SUBJECT: Comments on Agenda Items, Meeting of June 10, 2025 ITEM 5.A. (Special Items). Community Development Department update - Community Development Director Hensley will provide an update for the council.

ITEM 5.B. (Special Items). Parks and Recreation Department update - Parks and Recreation Director Enriquez will provide an update for the council.

ITEM 9.E. (Consent Calendar). The Community Development Department has submitted the monthly report for June 2025 for review.

ITEM 9.F. (Consent Calendar). The Parks and Recreation Department has submitted the monthly report for June 2025 for review.

ITEM 9.G. (Consent Calendar). Resolution No. 25-13 - Adopting the Holiday Schedule for City Employees - Pursuant to Chapter 2.08.010 of the Duarte Municipal Code (“DMC”) observed holidays that impact the public offices of the City shall be designated by resolution of the city council. The City and the employee union have agreed to specific paid holidays in the current Memorandum of Understanding. The adoption of Resolution No. 25-13 would memorialize said agreed-upon holidays.

ITEM 9.H. (Consent Calendar). Proclamation Recognizing National Mosquito Control Awareness Week - National Mosquito Control Awareness Week is observed annually in June and is coordinated by the American Mosquito Control Association. The goal of this awareness campaign is to educate communities about the importance of mosquito control and the proactive steps individuals and local governments can take to reduce mosquito populations and prevent the spread of mosquito-borne diseases. The San Gabriel Valley Mosquito & Vector Control District (SGVMVCD) plays an essential role in protecting public health in our region. The SGVMVCD partners with the City of Duarte and neighboring communities to provide surveillance, prevention, and education efforts to combat mosquitoes and the diseases they carry.

Proclaiming June 15-21, 2025, reinforces our City's partnership with SGVMVCD and supports regional efforts to protect the health and well-being of our residents.

ITEM 9.I. (Consent Calendar). Amendment to Agreement for Animal Care and Control Contract Services with San Gabriel Valley Humane Society - The City of Duarte currently contracts with the San Gabriel Valley Humane Society (SGVHS) for the provision of animal care and control services. The original agreement, titled “City of Duarte Agreement for Animal Care and Control Contract Services,” was executed on July 1, 2019, and has continued through automatic annual renewals. The current contract is set to renew on July 1, 2025, unless terminated with a minimum of ninety (90) days' by written notice by either party, as stated in Section I of the agreement. SGVHS is in the process of joining with the Inland Valley Humane Society, which is headquartered in Pomona, CA. Inland Valley Humane Society & SPCA will be the surviving nonprofit entity post-joining. To facilitate a seamless transition of services and maintain uninterrupted animal care and control operations for Duarte, SGVHS has requested to amend the contract to permit the assignment of the agreement to the successor entity.

ITEM 13.A. (Business Items). Emergency Approval of Competition Pool Infrastructure Repairs - Since late April, the City’s competition pool at the Fitness Center has remained closed due to significant ongoing water loss. The issue first came to light when City staff noticed an uptick in utility usage. In response, the

Page 6 of 75 ends

City contracted with a professional leak detection company. That company detected several leaks and given the larger infrastructure issue contributing to the water loss, staff worked with Aquatic Design Group, the awarded contractor for the Pool Deck Renovation Project, to identify qualified contractors to perform these emergency repairs. Based on their recommendation, City staff invited three contractors out to assess the space and provided estimates for the work; to which two provided a proposal. Staff, in coordination with Aquatic Design Group, has reviewed both submitted proposals. Based on the anticipated cost, proposed timelines for commencement and completion, staff is recommending the City Council employ its authority under Municipal Code 2.36.050 – Exemptions from Purchasing Requirements, and authorize the City Manager to enter into agreement with Condor Inc. to perform the emergency repair work for the Duarte Fitness Center Competition Pool in the amount of $65,000, with a contingency not to exceed a total project cost of $130,000. This contingency will allow the project to proceed without any delay, should any unforeseen repairs arise during construction and ensuring the work can continue within the total project budget authorized by Council.

