years. The previous truck will be placed into reserve status and used when the new truck is out of service for maintenance or repairs. This enhancement in the fleet of apparatus will ensure that Downey Fire Department continues to provide the highest standard of service with no interruptions.
The cost of this apparatus was fully prepaid in the amount of $1,851,095 in May of 2022 using Measure S funds. Paying upfront allowed the City to take advantage of a prepayment discount of $65,484. Sales tax calculations in the State of California are made at the time of vehicle delivery. When ordered, the City of Downey sales tax was 10%. In the ensuing time, increases in sales tax to 10.5% require the increased balance to be paid. The difference, in the amount of $8,395, reflects the 0.25% Measure D sales tax increase as well as the Los Angeles County Measure A sales tax increase of 0.25%

FISCAL IMPACT
Approval of the recommended actions will result in an appropriation from Measure D Operating Funds in the amount of $8,395 to the Fire Suppression Automotive account (14-4-2610-0210) operating budget for FY. There is sufficient fund balance for the recommended actions

All of the Equipment (as such term is defined in the Agreement) listed in the above referenced Schedule of Equipment (the "Schedule") has been delivered, installed and accepted on the date hereof.
Lessee has conducted such inspection and/or testing of the Equipment listed in the Schedule as it deems necessary and appropriate and hereby acknowledges that it accepts the Equipment for all purposes Lessee is currently maintaining the insurance coverage required by Section 6.05 of the Agreement.
No event or condition that constitutes, or with notice or lapse of time, or both, would constitute. an Event of Default (as defined in the Agreement) exists at the date hereof.
Lessee has appropriated and/or taken other lawful actions necessary to provide moneys sufficient to pay all Rental Payments required to be paid under the Agreement during the current Budget Year of Lessee, and such moneys will be applied in payment of all Rental Payments due and payable during such current Budget Year.
The governing body of Lessee has approved the authorization, execution and delivery of this Agreement on its behalf by the authorized representative of Lessee who signed the Agreement.
The Lessee will in a timely fashion submit the appropriate paperwork to the State to have a title to the Equipment issued in their name as owner and Lessor listed as first lienholder. Such verification of perfected ownership and security interest will be provided to Lessor no later than 90 days from delivery of the Equipment. (6)
