A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
ACCEPTING THE HOUSING ELEMENT ANNUAL PROGRESS REPORT, GENERAL PLAN
ANNUAL PROGRESS REPORT, AND HOUSING SUCCESSOR TO THE REDEVELOPMENT
AGENCY ANNUAL REPORT, AND DIRECTING THE CITY MANAGER TO FILE THE REPORTS
WITH THE APPROPRIATE STATE AUTHORITIES
WHEREAS, Government Code Section 65400 requires the City of East Palo Alto (“City”) to file an annual progress report (“Housing Element Annual Progress Report”) documenting the progress in the City’s implementation of housing programs, using forms and definitions recommended by the California Department of Housing and Community Development (“Department”), with the Department and the Governor’s Office of Planning and Research (“OPR”) by April 1st of each year; and WHEREAS, Government Code Sections 65400 and 65700 require that the City file an annual report (“General Plan Annual Progress Report”) documenting progress in the City’s implementation of its General Plan with OPR by April 1st of each year; and
WHEREAS, Health and Safety Code Section 34176 requires the City to file an annual report (“Housing Successor to the Redevelopment Agency Annual Report”) describing how the City, acting as Successor to the former Redevelopment Agency of the City of East Palo Alto, has utilized its former Redevelopment Agency funds for housing activities in conformance with the Health and Safety Code; and WHEREAS, on March 21, 2023, via Resolution No. PC _____, the City of East Palo Alto Planning Commission recommended that the City Council direct the City Manager to file the above-referenced reports with the appropriate State authorities.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY:
1. Accepts the following annual reports: 2022 Housing Element Annual Progress Report; 2022 General Plan Annual Progress Report; and Housing Successor to the Redevelopment Agency Annual Report;
2. Authorizes the City Manager (or designee) to submit the above-referenced reports to the appropriate State authorities; and
3. Finds that the acceptance and submittal of the above-referenced reports are exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline Sections 15061(b)(3) and 15306 based on evidence in the administrative record.