ITEM 13.B. (Business Items). Resolution No. 25-14 - Establishing a salary schedule and compensation plan for the unrepresented regular employees and amending the Citywide Salary accordingly - Unrepresented Employees are bound by the policies established by the City's Personnel Rules and Regulations and a Compensation Resolution, which is typically adopted by the Council on an annual basis in June for the upcoming fiscal year. The compensation resolution for Unrepresented Employees serves to establish compensation, benefits, and any procedures, rights, or protections that are of particular interest and are not already a part of the existing Personnel Rules & Regulations. Please note that the Memorandum of Understanding ("MOUs") for the Management and Professional and the General Units of represented employees does not apply to unrepresented employees. As a result, the City Manager must recommend, and City Council must approve compensation for unrepresented regular positions on an annual basis. This year's Unrepresented Employees compensation plan includes a 5 percent base salary increase (PERSable), a $150 auto allowance increase (non-PERSable), and a $100 increase to the deferred compensation contribution match (non-PERSable). There is also language included in this year’s resolution for the potential of a one-time non-PERSable bonus of up to 3% as part of the personnel evaluation process. The estimated expenditures related to all compensation changes is up to $20,000.

STATUS REPORT
June 2025

PROJECT/PROGRAM STATUS

DEVELOPMENT
Wyndham Hawthorn
Suites Hotel (1230
Huntington Drive)
This is a two-phase project with a total of 178 rooms with 72 in the first phase. Utility plans are still in process and the development team is working on resolving easement issues.

Building permits were issued in December. The applicant initially stated that construction would start in March 2025.

Recently, there has been some progress, however, there are several items that are still not completed. Project approvals will expire on June 23. If the approvals expire, the project will need new entitlements.

Andres Duarte School This is a Duarte Unified School District (DUSD) project which entails the development of the Andres Duarte School site.

The proposed project, at 1433 Crestfield Avenue, is for the construction of 169 townhome units and renovation of Otis Gordon Park. The entitlements required are a: general plan amendment, zone change, parcel map, planned development permit and site plan and design review.

The Parks & Recreation Commission reviewed the concept for the Otis Gordon Park rebuild at its September 2024 meeting.

The Draft EIR will be released for public comment in early June.

That opens a 45 day public comment period. After the
comment period, public hearings will be scheduled.

BP Charging Station
2107 Huntington Dr.

Permits have been issued, and construction is in process for the new EV charging station on the property at the northeast corner of Huntington Drive and Bradbourne. This is a new style of charging station that includes several charging spaces and a lounge area for customers that are waiting for their vehicles to charge. The building is complete and the owner is in the process of deciding when the official opening will take place. 1501-1525 Huntington
Dr.

A developer has recently purchased the building at 1501 Huntington Drive (formerly Morrolito Restaurant). This same developer owns the former Maya building and the vacant
property. The short term plan is to demolish all of the buildings. This should occur in the next two months. The longer term plan is to build a mixed use project that meets the requirements of the Town Center Specific Plan. This is a longer

term project, but is a positive step in building out the Town Center area.

Former Nissan
Dealership
The Nissan dealership on the northeast corner of Buena Vista Street and Central Avenue has permanently closed. Staff has met with the new owner to discuss possible development of the site. The priority is for a new car dealership for the location. In the most recent discussion with the owner’s representative, it was reported that the plan is to begin marketing the property in early 2025. In the interim the property will be used for new car parking and will be well maintained.

New Infinity/Nissan
Dealership
Nissan has moved to the former Used Car Superstore at 1125 Central Ave. The Infinity brand will also be sold at this location.

The new owner has informed Staff that future plans include upgrades to the building and signs.

Envision Ford Envision Ford at 1031 Central Ave. recently completed construction on a new freeway sign. The owners also plan to make a significant upgrade to the property with a new building.

