Item No. 7.
TO:HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:OFFICE OF THE CITY MANAGER
BY:MATTHEW BAUMGARDNER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE:OCTOBER 13, 2026
SUBJECT:
ADOPTION OF RESOLUTION SUMMARILY VACATING PUBLIC SERVICE UTILITY
EASEMENT FOR SANITARY SEWER MAIN FACILITY PURPOSES ON PRIVATE PROPERTY AT THE SOUTHWEST CORNER OF BELLFLOWER BLVD. AND IMPERIAL HWY.
EXECUTIVE SUMMARY
The City Council will consider adopting a resolution to vacate public utility easements located on private property at the southwest corner of Bellflower Blvd. and Imperial Hwy. The City has owned such utility easements since 1965 for operation and maintenance of sanitary sewer main purposes. The existence of such easements is no longer necessary for City sewer main purposes due to the ongoing development of the private property as an In-N-Out restaurant, which intends to both reconstruct and reuse such onsite sewer main for private sewer lateral purposes.
RECOMMENDATION
That the City Council:
Adopt Resolution No. 26-8383, Summarily Vacating Public Service Utility Easements for Sanitary Sewer Main Facility Purposes on Private Property at the Southwest Corner of Bellflower Blvd. and Imperial Hwy.
BACKGROUND
The City of Downey maintains sanitary sewer easements on private property located at the southwest corner of Bellflower Blvd. and Imperial Hwy. which were acquired and accepted by the City in 1965. The easements enabled the City to have access in order to operate, clean, and make repairs to its sewer infrastructure to maintain and provide reliable sewer service to the surrounding properties. However, such properties are now under sole ownership and given the development of this property as an In-N-Out restaurant, the sanitary sewer facilities located on this private property are no longer necessary for the City to use and maintain. All other customers in the area will be provided sanitary sewer service via sewer mains within City right-of-way along adjacent City streets.
ANALYSIS
Summary vacation (Attachment A) of the existing 10-foot wide sanitary sewer utility easements located on private property at the Southwest Corner of Bellflower Blvd. and Imperial Hwy. is necessary to eliminate the easements which are no longer needed due to the ongoing development of this property. The existing sewer will continue to serve as a privately owned sewer lateral and the owner will have the privilege to use or abandon and replace the existing system for all future development. The City will benefit from not having to operate and maintain the sewer facilities on private property.
