TO:HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:OFFICE OF THE CITY MANAGER

SHANTAE DUREN, MANAGEMENT ANALYST
DATE:JUNE 23, 2026
SUBJECT:ADOPTION OF RESOLUTION ADJUSTING THE CITYWIDE USER FEES SCHEDULE FOR FISCAL YEAR 2026-2027

EXECUTIVE SUMMARY

The City Council will consider adopting Resolution No. 26-8363, adjusting Citywide User Fees for Fiscal Year (FY) 2026-2027. The City has historically adjusted Citywide user fees by the annual March Consumer Price Index (CPI) for the Los Angeles-Long Beach-Anaheim area according to the U.S. Bureau of Labor Statistics. By applying this gradual increase in fees, it ensures that General Fund revenues are not used to subsidize specialized services and prevents the need to enact large fee increases that can occur when annual analyses are skipped over multiple years.

RECOMMENDATION

That the City Council:

1. Conduct a Public Hearing; and,

2. Adopt Resolution No. 26-8363, adjusting the Citywide Uniform Schedule of Fees for Fiscal Year 2026-2027.

BACKGROUND

Local government agencies are responsible for providing a variety of services to citizens. These services range from public safety to building and planning. The method of funding local government services are also varied, and most services are funded by tax revenues and user fee charges. Services that support the community and public safety are typically tax supported, while services that provide for specific individual beneficiaries are generally supported by user fee charges.

User fee charges in California are required to comply with the statutory requirements of the California Constitution and the California Code of Regulations. Specifically, Proposition 26, approved by voters in 2010, requires that user fees for activities that benefit specific user groups be set at no more than the actual cost to provide the services.

While State law does permit the full recovery of costs associated with providing these services, actual cost recovery is a policy decision of the City Council based upon the general public benefit derived from the specific fee, the overall fee purpose, and the need to remain economically competitive.

It is common practice for cities to perform a comprehensive user fee study every 4-5 years, due to ongoing changes in staffing levels, land use policies, advancement in municipal practices, and increasing cost of providing City services. In February 2022, the City retained Revenue & Cost Specialists, LLC (RCS) to perform a Citywide Cost Allocation and Cost of Services Study to ensure the City’s fees and rates reflect the true and reasonable cost of delivering services. In October 2023, RCS completed its study and provided the City with the study findings.

RCS also provided, as part of the study, a recommended range of cost recovery targets that are specific to the industry, end user group, and public purpose for which the activity is occurring.

This spring, the City again worked with RCS to support a focused review of the Fire Department’s fee structure as the Department begins the transition to a risk-based approach to processing fire inspection services. RCS worked closely with Fire Department staff to review costs, adjust recovery targets, and calculate new fees specific to the Department’s new processing structure. This study resulted in an updated recommended range of cost recovery targets specific to the Fire Department to meet the needs of the Department’s updated fee structure.

ANALYSIS
The proposed FY 2026-2027 Citywide User Fee Schedule is attached as “Exhibit A” to Resolution No. 26-8363, (Attachment A).

City staff is proposing a total of 963 user fees for FY 2026-2027. Out of this total the following actions are recommended:
466 of the fees are proposed to be increased by CPI (3.4%). 35 fees are proposed to be increased or decreased to reflect market rates. 60 fees are new proposed fees.
237 fees have no increase or decrease proposed due to rounding or current market rates. 45 fees are set by outside agencies.
70 fees were adjusted as a result of the 2026 Fire Department Fee Study; and, 50 fees are proposed to be removed from the schedule.

Fees not set by state regulations are proposed to increase by 3.4 percent (3.4%) based on the March 2025-March 2026, CPI for the Los Angeles-Long Beach- Anaheim area according to the U.S. Bureau of Labor Statistics (Attachment B) and are highlighted in orange on the attached Exhibit A - User Fee Schedule. These fee changes account for the majority of the changes to the fee schedule. By applying this gradual increase in fees, it ensures that general fund revenues are not used to subsidize specialized services received by businesses and developers, among others. It also prevents the need to enact large increases, resulting from a need to “catch up” fee charges due to skipping annual fee analyses for a few years.

A few fees were amended to reflect market rates for facility rentals and admissions, and Theatre rental staff expenses. Those fees are highlighted in purple in Exhibit A.

A group of new fees are being proposed to recover the costs for staff time spent on various services that were not previously captured in the schedule. Additionally, staff has proposed the removal of fees no longer applicable.

Starting July 2026, the Downey Fire Department will change how fire inspections are scheduled and conducted, moving to a risk-based system. Fees will adjust accordingly. Inspections will now depend on occupancy type and associated risk, not business license applications. High-hazard operational permits will be issued with occupancy permits per national standards. This new process aims to enhance Citywide fire and life safety. The fee additions and changes made to Attachment A, Section 4 – Fire, reflect the extra time needed to complete these inspections and issue permits.

Fee increases were rounded up or down by one dollar if they were greater or less than $0.50, respectively.

However, there was an exception in the Community Development Department – Building & Safety section where fees were increased by the actual dollar amount to the cent, without any rounding.

CITY COUNCIL PRIORITIES

Fiscal Responsibility

FISCAL IMPACT

Approval of the recommended action will result in a revenue increase to General Fund Revenues in various Departments. However, the exact fiscal impact of these fee adjustments is not known at this time.