The owners recently reported that plans for upgrade have been moved back to 2026.
2400 Huntington Drive The City’s Housing Authority owns the property at 2400 Huntington Drive and has recently entered into an Exclusive Negotiating Agreement with Jamboree Housing to work on a plan for property sale and development. City Staff are working with the San Gabriel Valley COG and the San Gabriel Valley Regional Housing Trust on possible financial assistance for the development.
1404-1414 Royal Oaks
Drive
Shuorung Properties LLC has recently filed an application to construct 11 townhomes on the property at 1404-1414 Royal Oaks Drive, currently two single family homes. This requires environmental, a general plan amendment, zone change and design review. The environmental process has started and will take 4-6 months. The hearing process will follow.

3 PROJECT/PROGRAM STATUS
Metro Parking Lot Staff has been working with Metro for the past several years on the development of the Metro parking lot as part of the Duarte Station Specific Plan. The intent is to replace the Metro parking into a parking structure and construct workforce housing along Fasana Road at Highland Avenue. Metro has awarded an
Exclusive Negotiating Agreement to Jamboree Housing. The plan is for a development with between 100-120 units of multigeneration housing. There is currently no schedule for development.

Town Center North Staff has been meeting with property owners to develop a proposal for a complete center rehabilitation that includes new, upgraded facades, an upgraded parking lot and related
improvements. Staff has been working with a commercial
broker team with the goal of spurring activity. The City has hired an Architect and Engineer to develop a detailed concept plan for façade and parking lot upgrades to the center. The City has approved an Exclusive Negotiating Agreement with Red Mountain, one of the owners in the center, to work toward the sale of the City’s corner property. The goal is for the owner to assist the City in coordinating all the property owners to participate in a comprehensive improvement of the entire center as a part of the development plan.

Solana at Duarte Station
1750 Fasana Road
MBK is building Solana, a 292-unit apartment building. This building is the location of the “Duarte Station” sign that is an icon, located on the roof of the building. Pre leasing is under way and the building will open soon.

The City of Hope has recently submitted concept plans for a new building for pathology, radiology and oncology.

Westminster Gardens Human Good, the owner, plans for a major campus expansion and has recently filed an application. The City hired MIG to assist in the preparation of the specific plan amendment and EIR. The request is for this expansion to accommodate up to 600 total units; this includes assisted living and memory care units, and mixed use. This project will take 12+ months, but Staff has had kick off meetings with the consultant and HumanGood and there is positive progress.
928 Huntington Dr. A 16-unit apartment development has been approved for the property. Permits have been issued. The project was put on hold for a while but recently has restarted.

FROM: Brian Villalobos, City Manager
BY: Albert Nuñez, Management Analyst
SUBJECT: Proclamation Recognizing National Mosquito Control Awareness Week, June 15-21, 2025
RECOMMENDATION: It is recommended that the City Council proclaim June 15-21, 2025, as National Mosquito Control Awareness Week in the City of Duarte.

FISCAL IMPACT: No fiscal impact.

BACKGROUND
National Mosquito Control Awareness Week is observed annually in June and is coordinated by the American Mosquito Control Association. The goal of this awareness campaign is to educate communities about the importance of mosquito control and the proactive steps individuals and local governments can take to reduce mosquito populations and prevent the spread of mosquitoborne diseases.

DISCUSSION/ANALYSIS
Mosquitoes are more than a nuisance. They can transmit dangerous diseases such as West Nile virus, Zika virus, dengue fever, and chikungunya. Notably, in 2024, San Gabriel Valley communities reported 11 of the 18 statewide cases of dengue fever, highlighting the increasing threat of invasive Aedes mosquitoes and the growing risk of local transmission of tropical diseases.

Raising public awareness before and during mosquito season is vital to a successful mosquito control strategy. Recognizing National Mosquito Control Awareness Week will help remind Duarte residents to take preventive actions, such as eliminating standing water and maintaining yards and outdoor spaces to reduce mosquito breeding sources.

Agenda Item: 9.H.

