BY:ANTHONY HILDEBRAND, FIRE CHIEF
DATE:JUNE 23, 2026
SUBJECT:ADOPTION OF RESOLUTION REGARDING 2026 SB 1205 MANDATED FIRE/LIFE

SAFETY INSPECTION COMPLIANCE REPORT

EXECUTIVE SUMMARY

The City Council will consider adopting the attached resolution acknowledging receipt of a report by the Fire Chief of the Downey Fire Department regarding the annual inspection of required occupancies under Sections 13146.2 and 13146.3 of the California Health and Safety Code.

RECOMMENDATION

That the City Council:

Adopt Resolution No. 26-8369, acknowledging receipt of a report made by the Fire Chief of the Downey Fire Department regarding the annual inspections of certain occupancies pursuant to Sections 13146.2 and 13146.3 of the California Health and Safety Code.

BACKGROUND
Passed in 2018, Senate Bill 1205 added Section 13146.4 to the Health and Safety Code, requiring fire departments to report annually to their administering authority on their compliance with Sections 13146.2 and 13146.3 by resolution.

This compliance report details the number of fire/life safety inspections for Occupancy Type “R1” and “R2” (residential) and Occupancy Type “E” (education) conducted within the jurisdiction relative to the number of occupancies. Type R1 and R2 occupancies include hotels, motels, lodging houses, and apartment houses with more than two dwelling units. Type E occupancies include public and private school facilities serving more than 6 children for educational purposes through 12th grade.

ANALYSIS
The attached report represents inspections conducted within the past 12 months, as required by state law. During fiscal year 2025-2026, Downey Fire Department personnel conducted 498 mandated inspections out of 673 total occupancies. The Fire Department remains committed to achieving maximum inspection compliance while providing a full-service fire prevention bureau and investigating all fires and explosions within the City.

The Fire Department intends to continue its efforts to complete the outstanding 175 mandatory inspections with available resources as quickly as possible. These inspections will be prioritized by occupancy type and hazard potential.
