The Honorable Patrick J. Fuchs
Chairman
Surface Transportation Board
395 E Street SW
Washington, DC 20423
Subject: Support for Union Pacific and Norfolk Southern Merger, Docket Number: FD 36873 Dear Chairman Fuchs:
As Mayor of the City of Dunsmuir, CA I am writing to express my strong support for the proposed merger between Union Pacific and Norfolk Southern.
Freight rail is a cornerstone of our state’s economy, safely moving the goods that power our industries, support our farmers and connect our communities to markets across the nation and the world. Union Pacific has long been an essential transportation partner for our state, providing efficient, reliable and cost-effective service to large and small businesses. The American freight rail network is not only critical to our economic growth – it is also one of the most sustainable modes of transportation available, helping reduce highway congestion and emissions.
The proposed merger offers a unique opportunity to strengthen this network and deliver tangible benefits for shippers, consumers and communities, including:
• Improved Service Reliability: More direct routes and greater operational flexibility will help prevent service disruptions and improve schedule dependability. • Reduced Transit Times: Eliminating certain interchanges will speed the movement of goods, helping our businesses reach customers faster and more competitively. • Increased Investment: The transcontinental railroad will be better positioned to invest in modern infrastructure, advanced technology and enhanced safety systems. • Expanded Reach: The broader geographic footprint will open new markets for our state’s products and strengthen supply chain resilience.
This merger is about more than just railroads – it’s about securing the future of our transportation network, supporting economic development and ensuring American freight rail remains globally competitive.
I respectfully urge the Surface Transportation Board to give full and favorable consideration to this proposal, recognizing the benefits it will bring to our state and the national economy.
Sincerely,
Juliana Luchessi, Mayor

RE: Maintenance of Effort – Public Safety MEETING DATE: 8/20/26 SUBMITTED BY: Blake Michaelsen, Finance Director
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL:
The City Council is being asked to pass Resolution No. 2026-xx certifying the fiscal year 26/27 calculation of the adopted budget meets the Maintenance of Effort requirements.
BACKGROUND/DISCUSSION:
In 1992, the CA Legislature and the Governor shifted funds from counties/cities to educational entities. To help offset that shift, there was a voter approved ½ cent sales tax appropriated for public safety; Proposition 172.
Each year, the city must certify that the public safety budget meets maintenance of effort requirements according to the base year of 92/93. If the City does not spend equal to or more than the base year of 92/93, there is a potential loss of Prop 172 funds. The Base year amount is adjusted each year to account for changes, like inflation. The figures used in the MOE calculations are taken directly from the city budget figures for the Law Enforcement and Fire Department.

