The Act further requires that local government agencies conduct a biennial review of its Code to determine whether an amendment to the designated positions or disclosure categories is required. The City Clerk and City Attorney have conducted this review and it has been determined that an amendment to the designated positions and disclosure categories is necessary. The Conflict of Interest Code was last amended in 2024. Staff has reviewed the Code and determined that there have been changes to the organizational structure and position responsibilities since the last review, deeming it necessary to update the list of designated positions and adopt an amended Code.
ITEM 13.A. (Business Items). Adoption of Social Media Policy Amendment - On April 2024, the City updated its social media policy to formalize guidelines and best practices to ensure accuracy of information being posted, establish outline expectations for employee use of social media, and set limits regarding what is and is not allowed to be posted on City social media sites. The City’s Social Media Policy (“Policy”) establishes guidelines that outline best practices for all City employees, officials, and designated personnel on matters related to the use of social media. The Policy sets standards for employee access to social media as well as personal use of social media, establishes rules and guidelines to follow when posting on social media, and defines content posted by the public that are subject to moderation or deletion if comments
violate the Policy. Recently, staff revisited the Policy and concluded that it did not specifically outline a process when posting on social media. Additionally, the City found a need to include engagement standards with government affiliated and local non-profit organizations, among other groups to create a more welcoming, accessible social media environment.

PUBLIC SAFETY
STATUS REPORT
September 2026
PROJECT/PROGRAM STATUS
L.A. COUNTY SHERIFF’S DEPARTMENT
1. Part 1 Crimes
Part 1 crime has increased by 18% compared to 2025 year-to-date. This increase continues to be primarily driven by larceny theft, including catalytic converter thefts and other vehicle-related crimes. Despite the recent increase, overall, Part I crime remains significantly below prior years, with Duarte experiencing a 16.1% reduction compared to 2021 yearto-date figures.
2. Special
Assignment Team
The Special Assignment Team is coordinating with the LA County HOST Team, Azusa Police Department, Irwindale Police Department, LA County Public Works, the U.S. Army Corps of Engineers, and regional homeless service partners on a large-scale Santa Fe Dam and San Gabriel Riverbed cleanup initiative. Over the next several months, coordinated operations are expected to address areas from the Santa Fe Dam toward Spillway 1 near Mountain Cove. Recent assessments identified approximately 180 individual encampments/tents throughout the broader project area. Unlike previous operations that primarily focused on outreach and clearing occupied encampments, this effort will also focus on removing accumulated trash, debris, and abandoned materials. Drones will assist with mapping and identifying difficult-to-access areas. Removing these materials is critical to reducing opportunities for areas to be quickly reoccupied, while also reducing fire hazards, protecting the riverbed’s natural environment, improving storm and El Niño preparedness, and addressing public safety concerns for surrounding neighborhoods.
Outreach and service connections will remain an important component of these coordinated operations.
The Special Assignment Team has also increased its focus on developing actionable intelligence from resident tips and video evidence related to Part I crime. Deputies are combining information submitted by residents and businesses with the City’s portable camera system and Flock network to identify vehicles, suspects, patterns, and potential connections between incidents. This approach allows the team to turn community provided information into workable investigative leads that can support case follow up and arrests. The strategy also reinforces the importance of residents promptly reporting suspicious activity and providing available video, as even small pieces of information can help investigators connect related crimes.
PROJECT/PROGRAM STATUS
3. Neighborhood/
Business Watch
Public Safety has opened additional opportunities for neighborhoods and individual blocks to request their own meetings. These gatherings give residents a direct opportunity to meet with deputies and Public Safety staff, discuss crime trends and quality-of-life concerns, share information, and receive practical prevention tips tailored to their neighborhood. Expanding the program helps strengthen communication, build trust, and encourage residents to take an active role in keeping their neighborhoods safe.
OUTREACH COORDINATION
1. Outreach
Coordination
Erika Ramos’s unofficial homeless count for the month is 6 individuals, based on three or more contacts within a two-week period. Individuals are removed from the list after six weeks of no contact. Over the past month, Erika has conducted 103 interactions with individuals experiencing homelessness, providing essential services and information on Duarte regulations.
Success Story
During outreach at Aloysia Park, an individual approached Erika and requested shelter assistance. Erika immediately connected him with LA CADA, which secured shelter and provided transportation. After later returning to Duarte, the individual developed medical needs that created an additional barrier to placement. SGV CARE assisted with transportation to urgent care and temporary lodging so he could receive treatment while LA CADA continued working toward an appropriate placement. Through continued coordination between Erika, LA CADA, and SGV CARE, the individual successfully entered recuperative care on August 31. This case demonstrates how sustained engagement and coordination between multiple service providers can address housing, medical, and behavioral needs that cannot always be resolved through a single referral.
