CITY COUNCIL
STAFF REPORT
DATE: January 6, 2023
TO: Honorable Mayor and Members of the City Council
VIA: Patrick Heisinger, Interim City Manager
BY: Patrick Heisinger, Director of Emergency Services/Interim CityManager SUBJECT: Proclamation of Local Emergency
Recommendation
Adopt a resolution ratifying and extending the proclamation of local emergency by the City of East Palo Alto’s Director of Emergency Services.
Background
Section 2.76 of East Palo Alto Municipal Code empowers the Director of Emergency Services (“Director”) of the City of East Palo Alto to proclaim a local emergency when the City is threatened by conditions of disaster or extreme peril to the safety of persons and property within the City that are or are likely to be beyond the control of the services, personnel, equipment and facilities of the City and require the combined forces of other political subdivisions to combat and the City Council is not in session.
Under Chapter 2.76 of the East Palo Alto Municipal Code, the Director’s Proclamation of Local Emergency remains in effect for no more than seven days, unless the proclamation has been ratified by the City Council.
Analysis
On January 5, 2023, in my role as Director of Emergency Services, I issued a proclamation of local emergency (Attachment 1) in East Palo Alto due to the damage and impacts resulting from the extreme and unprecedented levels of rainfall and associated severe weather over the last several days. As you know, communities throughout the County of San Mateo suffered from an array of impacts which created conditions of disaster and extreme peril to the safety of persons and property within both the unincorporated and incorporated areas of San Mateo County.
As noted under Chapter 2.76 of the East Palo Alto Municipal Code, a proclamation of local emergency declared by the Director of Emergency Services shall remain in effect for no more than seven days unless it is ratified and extended by the City Council.
3.1 Packet Pg. 3
In light of current circumstances, I recommend the City Council ratify and extend the proclamation of local emergency by adopting the attached Resolution (Attachment 2). Under the City’s Code, the City Council must review the proclamation of local emergency at least once every sixty days to determine the need for continuing the local emergency.
Fiscal Impact
There is no fiscal impact associated with the items described in this staff report. By ratifying the Director’s Proclamation, the City Council will better position the City to recapture expenses that occur as part of the emergency.
Public Notice
The City Council’s Agenda for the Special Meeting held on January 6, 2023, was made available on the City’s website and at the San Mateo Co. Library located at 2415 University Avenue, East Palo Alto.
Environmental
The action being considered does not constitute a “Project” within the meaning of the California Environmental Quality Act (CEQA), pursuant to CEQA Guideline section 15378 (b)(5), in that it is a government administrative activity that will not result in direct or indirect changes in the environment.