RESOLUTION NO. 26-8363

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY

ADOPTING FEES AND CHARGES FOR CERTAIN SERVICES
PROVIDED BY THE CITY OF DOWNEY AND ADJUSTING THE CITY’S UNIFORM SCHEDULE OF FEES FOR FISCAL YEAR 2026-2027
WHEREAS, the City of Downey (the “City”) charges fees for various services, permits, licenses, and regulatory activity provided by the City (collectively, the “Fees”); and
WHEREAS, in order for the Fees to cover the costs of providing the services, permits, licenses, or regulatory activity for which the Fees are imposed, many of the Fees must be adjusted annually to reflect reasonable estimated costs of service; and WHEREAS, each year, for the convenience of the public, the City Council gathers in a single document a comprehensive listing of the Fees; and WHEREAS, this document is known as the Uniform Schedule of Fees, or the “Miscellaneous Fee Schedule”; and
WHEREAS, the City has undertaken a Cost of Services Study for “Section 4 – Fire” of the Uniform Schedule of Fees wherein the costs to provide these special services were reorganized and calculated to align with the Fire Department’s change in how fire inspections will be processed; and
WHEREAS, the City has analyzed the recommended fee increases and decreases proposed in this Cost of Services Study to determine its recommended fee increases, decreases, additions, and deletions to the previously adopted Uniform Schedule of Fees, as to recover an adequate percentage of the cost of rendering such services or regulatory activity; and
WHEREAS, on an annual basis, the Fees are reviewed and adjusted to reflect the City’s costs in delivering the services. The Consumer Price Index for All Urban Consumers (CPI-U) is 3.4% for the Los Angeles-Long Beach Anaheim area as of March 2026. The City Council finds that the cost of providing the services set forth in the Miscellaneous Fee Schedule for FY 2025-2026 must increase by 3.4% for the FY 2026-2027 Miscellaneous Fee Schedule to reflect the compensation increase for City staff providing the services. Furthermore, each City department has confirmed that the actual cost of providing the service does not exceed the proposed fees for Fiscal Year 2026-2027; and
WHEREAS, the cost of rendering such services or regulatory activity should be borne by that limited group who are the beneficiaries rather than the citizenry at large; and
WHEREAS, the City Council now wishes to adopt the Fees as set forth in Exhibit “A”, effective July 1, 2026; and
WHEREAS, certain Fees are subject to the adoption procedures set forth in Government Code section 66016, and others are subject to the procedures set forth in Government Code section 66018; and

RESOLUTION NO. 26-8363
PAGE 2

WHEREAS, in accordance with Government Code section 66016, the City has made available to the public at least ten days prior to its public hearing, data supporting the Fees, and notice of this hearing has been mailed to all interested persons who have requested such notice at least 14 days prior to the date of this hearing; and WHEREAS, in accordance with Government Code section 66018, the City Council called a public hearing for June 23, 2026, for the purpose of receiving public comments to the proposed Fees. Notice of the public hearing was given by publication in a newspaper of general circulation within the City once a week for two weeks commencing at least 10 days prior to the public hearing, with at least 5 days intervening between the first and last publication. On June 23, 2026, at the time and place set for the public hearing, the City Council heard and considered all oral and written presentations and comments made regarding the proposed Fees.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY
DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 1. The above Recitals are true and correct and by this reference incorporated herein.

SECTION 2. The City Council hereby adopts the full City of Downey Fee Schedule described in Exhibit “A” attached hereto and incorporated herein by this reference. The Fees imposed by this Resolution shall take effect on July 1, 2026, or for Fees subject to Government Code section 66017(a) or 66019(b), 60 days following adoption of this Resolution. The Fees imposed by this Resolution shall supersede any prior fees or charges imposed by resolution or otherwise by the City Council, to the extent such prior fees or charges conflict herewith. Each fee or service charge shall be levied until further resolution of the City Council.

SECTION 3. The valuation tables referenced in Exhibit A are based upon the International Construction Code (ICC) valuation table in effect at the date of application.

SECTION 4. The City Council finds and determines that:
(a) The Fees established by this Resolution:
(1) are imposed for a specific government service provided directly to the payor, or for reasonable regulatory costs of the City for issuing licenses and permits, performing investigations, inspections, and administrative enforcement of the City’s Municipal Code or other rules or ordinances; and (2) are no more than necessary to cover the reasonable
costs of the governmental activity for which the Fee is imposed; and (3) the manner in which those costs are allocated to a payor bear a fair or reasonable relationship to the payor’s burdens on, or benefits received from, the governmental activity for which the Fee is imposed. (b) The Fees are not taxes within the meaning of California Constitution Article XIII C, section 1(e).

Technical Note
The Consumer Price Index (CPI) is a measure of the average change in prices over time in a fixed market basket of goods and services. The Consumer Price Index for Los Angeles is published monthly. The set of components and sub-aggregates published for regional and metropolitan indexes is more limited than at the U.S. city average level; these indexes are byproducts of the national CPI program. Each local index has a much smaller sample size than the national or regional indexes and is, therefore, subject to substantially more sampling and other measurement error. As a result, local-area indexes are more volatile than the national or regional indexes. In addition, local indexes are not adjusted for seasonal influences. NOTE: Area indexes do not measure differences in the level of prices between cities; they only measure the average change in prices for each area since the base period.

A full all-items data series history for the original index value and for 1-month, 2-month, 3-month, 6-month, and 12-month percent changes can be accessed via BLS data query tools. A direct link to the all-items series is provided in Table 1 of this release under historical data.

The Los Angeles-Long Beach-Anaheim, CA Core Based Statistical Area includes Los Angeles and Orange Counties in California.
