ITEM 11.E. (Consent Calendar). The Community Development Department has submitted the monthly report for July 2025 for review.
ITEM 11.F. (Consent Calendar). The Parks and Recreation Department has submitted the monthly report for July 2025 for review.
ITEM 11.G. (Consent Calendar). Second Reading and Adoption of Ordinance No. 25-03 - On March 24, 2025 the California Department of Forestry and Fire Prevention (CAL FIRE) released updated Local Responsibility Area Fire Hazard Severity Zone maps defining areas where State fire safety regulations apply and clarifying the responsibilities of local and county fire departments in fire response. Pursuant to Government Code Section 51178, the City is required by State law to adopt, by ordinance, the Local Responsibility Area Fire Hazard Severity Zone maps within 120 days of release by CAL FIRE. At its meeting on June 24th, 2025 the City Council conducted a first reading of this Ordinance. If adopted by the City Council, Ordinance No. 25-03 will go into effect in thirty (30) days.
ITEM 11.H. (Consent Calendar). Approval of Hotel Accommodations for Duarte Dance - Staff is seeking approval for one night hotel accommodations in Anaheim, California for the Duarte Dance Team. The team will be competing in the National Finals, taking place from July 16 – 20, 2025. Per the City’s Expense Reimbursement Policy (Section 6 E.), if an event is fifty (50) miles or less from the City, no overnight accommodations will be allowed without prior City Council approval. Staff is requesting hotel accommodations due to the competition’s late end time (Friday, July 18, 2025) and early start time the following day (Saturday, July 19, 2025).
ITEM 15.A. (Business Items). Appointments to the 2025/26 Mayor’s Youth Council - In April of 2008, the Mayor’s Youth Council of the City of Duarte was established. The youth council is a leadership development program in which teens in grades 8 through 12 are given an opportunity to advise, recommend, assist, and encourage activities to be undertaken for and with teens in the City. Members selected to serve will be provided an opportunity to learn and contribute to the community, engage in volunteer activities, network with professionals within the community, undertake leadership and training programs, and implement ideas through practical actions and programs in the community. Youth council members will participate in, and encourage other teens to participate in, programs and activities at the Duarte Teen Center, will assist in the creation, development, and implementation of programs and activities for teens at the Duarte Teen Center and in the City.
ITEM 15.B. (Business Items). Resolution No. 25-18 - Opposing Senate Bill 634 (Perez) prohibiting a local jurisdiction from adopting a local ordinance, or enforcing an existing ordinance, that prohibits a person or organization from providing support services, as specified, to a person who is homeless or assisting a person who is homeless with any act related to basic survival - Senate Bill 634 (Perez) (“SB 634”) would
prohibit local jurisdictions from adopting or enforcing ordinances to address homelessness. The bill would severely inhibit the City’s ability to properly respond to residents’ and businesses’ quality of life concerns.
The City is committed to protecting the public health, safety, and welfare of all its residents, visitors, and businesses. In order to do so, the City must exercise its local expertise and control to determine the policies and procedures that best fit the needs of the Duarte community. SB 634 will strip the City Council—and therefore the voters of the City, the ability to adopt and implement policies that would best address homelessness within its community. The City continues its collaboration with other agencies to address homelessness within its jurisdiction, connecting individuals experiencing homelessness with resources, housing, and drug treatment programs. SB 634 may undermine the City’s current activities in addressing this ongoing issue. The League of California Cities has and continues to oppose SB 634 for its state overreach and erosion of local government authority.

PARKS MAKE LIFE BETTER MONTH
PROCLAMATION
AGENDA REPORT
MEETING DATE: July 8, 2025
TO: Mayor and Members of the City Council
FROM: Larry Breceda, Director of Public Safety Services SUBJECT: Second Reading and Adoption of Ordinance No. 25-03 RECOMMENDATION: It is recommended that City Council adopt Ordinance No. 25-03 FISCAL IMPACT: There is no fiscal impact resulting from these changes to the DMC.
The cost to enforce the amended codes and provide staff training has been included in the annual department budget.
BACKGROUND
On March 24, 2025 the California Department of Forestry and Fire Fire Prevention (CAL FIRE) released updated Local Responsibility Area Fire Hazard Severity Zone maps defining areas where State fire safety regulations apply and clarifying the responsibilities of local and county fire departments in fire response. Pursuant to Government Code Section 51178, the City is required by State law to adopt, by ordinance, the Local Responsibility Area Fire Hazard Severity Zone maps within 120 days of release by CAL FIRE. Additionally, pursuant to Government Code Section 51179(b)(3), the City must not decrease the level of the Local Responsibility Area Fire Hazard Severity Zone maps but may make additions to increase the level or provide for further enforcement.
As part of this further enforcement, it is necessary to protect against and prohibit activities known to increase fire risks surrounding key critical infrastructure. Destruction of, damage to, or interference with, critical infrastructure is frequently caused by persons whose activities are not permitted or authorized in, on or near critical infrastructure such as public camping, particularly in places situated in dense brush and vegetation. Specifically, public camping, storage of personal property, and the related fire risks associated with public camping such as outdoor cooking must be prohibited in areas surrounding critical infrastructure. As such, certain prohibitions and enforcement tools aimed at preserving critical infrastructure and reducing fire risk are necessary to protect the health, safety and welfare of the public.
Moreover, as authorized by the California Constitution and as part of its police powers, the City can regulate public camping in a manner consistent with State and Federal law. Specifically, the City can prohibit public camping and storage of personal property on public lands. The City Agenda Item: 11.G.
2 already regulates storage of personal property so these recommended amendments will largely model the existing provisions while adding a camping prohibition and providing clarity and protection for areas with critical infrastructure and in high fire risk zones.
Finally, at its meeting on June 24th, 2025 the City Council conducted a first reading of this Ordinance. If adopted by the City Council, Ordinance No. 25-03 will go into effect in thirty (30) days.

