Both of these units are represented by the Service Employees International Union, Local 721 (SEIU 721). Pursuant to the terms of the currently negotiated Memorandums of Understanding (“MOUs”), the City will contribute toward the cost of medical insurance. Pursuant to the terms of the Memorandums of Understanding (“MOUs”), Resolutions, and Contracts, the City will contribute toward the cost of medical insurance indexed to the cost of CalPERS Blue Shield Access Plus Los Angeles premiums. Healthcare premiums will change as of January 1, 2027, and as a result, the contribution needs to be adjusted. Please note that while the CalPERS Blue Shield Access Plus Los Angeles premiums will increase by 6.48% from the last negotiated City contribution to premiums, the City’s contribution as negotiated in the MOU allows for up to a 5% increase from the prior contributions. The final project cost was $208,707.07, which is below the authorized amount.

ITEM 13.A. (Business Items). Adoption of Registration Cancellation and Refund Policy for the Department of Parks and Recreation - The Department of Parks and Recreation’s current refund practice is that classes, activities, and excursions are advertised as non-refundable unless the Department cancels an offering and it will not be rescheduled. For its membership offerings currently being sold, the Department has handled refund requests on a case by case basis. However, to ensure consistency and transparency of the City’s terms before a customer registers and pays for a recreational offering, department leadership worked in collaboration with City staff, the Finance Department, and the Parks and Recreation Commission to provide the City Council with the proposed Department of Parks and Recreation Cancellation and Refund Policy. In terms of implementation timeline, City staff is proposing that the adopted policy take effect December 7, 2026. This would align with the Department’s registration start date for residents for the winter season and go live date of its new recreation software platform, Rec Tech. There is no fiscal impact associated with this item at this time.

*Source: City of Duarte general ledger. Note that the total cash balance as shown in the City's general ledger is not equal to the combined ending "Bank" and "LAIF" balances shown on the previous page. Because certain transactions are reflected at different times in the general ledger as compared to the City's bank account, the combined "Bank" and "LAIF" balances will rarely equal precisely the City's general ledger cash balance. The City performs a monthly "bank reconciliation" to reconcile these balances. **Funds with zero or negative cash balances are not shown above. Those with negative balances are offset against the General Fund cash balance.

COMMUNITY DEVELOPMENT

STATUS REPORT
October 2026

PROJECT/PROGRAM STATUS

DEVELOPMENT
Vallarta Supermarket
(1740 Mountain Ave.)
Vallarta Supermarket will be the new tenant for the former Best Buy building. Vallarta has over 60 supermarkets in California and is expanding quickly. Upgrades to the building shell are completed. Tenant improvements are underway. An October 21 opening is expected.

Andres Duarte School The project was approved at the September 23 City Council meeting. It includes construction of 169 townhomes and
renovation of Otis Gordon Park. The project is currently in the demolition and grading process.

SB 79 Overlay Zone SB 79 is a new State Law that requires California cities to allow high-density housing near transit stations. In Duarte, this means properties within ¼ mile of the Metro station. Many of these properties are single family houses. City Staff is working with a consultant to develop a plan that meets State
requirements but also produces the best possible outcome for our community. The first step in that process is a meeting with property owners that own properties in the impacted area. A meeting for impacted residents was held on September 14. 805 Highland Ave. Permits have been issued for a renovation and earthquake retrofit of the historic building at 805 Highland Avenue. This is a complicated project and may take some time, but it will preserve a local historic resource.
1501-1525 Huntington
Dr.

The development plan for the properties is moving forward.

The Town Center Specific Plan requires that these properties be developed together and that requirement has proven to be successful. The developer plans for some type of mixed use product for the property and is now considering various options. Staff has met with the development team to discuss development options and the City process. The developer plans to move forward in the next few months with an application for development.

Former Nissan
Dealership
The Nissan dealership on the northeast corner of Buena Vista Street and Central Avenue has permanently closed. The site is currently for sale. Staff has met with the broker team and

Page 62 of 82 ends

2 PROJECT/PROGRAM STATUS
discussed the City zoning requirements and way the property might be developed.
2400 Huntington Drive The City’s Housing Authority owns the property at 2400 Huntington Drive and has been working with Jamboree Housing to work on a plan for property sale and development.

Jamboree has purchased the adjacent property.

Jamboree plans to submit the entitlement package in October.

The project design requires Planning Commission approval. 1404-1414 Royal Oaks
Drive
Shuorung Properties LLC filed an application to construct 11 townhomes on the property at 1404-1414 Royal Oaks Drive, currently two single family homes. This requires
environmental, a general plan amendment, zone change and design review. The Architect is working on construction plans. 1401 Santo Domingo A 20-unit townhome development was approved for the property. The property was sold to a new owner that plans to develop the site. The owner plans to start construction soon.