New Resource: Gateways Enhanced Care Management
Outreach Coordinator Erika Ramos has identified a new resource for Duarte through Gateways Hospital & Mental Health Centers’ Enhanced Care Management Program. The program is a free Medi-Cal benefit for eligible individuals with complex needs, including people experiencing or at risk of homelessness, serious mental illness or substance use disorders, those transitioning from incarceration, and individuals moving between hospitals or other levels of care.
Eligible clients are paired with a Lead Care Manager and Community Health Worker who can coordinate mental health and substance use treatment, medical care, housing assistance, transportation, food and basic
PROJECT/PROGRAM STATUS
needs, employment and education assistance, and justice-system navigation.
Adding Gateways gives the City another option to complement the work already being performed by LA CADA, SGV CARE, Sycamores, and City outreach staff, particularly for individuals whose needs require longer-term care coordination. Gateways also provides access to a broader range of behavioral health services, including outpatient, residential, inpatient, addiction recovery, homeless, and forensic mental health programs. This additional partnership strengthens Duarte’s ability to connect individuals with the appropriate level of care rather than relying on a one-size-fits-all approach.
2. L.A. CADA The L.A. CADA Supplemental Team, dedicated to assisting individuals who are newly homeless or at risk of homelessness, first began their work in Duarte on September 22, 2022.
During this reporting period, the Supplemental Team engaged with 14 individuals, 5 of whom were first-time encounters and 9 follow-ups, and 0 individual(s) who refused supportive services. The primary areas with the highest number of encounters were identified as Pamela Park, however the LA CADA Team was advised that this location is within the County and not the City of Duarte.
Updated report was not available at the time of this report’s submission.
CODE ENFORCEMENT
1. Code Enforcement
Activity
Code Enforcement opened 52 new cases, closed 47 cases, and addressed 91 new violations throughout the City during August. The most common enforcement activity involved animal licensing, property maintenance, vegetation, vehicle-related violations, permit requirements, signage, and other neighborhood quality-of-life concerns. Staff ended the month with 214 active cases and will continue working with property owners and businesses to achieve voluntary compliance whenever possible, while using enforcement when necessary to protect neighborhood standards and public safety.
EMERGENCY PREPAREDNESS
1. Emergency
Operations Center
(EOC)
The City of Duarte is pleased to welcome Dr. Dora Mejia, PsyD, CAPEM, as the new Disaster Management Area Coordinator for Area D. Area D is part of Los Angeles County’s regional emergency management system and provides coordination and support to Duarte and neighboring jurisdictions before, during, and after emergencies. The Area D Coordinator serves as an important link between local cities, Los Angeles
PROJECT/PROGRAM STATUS
County, Cal OES, and other response partners, assisting with emergency planning, training, information sharing, resource requests, and regional coordination during major incidents. This partnership strengthens Duarte’s Emergency Operations Center operations and helps ensure the City has access to regional resources and assistance when they are needed most.
Dr. Mejia brings more than 22 years of experience in emergency management and disaster coordination, including preparedness, response, recovery, mitigation, grant management, and regional planning. Her background includes collaboration with FEMA, Cal OES, county government, healthcare, and higher education. We look forward to working closely with Dr. Mejia as Duarte continues strengthening its emergency preparedness, training, planning, and regional partnerships.