AGENDA REPORT
MEETING DATE: July 8, 2025
TO: Mayor and Members of the City Council
FROM: Thai Viet Phan, City Attorney
SUBJECT: Resolution opposing Senate Bill 634 (Perez) prohibiting a local jurisdiction from adopting a local ordinance, or enforcing an existing ordinance, that prohibits a person or organization from providing support services, as specified, to a person who is homeless or assisting a person who is homeless with any act related to basic survival.
RECOMMENDATION: Discuss and adopt Resolution No. 25-18 opposing Senate Bill 634 to protect local control and the public health, safety, and welfare of Duarte residents, visitors, and businesses.
FISCAL IMPACT: There is no fiscal impact resulting from the adoption of the resolution.
BACKGROUND
Senate Bill 634 (Perez) (“SB 634”) would prohibit local jurisdictions from adopting or enforcing ordinances to address homelessness. The bill would severely inhibit the City’s ability to properly respond to residents’ and businesses’ quality of life concerns. SB 634 originally sought to overturn the US Supreme Court’s decision in City of Grants Pass v. Johnson (2024) 603 U.S. 520, in which the Court determined that local jurisdictions may impose civil and criminal penalties for camping on public lands. The City has updated its Municipal Code to prevent loitering, trespassing, and camping on City property in a manner consistent with Grants Pass.
DISCUSSION/ANALYSIS
The City is committed to protecting the public health, safety, and welfare of all its residents, visitors, and businesses. In order to do so, the City must exercise its local expertise and control to determine the policies and procedures that best fit the needs of the Duarte community. SB 634 will strip the City Council—and therefore the voters of the City, the ability to adopt and implement policies that would best address homelessness within its community.
The City continues its collaboration with other agencies to address homelessness within its jurisdiction, connecting individuals experiencing homelessness with resources, housing, and drug Agenda Item: 15.B.
2 treatment programs. SB 634 may undermine the City’s current activities in addressing this ongoing issue.
The League of California Cities has and continues to oppose SB 634 for its state overreach and erosion of local government authority.
RECOMMENDATION
Discuss and adopt Resolution No. 25-18 opposing Senate Bill 634 to protect local control and the public health, safety, and welfare of Duarte residents, visitors, and businesses.
FISCAL IMPACT
There is no fiscal impact resulting from the adoption of the resolution.

RESOLUTION NO. 25-18
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUARTE, CALIFORNIA, OPPOSING SENATE BILL 634 (PEREZ) PROHIBITING
A LOCAL JURISDICTION FROM ADOPTING A LOCAL ORDINANCE,
OR ENFORCING AN EXISTING ORDINANCE, THAT PROHIBITS A
PERSON OR ORGANIZATION FROM PROVIDING SUPPORT
SERVICES, AS SPECIFIED, TO A PERSON WHO IS HOMELESS OR
ASSISTING A PERSON WHO IS HOMELESS WITH ANY ACT
RELATED TO BASIC SURVIVAL
WHEREAS, Senate Bill 634 (Perez) (“SB 634”), as amended, would prohibit local jurisdictions from adopting or enforcing ordinances that prohibit “a person or organization from providing support services, as specified, to a person who is homeless or assisting a person who is homeless with any act related to basic survival”; and
WHEREAS, SB 634 defines “Act related to basic survival” to include, among other things, providing items to assist with eating and drinking, sleeping, and “activities and items necessary for immediate personal health and hygiene”; and
WHEREAS, the City of Duarte supports and asserts its local authority and jurisdiction to address the health, safety, and welfare of its residents, visitors, and businesses in a manner most responsive to its local community; and
WHEREAS, the City of Duarte believes that SB 634 seeks to strip cities that are closest and best suited to respond to the needs of its local community; and WHEREAS, the proponents of SB 634 failed to adequately and substantively take into account the concerns and issues raised by local agencies regarding local control.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DUARTE,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the City of Duarte opposes the passage and adoption of SB 634 for its attempt to bypass local control and failure to respond to the needs of local jurisdictions best suited to determine what programs and policies are effective at addressing public health, safety, and welfare in regard to homelessness.
SECTION 2. That the City Manager shall submit this resolution to State legislators representing the City of Duarte and transmit a copy of this resolution to any committees considering this item for a vote.
