RESOLUTION NO. __________
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
APPROVING AN INCLUSIONARY HOUSING ALTERNATIVE COMPLIANCE OPTION FOR A TWO-UNIT RESIDENTIAL DEVELOPMENT PROJECT AT LINCOLN STREET (APN 063-186-270) WHEREAS, on November 19, 2020, the City Council of the City of East Palo Alto (“City Council”) adopted Ordinance No. 425 (“Ordinance”), adding Chapter 18.37 – Inclusionary Housing to the City of East Palo Alto Municipal Code; and
WHEREAS, an application for a residential development consisting of two units and one detached Accessory Dwelling Unit (“ADU”) that provides one attached ADU as an inclusionary unit on a vacant lot on Lincoln Street (“Project”), was submitted on May 5, 2022; and WHEREAS, the Project is subject to the Ordinance, since it is a new residential development project; and
WHEREAS, the Project’s inclusionary obligation is to provide an In-Lieu Fee Payment equal to
0.4 of a unit;
WHEREAS, Section 18.37.080(D) of the East Palo Alto Municipal Code allows for an applicant of a residential development to propose an Alternative Compliance Option to meet its inclusionary obligation, and this Alternative Compliance Option must be approved by the City Council; and WHEREAS, in lieu of paying an In-Lieu Fee equal to 0.4 of a unit, the Developer proposes to provide one attached ADU to rent to a 35% Area Median Income (“AMI”) Household, as defined in the Ordinance, as an Alternative Compliance Option for the Project; and WHEREAS, no Planning approvals or clearances may be issued for a residential project unless the inclusionary housing requirements are first met.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY:
1. Finds that the proposed Alternative Compliance Option for the Project to provide, instead of an In-Lieu Fee Payment equivalent to 0.4 units, one attached Accessory Dwelling Unit to be rented separately to 35% Area Median Income Households, satisfies the requirements of Section 18.37.080(D) of the East Palo Alto Municipal Code; and
2. Directs the City Manager to execute all necessary documents, in a form approved by the City Attorney, associated with the inclusionary housing requirements of the Project.