BACKGROUND
The Political Reform Act (Act) requires that local government agencies adopt a Conflict of Interest Code (Code) designating those positions which must disclose private financial interests that may influence governmental decisions and which financial interests are to be disclosed. REQUIREMENTS OF THE STATE OF CALIFORNIA FAIR POLITICAL
PRACTICES COMMISSION
WHEREAS, California’s Political Reform Act (Act) of 1974 imposed strict conflict of interest laws which prohibit a public official at any level of local government in making, participating in making, or in any way attempting to use their official position to influence a governmental decision in which they have a financial interest; and WHEREAS, in order to more effectively enforce these laws, the Act mandates that individuals holding certain positions in a local government agency must report and disclose their outside financial interests as described in the Act; and WHEREAS, the financial interests must be disclosed on a uniform Statement of Economic Interests form (Form 700) created and routinely updated by the California Fair Political Practices Commission (FPPC); and
WHEREAS, the Act (Government Code Section 87300 et seq.) requires each local government agency to promulgate and adopt a Conflict of Interest Code (Code); and WHEREAS, it is required that a local government agency’s Code reflects the current structure of the local government agency, identifies all current public officials who must disclose their financial interests, provides the ability to identify potential public officials and consultants who may have disclosure obligations once assuming office or starting service; and WHEREAS, to ensure accuracy of the Code, each local government agency is required to review its Code in even~numbered years (biennial review) and periodically submit the Code for updates through adoption of amendments; and
WHEREAS, Section 18730 of Division 6, of Title 2 of the California Code of Regulations contains the terms of a standard conflict of interest code, which must be incorporated by reference in a local government agency’s code, and which may be amended by the FPPC to conform to amendments in the Political Reform Act; and WHEREAS, the City of Duarte is a local government agency that has promulgated and adopted a Conflict of Interest Code as required by the Act and has included Section 18730 of Division 6, of Title 2 of the California Code of Regulations by reference; and WHEREAS, Section 2.44.030 of Chapter 2.44 of the Duarte Municipal Code specifies that the City Council shall adopt a resolution designating positions, the holders of which are required to file statements of economic interests, and the disclosure categories applicable to each position; and

SECTION 4. Positions no longer requiring disclosure under the Code or are otherwise eliminated by the City are deleted as shown via strikethrough in Appendix A.

SUBJECT: Adoption of Social Media Policy Amendment
RECOMMENDATION: It is recommended that the City Council adopt proposed amendments to the City’s Social Media Policy
FISCAL IMPACT: There is no fiscal impact associated with this item
STRATEGIC PLAN
IMPACT: Goal B – B2.1 Engagement, Outreach, and Communication
BACKGROUND
On April 2024, the City updated its social media policy to formalize guidelines and best practices to ensure accuracy of information being posted, establish outline expectations for employee use of social media, and set limits regarding what is and is not allowed to be posted on City social media sites.
To further the City’s goal in disseminating accurate and high-quality social media posts, City staff assessed the current policy and found the need to amend its Social Media Policy.
DISCUSSION/ANALYSIS
The City’s Social Media Policy (“Policy”) establishes guidelines that outline best practices for all City employees, officials, and designated personnel on matters related to the use of social media.
The Policy sets standards for employee access to social media as well as personal use of social media, establishes rules and guidelines to follow when posting on social media, and defines content posted by the public that are subject to moderation or deletion if comments violate the Policy.
Recently, staff revisited the Policy and concluded that it did not specifically outline a process when posting on social media. Additionally, the City found a need to include engagement standards with government affiliated and local non-profit organizations, among other groups to create a more welcoming, accessible social media environment.
Therefore, staff recommends that the Policy is updated to include the following amendments:
• Addition of Section IV(D) – The City Manager, at their discretion, may designate employees to post on the City’s social media pages.
Agenda Item: 13.A.
2 • Addition of Section V(B)(9) – All employees authorized to post items shall submit a draft for review to the department’s director (or city manager), or their designee before posting the item, in accordance with section VII of this Policy. • Addition of Section V(B)(10) - When appropriate, all employees authorized to post items should proactively engage with other local government, community non-profit organizations, local public service groups, and government affiliated pages. • Addition of Section VII. Social Media Post Request Process.
The proposed Policy Amendment establishes quality controls by formalizing a process to follow when posting on social media. The proposed Section VII reads as follows:
VII. SOCIAL MEDIA POST REQUEST PROCESS
A. Departments requesting to publish information on the City’s social media channels must submit a written request to the City Manager’s Office. To ensure staff has adequate time to draft the post, written notices should be submitted at least one week in advanced of the requested scheduled date.
B. The City Manager’s Office or authorized designee will review the request and coordinate with requestor to generate the requested post.
C. The City Managers Office or authorized designee will send requestor and department director a final draft and confirmed post date for review and approval. Department director may, at their discretion, designate staff to review and approve posts.
D. The Request Form Process relates to non-urgent City business or matters. If an urgent or emergency related post is needed, requestor may contact City Manager’s designated staff to request dissemination of information. Requestor and department director (or city manager) will receive final draft for review and approval. In the event that City Manager staff is not available during an urgent or emergency related matter, City Manager can authorize a department director to disseminate information.
RECOMMENDATION
It is recommended that the City Council adopt proposed amendments to the City’s Social Media Policy.

While employees do not need explicit permission from the City to utilize social media in their personal capacity, they are cautioned that certain restrictions may apply, including the limitations of receiving compensation, disclosing nonpublic information, and misusing a City title or official authority, even when they think they are acting in a personal capacity. Employees are encouraged to check with their department head if there are any questions or concerns.
