CITY COUNCIL

STAFF REPORT
DATE: June 7, 2022
TO: Honorable Mayor and Members of the City Council
VIA: Patrick Heisinger, Interim City Manager
BY: Patrick Heisinger, Interim City Manager
SUBJECT: Proposed Contract Amendment with Verde Designs for the Martin Luther King Jr.

Park Master Plan
Recommendation
Adopt a Resolution (Attachment 1) authorizing the Interim City Manager to execute an amendment to the contract with Verde Designs for the Dr. Martin Luther King, Jr. (MLK) Park Master Plan process to accommodate additional California Environmental Quality Act (CEQA) related tasks.

Background
On July 20, 2021, the City Council adopted a resolution authorizing the City Manager to enter into a two-year agreement with Verde Designs in an amount not-to-exceed $271,713 to complete a Master Plan for the proposed MLK Park expansion project. The estimated costs associated with the Master Plan process included the following elements:

Item Cost Estimate
Master Plan Process $90,460.00
Site Survey $18,260.00
CEQA $162,993.60
Total $271,713.60
On March 22, 2022, the City Council and Planning Commission hosted a joint Study Session regarding the proposed conceptual plan for MLK Park. At the conclusion of the meeting, the City Council unanimously approved the proposed conceptual plan and directed the City’s consultants to initiate the CEQA process for the Master Plan.

On May 18, 2022, Verde Design notified the City that, based on the revised conceptual plan, additional CEQA work would be required to complete the CEQA process, as follows:
· Expanded Site for Archaeological Survey
· Additional Noise Modeling for Recreational Facilities · Additional Air Quality for Larger Site
· Updated Methodology for Traffic Counts
The estimated cost associated with these updated services is $14,681.

Please see Attachment 2 for a detailed accounting of the proposed Additional Services related to CEQA analysis.

Analysis
Staff recommends that the City Council authorize an increase to the contract with Verde Designs for the MLK Park Master Plan by $20,000 to account for the items described in this staff report. This amount would accommodate any additional CEQA efforts that may arise and would set contractual not-to-exceed amount at $291,713.60.

Fiscal Impact
The $20,000 would be funded by the City’s General Fund Reserve.
