Item No. 13.
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: OFFICE OF THE CITY MANAGER
BY: MATTHEW BAUMGARDNER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE: JANUARY 27, 2026
INTRODUCTION OF AN ORDINANCE APPROVING THE EIGHTH AMENDMENT TO THE SUBJECT: 1-5 CONSORTIUM CITIES JOINT POWERS AGREEMENT
EXECUTIVE SUMMARY
The City Council will consider introducing an Ordinance approving the eighth amendment to the 1-5 Consortium Cities Joint Powers Agreement. The original agreement expired in November 2025 and an extension through November 1, 2030 is proposed though the approval of the eighth amendment to said agreement. Per the City Charter, the adoption of an ordinance is required for the approval of any agreement for a period longer than ten years.

That the City Council:
Introduce an ordinance approving the eighth amendment to the Interstate 5 Consortium Cities Joint Powers Agreement.
BACKGROUND
The City of Downey is one of five member cities of the Interstate 5 Consortium Cities Joint Powers Authority (1-5 JPA), which was established in 1990. The goal of the 1-5 JPA is to work in partnership with Caltrans, Metro, and the Federal Highway Administration to pursue innovative capacity -enhancing options for the expansion of the 1-5 Freeway to avoid significant at -grade widening of the freeway that would have negative social and economic impacts on adjacent communities along the corridor.
The 1-5 JPA has been successful in its efforts to secure financial support for traffic mitigation projects along the 1-5 corridor and continues to advocate on behalf of its member agencies for the implementation of capacity enhancements improving traffic flow along the freeway between the Los Angeles County line and the 1-710 Freeway.
ANALYSIS
The term of the original agreement (see Attachment B), which has been extended through seven prior approved amendments, expired on November 1, 2025. The eighth amendment (see Exhibit A) to the subject agreement extends the term for an additional five (5) years through November 1, 2030. Section 518 of the City's Charter states that "no contract or lease or extension thereof for a longer period than ten years shall be valid unless said contract, lease or extension be made or approved by ordinance..." Therefore, in order to extend the term of the 1-5 Consortium Cities Joint Powers Agreement by five (5) years to November 1, 2030, Ordinance No. 26- (see Attachment A) must be introduced and subsequently adopted by the City Council. Continuing to participate in the I- 5 JPA will be valuable to the City as development continues to move north along the corridor and project and project reimbursements are still pending.