BACKGROUND
One June 27, 2017, the Governor approved Senate Bill 94, the Medicinal and Adult-Use Cannabis Regulation and safety ACT (MAUCRSA), which created one regulatory system for commercial cannabis activity. This legislation allowed jurisdictions to either permit or prohibit cannabis activity within their jurisdictions. 016
One December 17, 2017, the City of Dunsmuir City Council adopted Ordinance No. 558, establishing business license regulations for the commercial cannabis industry. He Council followed with adoption of Ordinance No. 559 on July 5, 2018, which codified a voter-approved cannabis industry tax. Additionally, on February 7, 2019, the City Council adopted Ordinance No. 560 adding sections 17.10.101, 17.10.020, and 17.10.030 to the Dunsmuir Municipal Code (DMC) to further define cannabis operations and allow certain aspects and licenses of the cannabis industry as permitted and conditionally permitted uses in certain zoning districts.
As it relates to the proposed request to allow a storefront commercial cannabis retail store located at 5838 Dunsmuir Avenue, the project site is in the Dunsmuir’s Town Center (TC) zoning district. Per DMC Section 17-108.050, storefront retail of cannabis is permitted in the TC zoning district subject to approval of a Conditional Use Permit and compliance with the provisions of Ordinance No. 558.
PROJECT OVERVIEW
On July 8, 2026, the Planning Commission held a public hearing of the request for a Conditional Use Permit allowing establishment of a storefront commercial retail cannabis dispensary within an existing building located at 5838 Dunsmuir Avenue.
Following public testimony, the Commission voted to deny the application. The basis for denial was concern regarding the business’s proximity to the adjacent Community Resource Center. All public comment received at the hearing came from individuals associated with or supportive of the Resource Center.
While the Commission’s concern was understandable, the rationale for denial was not supported by the adopted regulatory framework governing cannabis uses in the City of Dunsmuir. Under both MAUCRSA (state law) and the Dunsmuir Municipal Code, only the following uses qualify as “sensitive uses” requiring separation or buffer from cannabis retail operations:
• Schools
• Licensed daycare centers
• Youth centers (as defined in Health & Safety Code §11353.1) The adjacent Community Resource Center does not meet any of these definitions, as it is a tenant-operated nonprofit providing general community services for example: food pantry or similar, arts and crafts classes, a small garden/play area, and community support in a multitude of areas. It is not municipally operated, does not hold educational or childcare licenses, and is not recognized as a youth center under state law. Therefore, no buffer applies, and the proposed cannabis use is considered locationally compliant at both a state and local level.
The applicant has appealed the Commission’s decision, asserting that the denial was based on subjective concerns rather than adopted standards. Staff concur that the application meets all objective requirements of the Dunsmuir Municipal Code and state cannabis regulations. This appeal provides the City Council with an opportunity to apply the correct legal criteria and determine whether the project is consistent with adopted regulations.
The subject property is located in the Town Center (TC) zoning district and is not within the 600-foot buffer of any sensitive uses (schools, day cares, youth centers, public parks) and is out-side of the 100-foot requirement of any libraries, children’s parks, football fields, or other community buildings, parks or recreations areas as defined in DMC 5.05.040 017
(Separation requirements). The project would include interior alterations for product storage, security measures and point-of-sale counter. The exterior would be altered by the installation of new business signage.
As designed, the retail cannabis dispensary will be accessed through the existing storefront access, and deliveries will utilize the existing street parking.
Surrounding land uses include various retail/commercial businesses in each direction including a community resource establishment.
Environmental Review:
This project is exempt from the California Environmental Quality Act (CEQA), per Sections 15301, 15332, and 15061(b)(3).
Analysis:
The proposed use of building has been reviewed as has been found to be an appropriate use for the Town Center zoning district due to its compatibility with the existing neighborhood. The project has not received any negative responsesfrom reviewing agencies and is considered a reasonable request. Accordingly, staff recommend project approval based upon and subject to the following recommended findings and conditions of approval.

d) Find that the project, as conditioned, is compatible with surrounding land uses and would not be detrimental to the health, safety, and general welfare of the residents of the City of Dunsmuir.
CLOSING SUMMARY
The Planning Commission’s denial was based on concerns about proximity to the Community Resource Center. Those concerns came entirely from public testimony offered by individuals associated with or in support of the organization.
While community input is an essential part of the land-use process, our decisions must ultimately rely in the standards that have been adopted by the Council.
Under both state law and the Dunsmuir Municipal Code, only three uses qualify as sensitive uses requiring separation from cannabis retail: schools, licensed daycare centers, and youth centers. The adjacent Resource Center does not meet any of those definitions. It is not municipally operated, not licensed as a childcare or educational facility, and not recognized as a youth center under Health & Safety Code §11353.1.
The appeal before you tonight is an opportunity to apply the ordinance as written and ensure consistent, fair, and legally defensible land-use decision-making.
For these reasons, staff recommend that the Council grant the appeal and approve the Conditional Use Permit.
SUGGESTED MOTION
Move that The City Council hereby grants the appeal, overturns the Planning Commission’s denial, and adopt the findings that the proposed project as conditioned is exempt from CEQA, will not have a significant adverse effect on the environment, that it is consistent with Title 17 of the Dunsmuir Municipal Code and Dunsmuir General Plan, and is compatible with surrounding land uses, and that we adopt Resolution 2026-XX approving the Dunsmuir Cannabis Company conditional use permit located at 5838 Dunsmuir Avenue, subject to the conditions of approval attached as Exhibit A.