Metro Parking Lot Staff has been working with Metro for the past several years on the development of the Metro parking lot as part of the Duarte Station Specific Plan. The intent is to replace the Metro parking into a parking structure and construct workforce housing along Fasana Road at Highland Avenue. Metro has awarded an
Exclusive Negotiating Agreement to Jamboree Housing. The plan is for a development with between 100-120 units of multigeneration housing. The developer recently informed the City that as a result of limited access to funding and Metro opposition to reducing the unit count, that the project will be on hold for a few months.

Town Center North Staff has been meeting with property owners to develop a proposal for a complete center rehabilitation that includes new, upgraded facades, an upgraded parking lot and related
improvements.

The first phase of the upgrade will be an upgrade of the parking lot, landscape and lighting and also façade enhancement to the future Sky Zone building.

Staff is working with Red Mountain Group, the main owner in the center. The goal is for the owner to assist the City in coordinating all the property owners.

The Sky Zone tenant improvement plans, façade enhancement plans and parking lot improvement plans are in plan check and the project is moving forward.

Page 63 of 82 ends

3 PROJECT/PROGRAM STATUS
Sky Zone A minor use permit was approved for Sky Zone trampoline park to occupy the former Big Lots space. Sky Zone is working with the building owner who is developing a plan for façade and parking improvements. Sky Zone is in plan check with its tenant improvement plans. The project included a significant structural and electrical upgrade, so the work will take some time to complete.

City of Hope
General Projects
The PRO building recently was issued building permits. This project is in the central portion of the campus to the east of the former Heritage Park. The campus circulation plan that is a part of the specific plan will also be completed including upgrades to Village Road and completion of Circle Road. The project is underway. Village Road improvements are scheduled to be completed by September 2027; building construction began in May 2026 and other roads and utility improvements are also in process.

Westminster Gardens Human Good, the owner, plans for a major campus expansion and has recently filed an application. The City hired MIG to assist in the preparation of the specific plan amendment and EIR. The request is for this expansion to accommodate up to 600 total units; this includes assisted living and memory care units, and mixed use. This project will take 12+ months, but Staff has had kick off meetings with the consultant and HumanGood and there is positive progress.

The Draft EIR for the project is completed and the 45 day public comment period will begin in October.
928 Huntington Dr. A 16-unit apartment development was approved for the property. The original developer could not move forward with construction. Staff recently met with the bank to discuss options for moving forward with construction.
1230 Huntington Proposed Wyndham Hawthorn Suites. A hotel was previously approved on this property, but the approval expired. The same owner has hired an Architect to develop a new hotel. The application is currently incomplete and Staff is working with the development team to ensure a complete application that can move forward.

Congresswoman Napolitano. Construction is underway and
should be completed by the end of 2026.

A project website has been set up to provided project
information and regular progress updates. Project signs have been installed that include a QR code to access the website. It can also be accessed from the City’s webpage.

Work in September included completing the paving,
intersection improvements and installation of the kinetic wind sculptures. A social media post promoted the wind sculptures and provided interesting information about the artist. In the coming weeks, the contractor plans to: install conduit for trail lighting; begin landscape and irrigation; and work to complete rest areas.

Huntington Drive
Greening and Traffic
Calming Project
The City has recently been awarded a $2.1 million Metro Active Transport Program (MAT) grant to complete the project. This plan is in the CIP but had not yet been funded. The Huntington Drive Greening and Traffic Calming plan was approved by the Council in 2019 and was an implementation item from the Town Center Specific Plan. The project includes completing bulb outs, parking space marking, pedestrian lighting and sidewalk improvements on Huntington Drive between Buena Vista and Highland. It also includes pedestrian lighting and sidewalk improvements on the west side of Highland from Huntington Drive to the Freeway.

Encanto Park Infiltration
Project
As a member of the Rio Hondo/San Gabriel River Watershed Management JPA a water infiltration project is being proposed at Encanto Park. The plan is to locate the structure in the park area under the soccer field. The City will get a new soccer field, some other park improvements, new landscape and a parking lot repave. The JPA is working with City Staff on developing lease and maintenance agreements. The JPA’s design team is preparing final plans and bid documents. The project is fully funded and the current plan is to have the bid process start in Spring 2027 and construction in Fall 2027.

Kellwil Traffic Signal Construction is completed and the signal is expected to be in operation sometime in October.

Annual Striping Project The 2026-27 project is currently in process. This citywide project will be in construction by mid-October.

