SUBJECT: Notice of Completion - Bay Road Phase II & III Recommendation
Adopt a Resolution accepting the Bay Road Phase II & III Project, CIP-ST-05A-13, authorizing the recordation of the Notice of Completion with the County of San Mateo, and releasing the contract retention balance.
Alignment with City Council Strategic Plan
This recommendation is primarily aligned with:
Priority No. 1: Enhance Public Safety and Emergency Preparedness Priority No. 2: Enhance Economic Vitality
Priority No. 4: Improve Public Facilities and Infrastructure Priority No. 6: Create a Healthy and Safe Community
Background
The Bay Road Improvements project occurred along Bay Road from University Avenue to Cooley Landing Park. Now completed, the improvements create a gateway to the Ravenswood Business District, consistent with the goals, policies, and standards of the Ravenswood Business District / 4 Corners Specific Plan, and provide the community a walkable downtown along Bay Road with complete street bicycle and pedestrian access out to Cooley Landing Park and the Bay Trail.
Phase I of the project, completed in 2008, installed pedestrian, safety, and streetscape improvements along Bay Road from University Avenue to Clarke Avenue.
Phase II included undergrounding overhead utilities (under the PG&E Rule 20A program) and constructing complete street, utility, and landscape improvements from Clarke Avenue to Pulgas Avenue. The Rule 20A portion of this project was completed in 2017.
Phase III continued these improvements from Pulgas Avenue to the Cooley Landing Park entrance. Also included with the Phase II & III improvements are the downstream storm drainage improvement to carry stormwater from Bay Road/RBD area along Pulgas Avenue to the Runnymede outfall and channel.
Analysis
The construction work commenced on April 27, 2020 and was completed on March 3, 2022.
The project was inspected throughout construction and was accepted by staff in Spring of 2022. The construction of the project is complete, and retention must be released to the contractor for the work that has been completed. The retention funds are due to the Contractor for completed work that has been accepted by the City. In addition, a Notice of Completion (NOC) needs to be recorded with the County to formally complete the project.
Although the project is complete and staff is recommending the release of the retention payment, the contractor has submitted two claims which are under review. The review and settlement of claims are independent from the retention release.
Fiscal Impact
The City is currently holding a retention balance in the amount of $659,753.31 to be released upon acceptance of the improvements by the City and within 35 days after recordation of the Notice of Completion. These funds are available and have been previously allocated by the City Council in the project budget.

The public was provided notice of this agenda item by posting the City Council agenda on the City’s official bulletin board outside City Hall and making the agenda and report available at the City’s website and at the San Mateo Co. Library located at 2415 University Avenue, East Palo Alto.
Environmental
