A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
AUTHORIZING THE CITY MANAGER TO EXECUTE A FIRST AMENDMENT TO THE CONTRACT WITH ZOON ENGINEERING TO INCREASE THE BUDGET BY $49,830 FOR A NEW NOT-TOEXCEED TOTAL OF $1,035,925 FOR CONSTRUCTION MANAGEMENT SERVICES PERTAINING
TO THE BAY ROAD PHASE II/III IMPROVEMENT PROJECT
WHEREAS, the Bay Road Improvements Phase II/III Project (“Project”) along Bay Road and Pulgas Avenue includes construction of underground utilities, complete street bicycle and pedestrian improvements, and pavement rehabilitation; and
WHEREAS, the City Council approved Resolution No. 10-2020 on January 21, 2020, approving a construction management contract with Zoon Enginering for the construction management, inspection, and materials testing for the Project; and
WHEREAS, over the course of construction a number of changed conditions were encountered during the installation of underground utilities which required additional time to complete the project; and
WHEREAS, the project was completed in February 2022, however, additional construction management services are needed through summer 2022 for review and approval of project As-Builts (construction drawings), support with Caltrans grant closeout documentation, execution of change orders, and support with claim settlement; and
WHEREAS, grant funds through the Economic Development Administration, and a local match are available to fund the contract amendment.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY authorizes the City Manager to execute a first amendment to the contract with Zoon Engineering to increase the contract budget by $49,830 for a new not-to-exceed total of $1,035,925 for construction management services pertaining to the Bay Road Phase II/III Improvements Project.
