SUBJECT: David J. Powers Agreement for Environmental Review Services Recommendation
It is recommended that the City Council adopt a Resolution amending an agreement with David J. Powers to complete environmental review services on behalf of the City.
On July 27, 2021, the City Council adopted a Resolution authorizing the City Manager to execute an agreement with David J. Powers (“DJP”) to complete environmental review services in the amount of $90,000.
DJP has been providing services connected to the City’s potential acquisition of the property located at the corner of Bay Road and Pulgas Avenue for a future public library.
On December 7, 2021, DJP provided the City with the Environmental Site Analysis (“ESA”) for the property in question and the results of the ESA warrant a Phase II Site Assessment, which was not included in the original scope of work.
Analysis
DJP estimates it will cost an additional amount of $14,937 to complete the Phase II Site Assessment. Staff is requesting an additional $5,000 in authority in the event a minor, unforeseen issue arises prior to completion of the environmental review process. The total increase of the contract would be $19,937 for a total not to exceed amount of $109,937, as reflected in the resolution (Attachment 1).
Proposed Amended Contract Terms
Contract Amount: $109,937
Term: Two Years (remains unchanged)
Extension Provisions: Two (2) six (6)-month extensions at the discretion of the City Manager (remains unchanged)
DJP anticipates that the Phase II Site Assessment would be completed within 30-days of amended contract being executed.
Fiscal Impact
This General Fund activity is not budgeted in FY 2021-22. Given the current and on-going projection of General Fund deficit, the amount of $19,937 will be appropriated and funded from one-time General Fund Reserves.
Environmental
The action being considered does not constitute a “Project” within the meaning of the California Environmental Quality Act (CEQA), pursuant to CEQA Guideline section 15378(b)(5), in that it is a government administrative activity that will not result in direct or indirect changes in the environment.