2 Proclaiming June 15-21, 2025, also reinforces our City's partnership with SGVMVCD and supports regional efforts to protect the health and well-being of our residents.

RECOMMENDATION
It is recommended that the City Council proclaim June 15-21, 2025, as National Mosquito Control Awareness Week in the City of Duarte.

WHEREAS, the presence of mosquitoes negatively affects quality of life by limiting outdoor activities, decreasing enjoyment of parks and recreational areas, hindering outdoor work, and reducing property values; and
WHEREAS, the San Gabriel Valley Mosquito & Vector Control District works in partnership with local communities, including the City of Duarte, to educate residents, eliminate mosquito breeding sources, and prevent mosquito-borne diseases; and

FROM: Larry Breceda, Director of Public Safety
SUBJECT: Amendment to Agreement for Animal Care and Control Contract Services with San Gabriel Valley Humane Society
RECOMMENDATION: Staff recommends that the City Council authorize the City Manager to execute the proposed amendment to the City’s Agreement for Animal Care and Control Contract Services with the San Gabriel Valley Humane Society allowing for the assignment of the agreement to an alternate entity.

FISCAL IMPACT: There is no direct fiscal impact associated with the approval of this amendment. Existing contract terms and compensation schedules remain unchanged.

BACKGROUND
The City of Duarte currently contracts with the San Gabriel Valley Humane Society (SGVHS) for the provision of animal care and control services.

DISCUSSION/ANALYSIS
To facilitate a seamless transition of services and maintain uninterrupted animal care and control operations for Duarte, SGVHS has requested to amend the contract to permit the assignment of the agreement to the successor entity.

The proposed amendment updates Section XV, Assignment, A, of the current agreement to read as follows:

Agenda Item: 9.I.

Page 53 of 75 ends

2 “Humane Society shall have the right, or power to sell, mortgage, or assign this agreement or the powers granted to it or any interest therein.”

No other terms or conditions of the original agreement are affected or amended by this change.

The City retains the ability to terminate the agreement with ninety (90) days' notice, as outlined in the contract.

RECOMMENDATION
Staff recommends that the City Council authorize the City Manager to execute the proposed amendment to the City’s Agreement for Animal Care and Control Contract Services with the San Gabriel Valley Humane Society, allowing for the assignment of the agreement to an alternate entity.

AGENDA REPORT
MEETING DATE: June 10, 2025
TO: Mayor and Members of the City Council
FROM: Manuel Enriquez, Director of Parks and Recreation SUBJECT: Emergency Approval of Competition Pool Infrastructure Repairs RECOMMENDATION: It is recommended that the City Council 1) authorize the City Manager to enter into agreement with Condor, Inc. to perform the emergency repair work for the Duarte Fitness Center Competition Pool in the amount of $65,000, with a contingency not to exceed a total project cost of $130,000; and 2) approve a budget amendment of $130,000 under Building Maintenance Services line (100-1610- 7652).

FISCAL IMPACT: The estimated repair cost is $65,000. To accommodate any unforeseen repairs identified during construction, a contingency is being included, for a total project cost not to exceed $130,000 from the General Funds Building Maintenance Services line (100-1610- 7652).

BACKGROUND
Since late April, the City’s competition pool at the Fitness Center has remained closed due to significant ongoing water loss. The issue first came to light when City staff noticed an uptick in utility usage. In response, the City contracted with a professional leak detection company, which initially identified two significant cracks on our surge tank throat. Based on the initial inspection report, staff coordinated with the City’s regular pool servicing and maintenance contractor (Wet Views) to perform the recommended repairs. After the repairs were completed and allowed to cure, staff and Wet Views observed that the pool was still experiencing substantial water loss.

Consequently, the leak detection company was brought back out for further investigation. This second phase of assessment included the removal of grates around the entire perimeter of the competition pool to assess the pool’s infrastructure. A full pressurized test of the pool’s system was conducted by the vendor, and a certified diver was deployed into the surge pit to perform a thorough inspection. The detailed inspection report revealed two additional leaks above the auto fill area of the surge tank and a third smaller leak in the southwest area of our competition pool lights.