VI. ADDITIONAL REGULATIONS FOR CITY OFFICIALS
A. This section of the Policy is adopted, in part, in light of California Assembly Bill No. 992, which authorizes members of a legislative body to use social media to communicate with the public, subject to statutory exceptions.
B. The City recognizes that social media has become an integral channel of communication for individual members of the public. However, such communications must be balanced
6 against legal obligations with respect to transparency in the conduct of the people’s business. For example, the Brown Act requires that legislative bodies of public agencies deliberate and take action openly (Gov. Code §§ 54950, et seq.). Moreover, communications regarding City business on private accounts may be subject to disclosure under the Public Records Act (Gov. Code §§ 6250, et seq.). To that end, the protocol described in this section will be followed.
C. Public Records Act: City officials shall be aware that their posts, comments, and responses about City business on social media platforms, whether on public or private pages, may be subject to disclosure under the Public Records Act.
D. First Amendment: City officials shall also be aware that their private social media accounts may be transformed into public forums where members of the public may have First Amendment rights. In determining whether a private social media page has become a public forum, courts have examined factors including:
1. How the official is referenced on the site (i.e., are they referenced as “Mayor” or “Chair”, or simply “Jane Doe”?);
2. How the page is titled (i.e., is the account registered as a governmental account or a private account?);
3. How the official “invites” users to use the page (i.e., in cases in which the account was deemed a public one, the public official solicited the public’s opinion on City matters);
4. Whether the official is “transacting” City matters on the site (i.e., replying to constituent comments regarding City business)
5. Whether City Employees help maintain and operate the site; and
6. Whether the official uses the site to engage directly with the public (i.e., replying to constituent comments regarding City business).
7. Whether an account is private, or public is fact-specific and depends on the totality of the circumstances. If there are reasons to believe that a City official’s private social media page has turned into a public forum, City officials should refrain from blocking members of the public from the page or deleting comments with which they disagree.
E. Brown Act: City officials may engage in separate conversations or communicate on social media platforms to answer questions, provide information to the public, or solicit information from the public regarding City business.
F. However, City official may not:
1. Discuss City business with a majority of members of commenting, or using digital icons (i.e., a thumbs up or an emoji);
2. Respond directly to another member’s communication, comment, or post if the two are on the same legislative body of the City and the topic concerns City business.
3. City officials must keep their social media presence separate from that of the City, and from that of other City officials. As such, the City recommends that City officials include the following language on their personal social media sites: “All content on this page is my own and not a reflection of the City of Duarte, its employees or other elected officials.”
VII. SOCIAL MEDIA POST REQUEST PROCESS
7 The City Manager’s Office and authorized designees are responsible for posting and maintaining information published on the City’s communication channels. This Policy establishes internal procedures to follow when requesting dissemination of information through the City’s social media channels for staff not authorized to post on social media.
A. Departments requesting to publish information on the City’s social media channels must submit a written request to the City Manager’s Office. To ensure staff has adequate time to draft the post, written notices should be submitted at least one week in advanced of the requested scheduled date.
B. The City Manager’s Office or authorized designee will review the requestf and coordinate with requestor to generate the requested post.
C. The City Manager’s Office or authorized designee will send requestor and department director a final draft and confirmed post date for review and approval.
VIII. RECORDS RETENTION
Social media sites contain communications sent to or received by the City and its Employees, and such communications may be public records subject to the Public Records Act. Retention requirements apply regardless of the form of the record (i.e., digital text, photos, audio, and video).
The Department maintaining a site shall preserve records, as may be legally required, pursuant to a relevant records retention schedule for the required retention period in a format that preserves the integrity of the original record and is easily accessible. Furthermore, retention of social media records shall fulfill the following requirements:
A. Social media records are captured in a continuous, automated fashion throughout the day to minimize a potential loss of data due to deletion and/or changes on the social networking site.
B. Social media records are archived in a system that preserves the context of communications, including conversation threads and rich media, to ensure completeness and availability of relevant information when records are accessed.
C. Social media records are indexed based on specific criteria such as date, content type, and keywords to ensure that records can be quickly located and produced in an appropriate format for distribution (e.g. PDF).
D. Each employee who administers one or more social networking sites on behalf of the City has self-service, read-only access to search, and produce relevant social media records to fulfill public information and legal discovery requests as needed.
E. The City utilizes an automated archiving solution provided by Pagefreezer to comply with applicable public records law and fulfill the above record retention requirements.