Annual CDBG Curb
Ramp Project

The City’s contribution towards healthcare premiums as of January 1, 2027 will be $897.63, $1,795.30 and $2,333.91 for employee only, employee + 1 and employee + 2 or more. AGENDA REPORT
MEETING DATE: October 13, 2026
TO: Mayor and Members of the City Council
FROM: Manuel Enriquez, Director of Parks and Recreation SUBJECT: Adoption of Registration Cancelation and Refund Policy for the Department of Parks and Recreation
RECOMMENDATION: Staff recommends City Council adopt the proposed Registration Cancelation and Refund Policy for the Department of Parks & Recreation
FISCAL IMPACT: There is no fiscal impact associated with this item at this time

STRATEGIC PLAN
IMPACT: Goal D – D2.1 Financial Sustainability

BACKGROUND
The Department of Parks and Recreation’s current refund practice is that classes, activities, and excursions are advertised as non-refundable unless the Department cancels an offering and it will not be rescheduled. For its membership offerings currently being sold, the Department has handled refund requests on a case by case basis. However, to ensure consistency and transparency of the City’s terms before a customer registers and pays for a recreational offering, department leadership worked in collaboration with City staff, the Finance Department, and the Parks and Recreation Commission to provide the City Council with the proposed Department of Parks and Recreation Cancelation and Refund Policy.

DISCUSSION/ANALYSIS
The proposed Department of Parks and Recreation Cancelation and Refund Policy reaffirms that in the event that the Department cancels an offering or activity, no action is required by a registrant, as refunds will automatically be processed to the original form of payment with the exception of payments made by cash or check, as those require a three to five week processing timeframe to account for the City’s Warrant Request Schedule. The policy also establishes that cancelation and refund requests must be generated by the registrant through the Department’s registration software system. This change ensures that all requests are routed and filtered through one centralized system and reviewed within five business days by the Department.

A new transfer option has been introduced into the policy to better accommodate customer requests within each season of offerings; however, it must be to an activity or program of equal or greater value. Additionally, the policy sets the precedent that all approved refund requests are subject to a ten percent administrative processing fee and all offerings priced at $15 or less are considered final Agenda Item: 13.A.

Page 79 of 82 ends

2 at the time of checkout and non-refundable.

In terms of the Department’s Travel Together offerings, the policy clearly defines that refund requests for excursions will only be issued if the registrant’s spot can be filled off the established waitlist as excursion tickets and transportation are generally coordinated months in advance by the City. With respect to memberships, the policy indicates that all memberships, monthly and annually, are non-refundable with the exception of a certified medical condition that prevents a member from using their membership. At that time, the Department may consider a membership freeze or prorated refund.

Finally, as it relates to Facility Rentals, the policy reiterates the City’s already established Facility Use Policy. Cancelations made 60 or more days before the rental date will receive a full refund.

Cancelations made 14-59 days before the rental date will forfeit 50% of the cleaning and damage bond. Cancelations made less than 14 days before the rental date forfeit all fees.

In terms of implementation timeline, City staff is proposing that the adopted policy take effect December 7, 2026. This would align with the Department’s registration start date for residents for the winter season and go live date of its new recreation software platform, Rec Tech.

RECOMMENDATION
Staff recommends City Council adopt the proposed Cancelation and Refund Policy for the Department of Parks & Recreation.

FISCAL IMPACT
There is no fiscal impact associated with this item at this time.

Department of Parks & Recreation
Registration Cancelation & Refund Policy
General Information
In the event that the Department cancels an offering or activity, no action is required by a registrant, as refunds will be processed automatically to the original form of payment used at the time of registration.

Note, cash or check transactions will be refunded by check to the payer’s address on file and take 3 to 5 weeks for processing.

All other cancelation and refund requests must be generated by the registrant through the Department’s registration software system to start the administrative review process.

Cancelation requests must be submitted at least 14 days prior to the offering or activity with the exception of swim lessons, which require a minimum of 5 days prior. Refund requests submitted after these deadlines will not be considered.

Refunds or future account credits are not issued for absences or code of conduct violations.

All refund requests will be reviewed on a case-by-case basis by the Department and may take up to 5 business days for determination.

Transfers
Whenever possible, the Department may accommodate a transfer to another activity/session within the respective season or from one child to their sibling. All transfer requests must be to a program of equal or greater value and prior to the start of the program.

Refund Minimum
Department offerings and activities priced at $15 or less are non-refundable. Payment for these is final at the time of registration.

Administrative Processing Fee
Approved refunds may be subject to a non-refundable 10% administrative processing fee from the total refund amount.

Excursions and Trips
Due to advance ticket purchases and transportation coordination, refund requests will only by issued if the registrant’s space can be filled by the waitlist.

Page 81 of 82 ends

Memberships
Memberships are non-refundable. However, in the event of a certified medical condition that prevents a member from using their membership, the Department may consider a prorated refund or membership freeze.

Facility Rentals
Facility rental refunds follow the City's Facility Use Policy. Cancelations made 60 or more days before the rental date will receive a full refund. Cancelations made 14-59 days before the rental date will forfeit 50% of the cleaning and damage bond. Cancelations made less than 14 days before the rental date forfeit all fees.