Agenda Item: 13.A.

Page 63 of 75 ends

2 DISCUSSION/ANALYSIS
Given the larger infrastructure issue contributing to the water loss, staff worked with Aquatic Design Group, the awarded contractor for the Pool Deck Renovation Project, to identify qualified contractors to perform these emergency repairs.

RECOMMENDATION
It is recommended that the City Council 1) authorize the City Manager to enter into agreement with Condor, Inc. to perform the emergency repair work for the Duarte Fitness Center Competition Pool in the amount of $65,000, with a contingency not to exceed a total project cost of $130,000; and 2) approve a budget amendment of $130,000 under Building Maintenance Services line (100- 1610-7652).

BY: Kristen Petersen, Director of Administrative Services SUBJECT: Citywide Salary Schedule Effective July 1, 2025 RECOMMENDATION: It is recommended that the City Council adopt Resolution No. 25- 14 rescinding Resolution No. 24-11 and establishing a salary schedule and compensation plan for the unrepresented regular employees and amending the Citywide Salary accordingly.

FISCAL IMPACT: The estimated expenditures related to all compensation changes is up to $20,000.

BACKGROUND
Unrepresented Employees are bound by the policies established by the City's Personnel Rules and Regulations and a Compensation Resolution, which is typically adopted by the Council on an annual basis in June for the upcoming fiscal year.

DISCUSSION/ANALYSIS
This year's Unrepresented Employees compensation plan includes a 5 percent base salary increase (PERSable), a $150 auto allowance increase (non-PERSable), and a $100 increase to the deferred compensation contribution match (non-PERSable). There is also language included in this year’s resolution for the potential of a one-time non-PERSable bonus of up to 3% as part of the personnel evaluation process.

a biological, adopted, or foster child, stepchild, legal ward, or a child to whom the employee stands in loco parentis, regardless of the child’s age or dependency status; a biological, adoptive, or foster parent, stepparent, or legal guardian of an employee or the employee’s spouse or registered domestic partner, or a person who stood in loco parentis when the employee was a minor child; a spouse; a State of California registered domestic partner; a grandparent; a grandchild; and a sibling. ii. For employees who are victims of domestic violence, sexual assault, or stalking, taking time off to obtain or attempt to obtain any relief, including, but not limited to, a temporary restraining order, restraining order, or other injunctive relief, to help ensure the health, safety, or welfare of the victim or his or her child. iii. For employees who are victims of domestic violence, sexual assault, or stalking, taking time off to seek medical attention for injuries caused by the domestic

violence, sexual assault, or stalking; to obtain services from a domestic violence shelter, program, or rape crisis center as a result of domestic violence, sexual assault, or stalking; to obtain psychological counseling related to an experience of domestic violence, sexual assault, or stalking; and to participate in safety planning and take other actions to increase safety from future domestic violence, sexual assault, or stalking, including temporary or permanent relocation.

In cases where lost work time due to illness or injury exceeds four days, or when the employee has been frequently absent (more than four cumulative days in a calendar year), the City Manager or designee may require a written physician’s confirmation of the nature of the illness or injury.

Employees are not responsible for finding other employees to cover shifts due to their use of paid sick leave. Should work time lost due to illness or injury exceed the employee’s accrued sick leave balance, then any available vacation, floating holidays, or compensated time off will be used as compensation.

C. Pursuant to the terms of the City’s contact, as amended, with the California Public Employees’ Retirement System (CalPERS), upon voluntary retirement the employee may convert one hundred percent of his/her accrued sick leave balance, less any amount used under the provisions to retirement service credit.

D. When utilizing sick leave, the employee will notify his/her direct supervisor at the earliest possible time as to the general nature and possible duration of the injury or illness. It will be the employee’s responsibility to keep his/her supervisor informed on a daily basis of his or her condition as it relates to absence from employment.

