VIA: Jaime M. Fontes, City Manager
BY: Rachel Horst, Housing and Economic Development Manager SUBJECT: David Rosen & Associates Contract Amendment
Recommendation
Adopt a Resolution:
1. Appropriating $45,000 from the following Funds: Measure HH (F219), Housing Successor (F220), and General Fund (010); and
2. Authorizing the City Manager to execute an amendment to the Agreement with DRA that increases the not-to-exceed amount to $170,000 and allows for an additional oneyear extension of the contract term with approval of the City Manager; and
3. Rescinding Resolution No. 01-2022.
Alignment with City Council Strategic Plan
This recommendation is primarily aligned with:
Priority No. 6: Create a Healthy and Safe Community
Background
On January 18, 2022, the City Council directed staff to engage David Rosen & Associates to perform analyses related to the proposed East Palo Alto Opportunity to Purchase Act (“EPA OPA”) and potential revenue sources to support affordable housing activities. This work required an increase to the existing not-to-exceed amount of $125,000 in the current professional services agreement with DRA (“DRA Agreement”).
Resolution No. 01-2022, which authorized the City Manager to execute an amendment to the DRA Agreement, included an appropriation of $40,000 and corresponding increase in the notto-exceed amount from $125,000 to $165,000. This was a staff error; the increase should have been $45,000, for a not-to-exceed amount of $170,000.
The purpose of this staff report is to correct the error in Resolution No. 01-2022 and clarify that the not-to-exceed amount is $170,000.
Analysis
The replacement resolution is provided as Attachment 1.
Next Steps
If adopted by the City Council, the resolution will authorize the City Manager to execute the amendment to the DRA Agreement. After payment of any outstanding invoices, this will close out the DRA Agreement.
Fiscal Impact
The fiscal impact of a $40,000 appropriation was discussed in the January 18, 2022 staff report. The action associated with this staff report is to increase the appropriation to $45,000. Staff recommend that this additional $5,000 be appropriated from the Housing Successor Fund (F220).
Public Notice
The public was provided notice by making the agenda and report available on the City’s website and at the San Mateo Co. Library located at 2415 University Avenue, East Palo Alto.
Environmental
The action being considered does not constitute a “Project” within the meaning of the California Environmental Quality Act (CEQA), pursuant to CEQA Guideline section 15378 (b)(5), in that it is a government administrative activity that will not result in direct or indirect changes in the environment.
