A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
AUTHORIZING THE CITY MANAGER TO EXECUTE A FINAL CONTRACT AMENDMENT WITH VERDE DESIGNS FOR AN ADDITIONAL $55,000 FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $341,394.60 TO COMPLETE A MASTER
PLAN FOR MARTIN LUTHER KING JUNIOR PARK
WHEREAS, On July 20, 2021, the City Council adopted a resolution selecting Verde Design as the lead consultant to complete the master plan for MLK Park and directing the City Manager to negotiate a scope and terms for an agreement with Verde Design and entered into an agreement for a not-to-exceed amount of $271,713.60; and WHEREAS, on June 7, 2022 City Council approved an amendment to the agreement with Verde Design to continue their work for the Martin Luther King Junior Park Master Plan by an amount not to exceed $20,000; and WHEREAS, on September 21, 2022 Verde Designs notified City staff that unanticipated soil testing would be required on the Beech Street parcel that the City seeks to utilize in the expansion of Martin Luther King Jr. Park Plan; and WHEREAS, on January 9, 2023, staff received communication from Verde Designs that the noise impact review section of CEQA was complete and would not require additional resources but an additional Phase II of soil testing would be required to move forward in the process; and
WHEREAS, the City is interested in acquiring the Beech Street parcel and is vital to complete a comprehensive environmental review process; and
WHEREAS, to complete the Park Master Plan, soil testing and ascertaining the level of contamination is imperative to determine the permissible uses on this parcel of land; accordingly, staff is requesting an additional $55,000 to complete said soil testing and provide for any unforeseen task related to this CEQA process that is slated for completion by May 2023; and
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY authorizes the City Manager to execute a final contract amendment, in a form approved by the City Attorney, with Verde Designs, for an additional $55,000 for a total not-to-exceed amount of $341,394.60 to complete a Master Plan for Martin Luther King Park.