E. Employees may voluntarily donate sick leave to a donation bank, which is maintained for the use of qualified employees who have suffered a catastrophic illness or injury and have exhausted their paid leaves of absence. This program is set forth in an administrative policy.

F. Up to 30 hours of unused sick leave at separation shall be reinstated upon return to active status with the City occurring within no more than 12 months of separation.

G. Upon reasonable request, and within 21 calendar days after the request, the City shall afford current and former employees the right to inspect or copy records pertaining to their hours worked and paid sick days accrued and used.

SECTION 6. BEREAVEMENT LEAVE
If an employee loses an immediate family member, as defined in this paragraph, the employee will be entitled to City-paid bereavement leave in an amount of forty (40) hours per incident.

Bereavement leave will be granted only in those cases involving the death of an immediate family member, which for the purposes of this section means: biological, adopted, or foster child, stepchild, legal ward, or a child to whom the employee stands in loco parentis; biological, adoptive, or foster parent, stepparent, or legal guardian of an employee or of the employee’s spouse or registered domestic partner, or a person who stood in loco parentis to either the employee or the employee’s spouse or domestic partner as a minor; or an employee’s spouse, registered domestic partner; grandparent; grandchild; sibling; a designated person, which means a person identified by the employee at the time the employee requests paid bereavement leave. The City limits an employee to one designated person per 12-month period.

SECTION 7. HOLIDAYS
A. Holidays Observed. The City provides regular and probationary employees with the following paid holidays during the calendar year:

Holiday Date Observed
New Year’s Day January 1 or January 2 if January 1 falls on a Sunday Martin Luther King Day Third Monday in January

Page 69 of 75 ends

Labor Day First Monday in September
Thanksgiving Day Fourth Thursday in November
Day after Thanksgiving Day Fourth Friday in November
Christmas Eve December 24
Christmas Day December 25
New Year’s Eve December 31
If a holiday falls on an employee’s regularly scheduled day off, the employee will receive a floating holiday, according to the provisions of Section 8.b, below. In such a case, the floating holiday will accrue on the date of the holiday.

B. Floating Holidays. Regular and probationary employees will receive one floating holiday each fiscal year.

The employee may use all floating holiday time at any time before the end of the fiscal year, as long as the employee has obtained the advance permission of his/her department head for the scheduling of the holiday. Unused floating holidays will be automatically cashed out at the end of the fiscal year. In case an employee terminates employment with the City, he or she will be fully compensated for any accrued, but unused, floating holidays.

C. Amount of Holiday Pay. Employees shall receive holiday pay, including floating holidays, in an amount equal to their regular schedule and rate of pay. For example, an employee who is assigned to a 4/10 schedule shall receive ten (10) hours of holiday pay, and an employee who is assigned to a 5/8 schedule shall receive eight (8) hours of holiday pay.

D. Work on Holidays. An employee who is scheduled and required to work on a date that the City has observed as a holiday shall be compensated at twice (2x) the employee’s regular salary for all time actually worked on the date the holiday is observed. The employee shall not be provided with an alternative day off to observe the holiday or with a floating holiday.

SECTION 8. ADMINISTRATIVE LEAVE AND/OR OVERTIME
In recognition of the long hours required to accomplish the requirements of the job, including attendance at numerous meetings outside normal working hours, department heads will be granted sixty (60) hours of administrative leave per fiscal year. The full sixty (60) hours shall be granted on July 1st of each year and shall not be allowed to carry over to the next fiscal year. This leave may be used to take time off, or sold back to the City at 100% of its monetary value. Department heads will not be eligible for overtime compensation.

Division managers shall receive either compensatory time or overtime pay (at the discretion of the department head) at their regular rate of pay (“straight” time) for the number of authorized hours worked over forty (40) per week. Vacation leave, sick leave, holidays, and other time not actually worked will not be counted towards the forty hours. If compensatory time is taken in lieu of paid overtime, no employee shall be permitted to accrue more than sixty (60) hours.

SECTION 9. CALL BACK
Employees may be required to come to work outside of their regular working hours in case of an emergency. In such circumstances, all employees, with the exception of department heads, will be guaranteed at least two hours pay.

SECTION 10. RETIREMENT
The City offers a defined retirement benefit plan through the California Public Employees’ Retirement System (CalPERS). An employee may be eligible for one of three (3) benefit tiers pursuant to the City’s contract with CalPERS. Information provided here is a summary of the benefits that are fully set forth in the City’s contract with CalPERS, and in the case of a conflict, either party may request to reopen Article 20 regarding Retirement to meet and confer over the conflict and/or changes to the retirement. The applicable benefit tier available to an individual employee depends on his/her date of hire and/or status as “new member”, which determines the retirement formula, final compensation calculation and employee contribution/cost sharing, as follows:

Page 70 of 75 ends

A. Tier 1: Employees Hired Before March 19, 2012. All full-time and three-quarter-time employees hired before March 19, 2012, including those who have a break in service and then later return to City employment, shall be provided with the CalPERS 2.5% @ 55 benefit formula. Final compensation is calculated as the highest average annual pensionable compensation earned during a period of twelve (12) consecutive months. The City will make all employer contributions required by CalPERS. The employee will be responsible for paying fifty percent (50%) of normal cost (currently eight percent (8%)).

In the event employee contribution rates are adjusted by CalPERS during the term of this MOU, the member contribution will be recalculated based upon the updated required member contribution rate established by CalPERS to ensure the employee contributes fifty percent (50%) of normal cost. All employee paid contributions will be deducted from employees’ salaries pre-tax.

B. Tier 2: Employees Hired On or After March 19, 2012. All full-time and three-quartertime employees hired on or after March 19, 2012, including those who have a break in service and then later return to City employment, shall be provided with the PERS 2% @ 60 benefit formula, with final compensation calculated using the average of three (3) highest years of pensionable compensation. The City will make all employer contributions required by CalPERS. The employee will be responsible for contributing fifty percent (50%) of the normal costs (currently seven percent (7%)).

C. Tier 3: Employees Hired On or After January 1, 2013. i. Full-time and three-quarter-time employees hired on or after January 1, 2013, who, within six (6) months of employment with the City, were either employed by a public employer that contracted with CalPERS or with another public retirement system with which CalPERS has reciprocity, shall be provided with the CalPERS 2% @ 60 benefit formula, with final compensation calculated using the average of three (3) highest years of pensionable compensation. The City will make all employer contributions required by CalPERS. The employee will be responsible for contributing fifty percent (50%) of the normal costs (currently seven percent (7%)). In the event employee contribution rates are adjusted by CalPERS during the term of this MOU, the member contribution will be recalculated based upon the updated required member contribution rate established by CalPERS to ensure the employee contributes fifty percent (50%) of normal cost. All employee paid contributions will be deducted from employees’ salaries pre-tax. ii. Any other full-time and three-quarter-time employees hired on or after January 1, 2013, who do not meet the criteria set forth in Section 20.c.i, above, shall be provided with the CalPERS 2% @ 62 benefit formula, with final compensation calculated using the average of the highest consecutive 36 months of pensionable compensation. The City will make all employer contributions required by CalPERS. The employee will be responsible for contributing fifty percent (50%) of the normal costs (currently six point five percent (6.5%)).

D. Disability Retirement. The City may request PERS to retire an employee who becomes physically or mentally unable to perform the duties of his or her position, or may be subject to further injury if employment is continued. The City may make every effort to transfer or reassign the partially disabled employee to another existing position within the classification plan before a request for disability retirement is made.

To be eligible, employees must retire within one hundred and twenty (120) days of their separation from employment from the City of Duarte. The City’s contribution to insurance premiums for retirees will be set at the same levels as they are for active employees. The City will provide taxable cash to retirees who waive medical insurance coverage and provide written proof of other medical insurance to the City as noted in Section B above.
